Abstract

Ṣaḥābaḧ is the first generation who believe to the Prophet Muḥammad [p.b.u.h] and accepted the teachings of Islām (the ḥadīts of the Prophet) directly from Him. They are very obedient to the Prophet so that they may not dare to betray and lie intentionally in the narration of ḥadīts. They are ‘adil generally. Muslims believe that whole companions have ‘adālaḧ quality, which is famous by a dictum: kullu ṣaḥābaḧ ‘udūl. Furthermore, this belief has come as something approved theologically. This concept becomes stronger when the hadith criticism, traditional scholars are more oriented sanad which has implications for the placement of narrators personality in a position that can not be ignored. This is clearly different from Juynboll, he is one of the Orientalists who came from Netherland who developed the theory of common linkThe conclusion of this research that Juynboll denies the method of hadith criticism. He claims that this theory occurred in the evolutive schema, and is the creation of muḥaddits. On the other hand, the author views that the denial of Juynboll for collective ta‘dīl is one of the instruments to strengthen the theory of common link.

Abstract

A public recognition announced by Saudi about how strict and conservative the way they practice the religion, has been attracting attention and a big question worldwide. Social and economic reformation are the main plan that will be committed by Saudi. Saudi intend to transform to a moderate Islam, as an effort to reduce their rigidity and extremism. This research will lead to some of the problem statements which explain the background of the reformation policy carried out by the Kingdom of Saudi Arabia, and how the constellation of Saudi's government will be in the future if a massive reformation occur, as well as the assumptions of Wahhabi‟s assertive and resistance reaction towards the policy. This paper will try to elaborate and unveil discursive assumptions by DMP (decision making process) approach to further understand the intention of Saudi Arabia's reformation ideal.

Abstract

Quran memorization education in Indonesia has recently experienced significant developments, both in terms of style and method. This indicates a shift in the perception of the Muslim community towards tahfidz education. This study aims to reveal the transformation of tahfidz education in Indonesia and the changes in people's perspective on tahfidz tradition. This research focuses on two Islamic educational institutions, namely the National Quran Tahfidz Quarantine Foundation as a representation of contemporary tahfidz education and Pondok Pesantren Tahfidz Yanbu’ al-Qur’an Kudus as a representation of contemporary tahfidz education. This research uses a descriptive-qualitative approach, while data sources come from various literatures, including books, journal articles, and internet media. While the data analysis technique used is descriptive-analytic. This study found that between tahfidz education in Yanbu’ al-Qur’an and the National Quran Tahfidz Quarantine Foundation there are very contrasting differences both in terms of methods and learning orientation. The difference indicates the transformation of tahfidz tradition from classical to modern (method) and oriented towards the fulfillment of identity. In addition, the transformation of tahfidz tradition is influenced by the new trend of Islamism, especially among urban communities who position tahfidz as a standard of piety.

Abstract

Environmental damage by extractive activities is caused by the formulation of policies that have not placed nature and the environment as legal subjects. Policy formulation in the form of a contract of work tends to accommodate human interests and is profit-oriented. This study aims to examine strategies for mitigating environmental damage caused by PT Freeport’s mining activities based on an eco-contract perspective. PT Freeport’s contract of work is the object of analysis in this research, while data on environmental damage are obtained from national media. Theoretical-reflective approach is used in analyzing the data to formulate mitigation strategies. The results showed that the mitigation of environmental damage in the eco-contract perspective emphasizes the natural relationships and interactions between all components of the ecosystem. In other words, mitigation of environmental damage requires equal treatment between the environment and humans which also indicates equal rights. In fact, force majeure conditions and natural disasters are still viewed from a human perspective, so that efforts to identify and socialize environmental damage only focus on human aspects rather than nature and the environment. PT Freeport’s contract of work has not accommodated mitigation efforts of environmental damage that ecologically oriented. In addition, the weak mapping, control, and socialization of PT Freeport’s mining activities have implications for the lack of efforts to mitigate environmental damage.

It further used normative legal study which included the process of identifying legal rules, principles, and doctrines to address the constitutional issues. The results showed that the amendments from the 2008 ITE Law to the 2016 ITE Law did not adequately the basic problems. Furthermore, certain forms of hate speech rules were observed in the ITE Law, particularly in Article 27 paragraph (3) and Article 28 paragraph (2). These rules were unclear benchmarks used in assessing social media posts as hate speech, defamation, or criticism and opinion from an individual about a problem. Therefore, making improvements through legal reform was essential to ITE Law, specifically Article 27 paragraph (3) and Article 28 paragraph (2). The amendments were necessary to develop good legal certainty for the community. The government should further make legal comparisons with other countries to identify the best regulatory framework for the community.

Abstract

Government Regulation instead of Law (Perppu) for Ormas No. 2 of 2017 has shown its implications for religious activities and discourses at IAIN Kerinci and UIN Sultan Thaha Saifuddin Jambi. The argument of this research departs from the tendency of campus elements to strengthen identity through discourse contestation after the issuance of the Perppu Ormas. This study applies a descriptive qualitative approach through observation, interviews, and document review. This study found that Perppu Ormas No. 2 of 2017 raises two different attitudes at the level of student organizations. Acceptance of the Perppu Ormas argues intending to deradicalize and strengthen moderation. Meanwhile, the voices of refusal argued that the Perppu Ormas have the potential to weaken democracy and be misused. Perppu Ormas at the leadership level was welcomed by intensifying the discourse on religious moderation and strengthening the Pancasila ideology through seminars and study centers.
