Abstract

Abstract

This study aims to examine the legal review of Sundanese local wisdom, specifically the concept of Sandekala traditionally practiced by West Java community. The analysis evaluated the effect of government policies on the implementation of local wisdom values in the context of education, technology, and restrictions during the COVID-19 pandemic, with particular attention to the role in fostering environmental awareness post-pandemic. Moreover, this study examined how these policies complement or deviate from the legal principles underlying local wisdom and environmental sustainability. An analytical method was used to review legal journals and online discussions, investigating how shifts in the understanding and application of local wisdom values have occurred in response to government measures. Furthermore, there are also big myths about these values that cause problems for keeping local wisdom true and useful. The results showed the importance of matching government policies with local values, including Sandekala, as a form of customary law that remains relevant, and ensuring the continuity of inclusive cultural and legal practices while protecting the environment in the post-pandemic context. This study provides valuable insights into how policies can enhance local wisdom and ensure compliance with relevant legal frameworks. In conclusion, keeping local wisdom is not just culture but also part of sustainable and inclusive law in Indonesia. Local wisdom should be kept and studied using science and technology.

Abstract

Abstract: Although historical researchers do not doubt the identity of the Demak Bintara Sultanate as an Islamic kingdom, there are old cultural systems that continue to be used by generations of the Demak Bintara Sultanate. This article aims to study the legacy of Majapahit in the cultural system of the Demak Bintara Sultanate. The research method used in this article is historical, examining secondary sources on the history of Majapahit and Demak Bintara. The results of this study indicate the existence of a social and political system that prevailed when Majapahit still existed until the establishment of Demak Bintara. Majapahit and Demak Bintara operated a mandala political system, a pattern of relationships among kingdoms in a region with a large kingdom as the center. In addition, the pattern of relations between the clergy and rulers in the Majapahit and Demak Bintara eras shows similarities. The rulers maintained good relations with the clergy to gain political support and power. On the other hand, the kings provided various facilities to the clergy for educational needs and religious rituals. Majapahit and Demak Bintara also had an orientation as maritime kingdoms. These findings imply that the cultural heritage identities of Majapahit and Demak Bintara that can be found today are not necessarily different. This refutes some people's assumption that the Demak Bintara generation always purified any cultural heritage of Majapahit.

Abstract

This study aims to examine and comparatively analyze the perspectives of the four Sunni madhhabs Hanafi, Maliki, Shafi'i, and Hanbali on online buying and selling transactions by referring to Madzāhibu al-Arba'ah by Abdurrahman Al-Juzairi, with a focus on identifying points of convergence and divergence relevant to contemporary digital commerce. While previous studies have generally addressed online transactions from a broad Islamic law perspective, few have conducted a systematic comparative analysis rooted in classical fiqh turath across all four madhhabs simultaneously. This study employs a normative qualitative library research method with a comparative fiqh approach, using Madzāhibu al-Arba'ah as the primary source and supported by contemporary fiqh muamalah literature, international journal articles on Islamic e-commerce, and relevant regulatory documents. Data were analyzed through descriptive-analytical and comparative methods to examine the pillars and conditions of sale, ijab-qabul, clarity of object, and the concept of ittihād al-majlis in online transactions. The findings reveal that all four madhhabs permit online buying and selling through analogical reasoning with bai' al-salam, yet differ significantly in their interpretations of sighat and ittihād al-majlis: the Hanafi and Hanbali schools adopt a more flexible stance on the form of ijab-qabul, the Shafi'i school emphasizes the continuity of the contract session and explicit sighah, while the Maliki school prioritizes public benefit through 'urf and maṣlaḥah mursalah. This study contributes a structured comparative framework that translates classical contract elements into their digital equivalents, offering normative guidance for Islamic e-commerce practice and sharia-compliant digital transaction governance.
