Abstract

Right of Liability is a security right imposed on the right to land as referred to in Law Number 5 of 1960 concerning Basic Regulations of Agrarian Principles, along with or not along with other objects that are an integral part of the land, which gives priority to certain creditors, over other creditors. In lawsuits involving dependent rights, the Judge often decides to cancel the encumbrance of the dependent rights that are being held by creditors. This results in legal certainty and protection for the parties in the guarantee of dependent rights which in the study are creditors of the holders of dependent rights is not achieved. The purpose of this study is First, knowing the creditor's right to change the position of the object of liability based on a court decision, Second knowing the legal protection for creditors against changes in the position of the object of liability based on a court decision. The type of research used is normative legal research using library materials as data and reference sources. This research requires secondary data consisting of primary, secondary, and tertiary legal materials. The data collection technique used in this normative legal research is library research or document study. The results of this data analysis will be concluded using deductive methods. From the results of discussion and research, there is a need for legal protection both preventively and repressively to creditors if the land rights that are the object of the dependent rights are removed which results in the position of the object of the dependent rights changing and the position of precedence (droit de preference) for holders of dependent rights who have special guarantees changes to general debt guarantees (Article 1131 of the Civil Code) so that the creditors related Does not have strong security rights and legal certainty related to the condition that debts will be repaid.

Abstract

Wanprestasi adalah tidak dipeuhinya kewajiban oleh debitur terhadap kreditur sebagaimana yang telah di perjanjikan sebelumnya atau di dalam perjanjian yang mana salah satu atau kedua belah pihak yang terikat dalam suatu perjanjian tidak melakukan kewajiban atau prestasi yang tertulisa didalam perjanjian tersebut. Menurut Pasal 1338 ayat (1) perjanjian yang dibuat oleh para pihak adalah undang- undang bagi mereka yang membuatnya. Dalam Perjanjian Kerjasama Pembangunan Rumah Tinggal antara Pihak Kedua Sebagai Pemilik Tanah dengan Pihak Kedua Sebagai developer terjadi wanprestasi yang mana pihak developer tidak melaksanakan kewajibannya yaitu tidak kunjung membangun unit perumahan yang telah dijanjikan akan dibangun sebagai bentuk dari pelaksanaan perjanjian mengakibatkan pasal-pasal lain yang ada di dalam perjanjian juga tidak terlaksana. Wanprestasi yang terjadi mengakibatkan kerugian bagi pemilik tanah. Penelitian ini bertujuan untuk mengetahui pelaksanaan serta penyelesaian wanprestasi dalam Perjanjian Kerjasama Pembangunan Rumah Tinggal antara Pihak Pertama Sebagai Pemilik Tanah dengan Pihak Kedua Sebagai Developer. Metode penelitian yang digunakan adalah penelitian sosiologis atau empiris yaitu dengan wawancara kepada para pihak yang terdapat didalam perjanjian sebagai alat pengumpul data. Pada penelitian ini penulis melakukan penelitian langsung pada lokasi penelitian untuk mendapatkan data-data, bahan serta informasi yang berhubungan dengan penelitian ini. Kesimpulan yang bisa diperoleh dari hasil penelitian ini bahwa terkait pelaksanaan Perjanjian Kerjasama Pembangunan Rumah Tinggal antara Pihak Pertama Sebagai Pemilik Tanah dengan Pihak Kedua Sebagai Developer, yang disepakati oleh para pihak tidak dapat terlaksana dengan baik dikarenakan pihak developer melakukan wanprestasi dengan tidak membangun unit perumahan tersebut. Penyelesaian wanprestasi yang terjadi pada perjanjian kerjasama pembangunan rumah tingal antara pihak pertama sebagai pemilik tanah dengan pihak kedua sebagai developer adalah dapat di tempuh dengan cara penyelesaian secara litigasi dan non litigasi, yang mana secara litigasi yaitu melalui pengadilan dan secara non litigasi atau diluar pengadilan yaitu melalui Negosiasi, koniliasi, konsultasi, mediasi dan pendapat para ahli.

Abstract

Agreements are an inseparable part of human life, starting from those made inwriting or unwritten. In principle, a rental agreement is a form of economic relationshipbetween the owner of the premises (the renter) and the tenant of the premises. Good faith isone of the principles of agreements, which is contained in Article 1338 paragraph (3) of theCivil Code, namely that agreements must be implemented in good faith. The implementationof the principle of good faith in the rental agreement for the Verlina boarding house inPekanbaru City is analyzed from the pre-contractual, contractual and post-contractualstages. This research aims to find out how the Verlina Boarding House room rentalagreement is implemented verbally based on the principle of good faith and the efforts thatmust be made so that the parties are obedient and obedient in implementing the VerlinaBoarding House room rental agreement verbally based on the principle of good faith inPekanbaru City.The type of research used is sociological legal research, namely legal research thatanalyzes the application of law in a real sense in society based on facts that exist in a society.The population and sample are all parties related to the problem being studied. This researchuses data sources in the form of primary data and secondary data, and data collectiontechniques are carried out using interviews and questionnaires.The results of this research are the implementation of the Verlina boarding house roomrental agreement orally based on the principle of good faith in Pekanbaru City between theboarding house owner and the boarding house tenant at the pre-agreement and contractualstages, the principle of good faith has been fulfilled, but at the post contractual there is adefault that occurs, the boarding house renter does not apply objective good faith inimplementing the agreement, especially in carrying out the boarding house renter'sobligations towards the boarding house owner, namely there are tenants who are late infulfilling their achievements in the form of not being on time in making payments for theboarding house rent. and being negligent in carrying out achievements by violating the rulesand regulations in the boarding house, there are boarding house tenants who are dishonestand run away before paying the boarding fee, causing losses to the boarding house owner.Efforts that must be made to ensure that the parties comply with the implementation of theagreement are to be given strict sanctions in the form of warnings and fines if they do not payboarding fees on time and fines for violations of regulations in the boarding house and toenforce the existence of guarantees in the boarding house rental agreement.Keywords: Verbal Agreement, Lease, Boarding House, Principle of Good Faith.

Abstract

This research was performed to develop a model of legal protection for tenure rights and Indigenous peoples' access to forests based on local and ecological wisdom in Riau Province. Socio-legal research methods are employed to examine the relationship between law and government policy, with a focus on local and ecological issues. This approach facilitates a more fundamental understanding of the law's substance. Using the normative analysis with interdisciplinary dialogue, in a protection model for public interests over the long term is proposed. The research suggests that cooperation between the public and local or regional governments can be pursued to implement a legal protection model for tenure rights, ensuring that the traditional rights of customary law communities are recognized and upheld within judicial processes. The protection of traditional and constitutional rights of customary law communities has not yet implemented in concrete actions. As a result, the private property rights and access to land in Riau Province are currently protected by the local and ecological considerations..

Abstract

National development aims to improve the quality of life for Indonesian citizens in accordance with the principles of Pancasila and the 1945 Constitution. However, violations of consumer protection regarding tobacco products, including electronic cigarettes, remain prevalent. Despite Government Regulation Number 109 of 2012 prohibiting the sale of tobacco products to individuals under 18 years old, weak enforcement and compliance by business actors allow children easy access to electronic cigarettes. This study examines consumer protection in the trade of electronic cigarettes in Sail District, Pekanbaru City. The research method used is qualitative descriptive, with data collected through observations, interviews, and literature studies. The results indicate that the sale of electronic cigarettes in Sail District remains unrestricted, including to minors, due to weak government supervision and non-compliance by business actors. This condition violates Law Number 8 of 1999 on Consumer Protection and Government Regulation Number 109 of 2012. Concrete efforts are needed from the government, society, and Consumer Protection Organizations to strengthen supervision and enforce regulations. Furthermore, public education on the dangers of electronic cigarettes must be enhanced to protect consumers and control their circulation.

Abstract

The Industrial Relations Court is a special court established within thedistrict court which has the authority to examine, adjudicate and make decisionson industrial relations disputes, this is stated in Article 1 paragraph 17 of LawNumber 4 of 2004 concerning Settlement of Industrial Relations Disputes.according to Article 97 of Law Number 2 of 2004 concerning Settlement ofIndustrial Relations Disputes, the decision of the Industrial Relations Courtdetermines the obligations that must be carried out and/or the rights that must beaccepted by the parties or one of the parties for any settlement of industrialrelations disputes. However, the implementation did not run smoothly whichresulted in legal uncertainty and the failure to fulfill the rights of laborers oremployees guaranteed by Article 156 paragraph 1 of Law Number 13 of 2003concerning Employment which states "In the event of termination of employment,employers are required to pay severance pay and/or service award money andcompensation money for rights that should have been received."The type of research used is empirical legal research. Empirical legalresearch is a legal research method that functions to be able to see the law in realterms and examine how the law works in a social environment, so the empiricallegal research method can also be said to be sociological legal research.This research discusses the implementation of the fulfillment of laborrights after the decision of the Industrial Relations Court at the PekanbaruDistrict Court. The results showed that the implementation of the fulfillment oflabor rights has been carried out well, although there are still some obstaclessuch as delays in submitting requests for execution by workers, delays inexecution by companies, lack of ability of workers in tracking company assets,and efforts by companies to cover up their assets. However, the PekanbaruDistrict Court has made preventive and repressive efforts to overcome theseobstacles, including by summoning both parties when giving a warning to thecompany, directing workers in tracking assets, and providing cover letters torelevant agencies in the asset confiscation process.Keywords: Industrial Relations, Labor Rights, Implementation.

Abstract

Civil liability is a legal obligation that requires one party to pay compensation or follow other legalenforcement in a civil action. Company PT. Mustika Agung Sawit Sejahtera, a company founded in Balai RajaVillage, Bengkalis Regency, did not carry out these responsibilities properly and committed Unlawful Acts(PMH) in accordance with what is regulated in the Civil Law. So the research objective of this thesis is todetermine the implementation of PT accountability. Mustika Agung Sawit Sejahtera towards the people ofBalai Raja Village, Bengkalis Regency and to find out the obstacles found by PT. Mustika Agung SawitSejahtera in implementing accountability towards the people of Balai Raja Village, Bengkalis Regency.Theresearch objective of this thesis is to determine the implementation of PT's accountability. Mustika AgungSawit Sejahtera towards the people of Balai Raja Village, Bengkalis Regency and to find out the obstaclesfound by PT. Mustika Agung Sawit Sejahtera in implementing accountability towards the people of Balai RajaVillage, Bengkalis Regency.The research method in this thesis uses a type of sociological legal research, namely research on theeffectiveness of law in society. The nature of this thesis research is descriptive research that systematicallydescribes the facts and characteristics of the object being studied accurately. Abstract

As an implementation of Law Number 5 of 1960 concerning Basic Regulationson Agrarian Principles (UUPA), the government issued Law Number 56 of 1960concerning Determination of Agricultural Land Area with the Implementation of PPNumber 224 of 1961 concerning Implementation of Land Distribution and ProvidingCompensation, in Article 3 paragraph (1) of PP Number 224 of 1961 in conjunctionwith Article PP Number 41 of 1964 regulates the Prohibition of Absentee LandOwnership, in reality There are still people who own agricultural land in absentee inPandau Jaya Village, Siak Hulu District, so in practice the regulations regarding theprohibition of absentee land cannot be implemented effectively.This type of research is classified as sociological legal research. Insociological legal research, the data sources are primary data sources and secondarydata sources consisting of primary legal materials, secondary legal materials andtertiary legal materials. Collecting normative legal research data uses datacollection techniques by interview and literature study. Data obtained throughliterature study will be analyzed qualitatively. In drawing conclusions the author usesan inductive thinking method, namely a way of thinking that draws conclusions froma specific statement or proposition to a general statement.Based on the research results, it can be understood that the factors that occurin absentee land ownership by inheritance in Pandau Jaya Village, Siak HuluDistrict, Kampar Regency include: buying and selling factors, inheritance factors,village coordination factors, absentee land data completeness factors and legalconsequences of absentee land ownership by inheritance in the Village Pandau Jaya,Siak Hulu District, Kampar Regency. In accordance with the principles of landreform contained in article 10 of the Basic Agrarian Law Number 5 of 1960 whichprohibits owning land in absentee. Abstract

Construction services are one of the economic activities that have animportant role in achieving various targets to support the realization of nationaldevelopment goals. There are two parties in construction services who enter intoa legal employment relationship, namely the service user and the serviceprovider. The work relationship between service users and service providers isbased on law, and is stated in the form of a construction work contract. A contractcan be said to be an agreement because the contract contains a mutually bindingagreement and must be agreed to by both parties. During the implementation ofthe agreement, if one of the parties breaks their promise then that party can besaid to be in default or what could be called a breach of contract.The method for writing this research was carried out using sociologicallegal research. This research was conducted in Mandau District, BengkalisRegency, Riau Province because of data obtained from PT Suka DamaiConstruction. The author took samples including the Director of PT Suka DamaiConstruction Rokan Hulu, PT Schintar Marquisa staff, and legal counsel from PTSuka Damai Construction. The data sources in this research are primary andsecondary data with primary legal materials, secondary legal materials andtertiary legal materials. The data obtained was collected through interviews andliterature review.Based on the results of research on the problem, there are two main thingsthat will be concluded. Settlement of default on Cooperation Agreement by PT.Suka Damai Construction with PT. Schintar Marquisa began with a cooperationagreement between PT. However, various efforts made by the defaulting partiesremain unresolved. Suggestions for firmness from PT. Suka Damai Constructionand, if necessary, take legal action, both non-litigation and litigation, to resolvethe breach of contract issue.Keywords: Construction Services, Contracts, Agreements, Default.

Abstract

Fenomena perkawinan janda tanpa akta cerai banyak terjadi di Jorong Dalam Koto Kenagarian Taeh Baruah, dimana seorang perempuan yang sebelumnya menikah secara sah di KUA bercerai di luar pengadilan, kemudian menikah lagi tanpa pendaftaran resmi sesuai UUP dan KHI. Penelitian ini bertujuan untuk menganalisis keabsahan dan akibat hukum dari perkawinan tersebut serta faktor penyebabnya. Metode yang digunakan adalah penelitian sosiologis dengan pengumpulan data melalui wawancara dengan pihak terkait di lokasi penelitian. Hasil penelitian menunjukkan bahwa perkawinan janda tanpa akta cerai di Jorong Dalam Koto tidak memiliki keabsahan hukum karena melanggar UUP Pasal 2 (2) dan KHI Pasal 5 (1), dan proses perceraian sebelumnya yang tidak melalui pengadilan bertentangan dengan UUP Pasal 39 (1) dan KHI Pasal 115. Selain itu, perkawinan ini dapat merugikan hak istri dan anak yang lahir. Faktor penyebabnya yaitu perceraian di luar pengadilan, rendahnya pemahaman masyarakat tentang hukum perkawinan, pengaruh lingkungan, dan kurangnya sosialisasi dari instansi terkait seperti KUA. Berdasarkan temuan tersebut, penulis memberikan saran kepada masyarakat untuk mematuhi hukum positif dalam melakukan perkawinan dan perceraian, tidak hanya mengandalkan aturan agama. Selain itu, KUA dan pihak berwenang perlu meningkatkan sosialisasi untuk mengurangi praktik perkawinan tidak terdaftar dan perceraian di luar hukum.
