Abstract The process of settlement customs violations carried out by traditional institutions that act as customary justice be gradual manner. Abstract

AbstrakFungsi penegakan hukum dalam rangka menjamin keamanan, ketertiban dan HAM. Dalam rangka itu, kepolisian diberikan wewenang oleh undang-undang sebagai penyidik. Penyidikan dilakukan sebagai upaya proses menetapkan siapa pelaku yang melanggar hak-hak asasi tersangka namun untuk menjamin hak-hak asasi yang lebih luas dari masyarakat umum. Pelanggaran hak-hak asasi tersangka oleh penyidik dapat dibenarkan sepanjang yang dibenarkan undang-undang (KUHAP). Namun demikian tidak jarang dalam pelaksanaan tugasnya sehari-hari Polri melakukan upaya justru melanggar rambu-rambu yang digariskan oleh undang-undang. Pelaksanaan tugas kepolisian yang sesungguhnya diberikan undang-undang dalam rangka melindungi HAM sebaliknya justru melanggar HAM lainnya. fungsi dan kewenangan Polri ada beberapa tahapan baik dalam tahap penyidikan, berupa mencari keterangan dan alat bukti dan menyuruh berhenti orang yang dicurigai sedangkan dalam tahap penyidikan berupa penangkapan dan penahanan.Kata Kunci : Polri Dalam Menjalankan Fungsi dan Wewenangnya

Abstract

AbstractImplementation of Criminal Justice is the enforcement mechanism of the workings of the criminal law began the process of the investigation, arrest and detention, prosecution and trial examination, and the implementation of court decisions. Witnesses presented before the trial was not enough that only one witness, because a witness not a witness (Unus testis nulus testis), it is in KUHAP for in Article 185 paragraph (20), paragraph (3), and paragraph (4), namely that the testimony of a witness is not sufficient to prove that the defendant is guilty of acts that indicted him unless there are other valid evidence and witness testimony is required between these must relate to one another.

Abstract

Existence of Indigenous Institutions in the Regulation of the Minister of Interior No. 3 of 1997 as follows: Accommodating and channeling public opinion to the government and resolve disputes relating to customary law, Customs and habits of society in order to enrich the local culture and empower the community in supporting the implementation of the government, implementation of development and social development; create a democratic and harmonious relationship and objective between the Head of Indigenous / Stakeholder Indigenous Peoples or the Oldest and Leader / Indigenous leaders with government officials in the region. While the function of Customary Institutions in the Regulation of the Minister of Interior No. 3 of 1997 is to carry out data collection activities in order to develop policies and strategies to support the smooth governance, sustainable development and supports the success of the coaching community. Key Note : Existence of Traditional Institutions
