Abstract

Halal tourism is one sector in Islamic Economics which is growing significantly. By 2015, Global Muslim spending on travel (outbound) has increased to reach $ 151 billion (excluding Hajj and Umrah). This is expected to reach $ 243 billion by 2021. In food market, Global Muslim spending on Food and Beverages (F&B) has increased to reach $1,173 billion in 2015. And it is expected to reach $ Â 1,914 billion by 2021. And in Media and recreation market, A Global Muslim spending on it has grown 7.3% to reach $189 billion in 2015 and it is expected to reach $ 262 billion by 2021. For Indonesia, the Indonesian Muslim community has spent approximately $ 9.1 billion in the sectors of tourism, $ 154.9 in the halal food and beverages sector, and $ 8.8 billion in media and leisure sectors. This condition has become one of the factors behind the publication DSN-MUI/X/2016 on Guidelines for the Implementation of Sharia Tourism in Indonesia. However, as the only rule in the development of halal tourism, many provisions in this fatwa to be discussed again ameng Islamic scholars and Stakeholders, caused it seemed to lead halal tourism towards a more exclusive. This paper tries to analyze some of the provisions of this fatwa and discuss logical consequences arising from these provisions. Abstrak Parawisata halal merupakan salah satu sektor dalam Ekonomi Islam yang mengalami perkembangan yang signifikan. Pada tahun 2015, sumbangan terhadap pasar pariwisata dunia dari masyarakat muslim dunia mencapai US$ 151 milyar dan diprediksikan akan menembus US$243 milyar di tahun 2021. Begitupun halnya dengan total pengeluaran masyarakat muslim di sektor makanan dan minuman halal yang mencapai US$1,173 milyar dan akan mencapai US$1.914 milyar pada 2021. Begitupun halnya di sektor media dan rekreasi, masyarakat muslim menghabiskan sekitar US$189 milyar dan diperkirakan akan mencapai US$262 milyar pada 2021. Untuk Indonesia sendiri, masyarakat muslim Indonesia telah menghabiskan sekitar US$9,1 milyar di sektor parawisata, US$154,9 di sektor makanan halal, dan US$8,8 milyar di sektor media dan rekreasi. Kondisi inilah yang menjadi salah satu faktor yang melatarbelakangi terbitnya Fatwa DSN-MUI/X/2016 tentang Pedoman Penyelenggaraan Parawisata Berdasarkan Prinsip Syariah. Namun demikian, sebagai aturan satu-satunya dalam pengembangan parawisata halal di Indonesia, banyak ketentuan pada fatwa ini yang harus didiskusikan dan dibahas lebih lanjut, karena terkesan menggiring parawisata ke arah yang lebih eksklusif. Oleh kerena itu, makalah ini mencoba menganalisis beberapa ketentuan pada fatwa ini serta membahas konsekwensi logis yang ditimbulkan dari ketentuan-ketentuan tersebut.

Abstract

Hukum dan ekonomi memiliki hubungan timbal balik dan saling mempengaruhi. Artinya, suatu kegiatan ekonomi yang tidak didukung oleh perangkat hukum yang baik memungkinkan akan mengakibatkan terjadinya kekacauan. Hal ini disebabkan karena para pelaku ekonomi akan melakukan aktivitasnya dengan tanpa standar norma yang pada akhirnya menyebabkan kerugian di antara salah satu pihak yang melakukan aktivitas ekonomi. Jika dibiarkan begitu saja, hal tersebut akan menyebabkan iklim ekonomi di masa depan menjadi terganggu. Begitupun halnya dengan ekonomi syariah. Jika proses hukum, dalam hal ini penyelesaian sengketa ekonomi syariah dilaksanakan dengan baik, maka pengembangan ekonomi dan keuangan syariah akan semakin baik. Pengadilan Agama sebagai salah salah satu pelaksana kekuasaan kehakiman di bawah Mahkamah Agung Republik Indonesia memiliki peranan yang penting dalam memajukan industri keuangan syariah di Indonesia. Hal ini didasarkan karena Pengadilan Agama merupakan lembaga negara yang memiliki kewenangan dalam menyelesaikan sengketa ekonomi syariah di Indonesia. Makalah ini mencoba membahas mengenai beberapa aspek penting yang terkait dengan penyelesaian sengketa ekonomi syariah di Pengadilan Agama, serta beberapa usaha yang dilakukan oleh Mahkamah Agung dalam menguatkan peran Pengadilan Agama dalam menyelesaikan sengketa ekonomi syariah. Abstract The legal relationship with the economy has a reciprocal and mutually influencing relationship. That is, an economic activity that is not supported by a good legal tool will result in chaos, this is because the economic actors will perform its activities without standard norms that caused the loss of one party in conducting economic activities. If left alone, this will cause the economic climate in the future to be disturbed. Likewise with the sharia economy. If the legal process, in this case the sharia economic dispute resolution carried out well, then the development of sharia economic and financial industry will be better. The Religious Courts as one of the judicial authorities under the Supreme Court of the Republic of Indonesia plays an important role in advancing the sharia financial industry in Indonesia. This is because the Religious Courts are state institutions that have the authority to resolve the dispute of sharia economy. This paper tries to discuss some important aspects related to the settlement of sharia economic dispute in the Religious Courts, as well as some efforts made by the Supreme Court in strengthening the role of Religious Courts in solving the dispute of sharia economy.

Abstract

Pembentukan peraturan perundang-undangan adalah salah satu fungsi negara untuk mengatur masyarakatnya demi men­ca­pai sebuah kesejahteraan dan keadilan di depan hukum. Begi­tupun halnya dengan Undang-Undang Nomor 17 tahun 2012 tentang Perkoperasian, Undang-undang ini di buat demi tercapainya kesejahteraan dan keadialan ekonomi masyarakat. Akan tetapi, keadilan tersebut seakan tersembunyi ketika ter­dapat Pasal 93 ayat (5) dan Pasal 120 ayat (1) huruf j pada Undang-undang ini yang melarang koperasi berinvestasi pada sektor riil, yang kita ketahui bahwa core dari Koperasi Syariah (Eko­nomi Syariah) adalah sektor riil. Sehingga kehadiran ke­dua pasal tersebut perlu untuk dikaji dan ditelaah ulang. Kajian dan telaah tersebut di dasarkan pada logika hukum dan Undang-Undang Dasar 1945 sebagai induk dari semua pera­turan perundang-undangan, serta beberapa teori yang berhu­bungan dengan keduanya.

Abstract

Mediation is a method of resolving disputes through a negotiation process with the assistance of either a judge or a non-judge mediator. The Supreme Court of Indonesia set a nationwide aim of 25% for settling disputes by mediation in 2023. However, the actual implementation in the jurisdiction of the Banten Religious High Court is only around 20,7% of the defined target, below the national success rate for religious courts, which has reached 39.85%. One of the main factors is the over-reliance on non-judge mediators and the mediator's ability to lead the mediation. Thus, mediation management must be improved, and the capacity of mediators, particularly non-judges, must be increased. This study seeks to discuss the effectiveness of dispute resolution by non-judge mediators and how to maximize the level of success in settling disputes by non-judge mediators. This article is a descriptive qualitative study using normative juridical and empirical approaches. According to the findings of this study, the mediation process in religious court institutions, particularly in the jurisdiction of the Banten Religious High Court, has not been effective because most of the process is directed by non-judge mediators who are less qualified than judge mediators. To increase the success rate of the mediation implementation process, the court must take the following steps: Rewarding non-judge mediators, organizing coaching and training programs for non-judge mediators, determining national mediation settlement targets by involving non-judge mediators, implementing hybrid mediation (between judge mediators and non-judge mediators); and conducting regular evaluations of a non-judge mediator.

Abstract

This paper examines the process of examining marriage dispensation cases prior to and following the enactment of Supreme Court Regulation Number 5 of 2019 concerning Guidelines for Adjudicating Marriage Dispensation Cases. This paper was written using a qualitative research method, specifically normative and empirical juridical approaches. According to the findings of this study, the provisions of Supreme Court Regulation Number 5 of 2019 have explicitly regulated several things that are not specifically regulated in the formal and material rules governing marriage dispensation. The adoption of this regulation is anticipation and standardization for judges in making legal decisions so that court decisions pay more attention to the best interests of children when granting a marriage dispensation application. Makalah ini mendiskusikan tentang proses pemeriksaan perkara dispensasi kawin sebelum dan sesudah diberlakukannya Peraturan Mahkamah Agung Nomor 5 Tahun 2019 tentang Pedoman Mengadili Perkara Dispensasi Kawin. Metode penelitian yang digunakan dalam penulisan makalah ini menggunakan pendekatan kualitatif, yaitu pendakatan yuridis normatif dan yuridis empiris. Hasil penelitian ini menyimpulkan bahwa ketentuan pada Peraturan Mahkamah Agung Nomor 5 Tahun 2019 telah mengatur secara tegas beberapa hal yang tidak diatur secara khusus di aturan formil maupun materil mengenai dispensasi kawin. Pemberlakuan Perma ini ialah sebagai atisipasi dan standarisasi bagi hakim dalam membuat putusan hukum agar putusan atau penetapan pengadilan lebih merperhatikan kepentingan terbaik anak ketika hendak mengabulkan permohonan dispensasi nikah

Abstract

Introduction to the Problem: Women and children are frequently mistreated, particularly when they face legal issues. In divorce situations, for example, they often do not receive the entitlements to which they are entitled, such as mut'ah, iddah, and child support. This situation is due to the existing legal system and policies that do not reflect equality and justice for women and children, particularly in the execution of court orders carrying ex-husbands' obligations to their ex-wives. One of the legal advances in this part is using information and technology (IT) to develop a decision execution system. E-MOSI CAPER is one of the IT-based decision execution instruments that ex-wives can employ to demand that their ex-husbands voluntarily carry out the decision's obligations.Purpose/Objective of the Study: This article attempts to describe and analyze how the E-MOSI CAPER App could assure the preservation of women's and children's rights after divorce.Design/Methodology/Approach: This work adopts a qualitative research technique through normative and empirical juridical approaches, with statutory and conceptual approaches.Findings: According to this study, the E-MOSI CAPER application, one of the IT-based services released by the Bengkulu Religious High Court, is an innovation that could be used as a tool in organizing guarantees for the protection of women's and children's rights. This App can increase the compliance of ex-husbands to perform court decisions, which makes this App part of the legal instrument of the Integrated Execution System.Paper Type: Research Article
