Abstract

Synchronization of the rule of law in the decentralized regulatory framework for the special autonomous area of Papua is discussed. This legal research employs a normative juridical approach supported by an empirical juridical description, namely a deductive study that begins with an analysis of the articles in the laws and regulations governing the issue of synchronizing legal rules pertaining to decentralization in Papua Province. Law Number 21 of 2001 concerning Special Autonomy for the Papua Province represents the political will of the Unitary State of the Republic of Indonesia, to the people of Papua, based on the consideration that the administration of development implementation in the Papua Province during its integration with Indonesia has not fully fulfilled the sense of justice, achieved prosperity and realize law enforcement and have not fully fulfilled the respect for human dignity.Keywords: Synchronization of the Rule of Law; Decentralized System; Special Autonomous Region AbstrakPembahasan mengenai sinkronisasi aturan hukum dalam sistem desentralisasi regulasi bagi daerah otonomi khusus Papua. Metode pendekatan yang dipergunakan dalam penelitian hukum ini adalah metode pendekatan yuridis normatif yang didukung dengan yuridis empiris dengan merinci uraian yaitu suatu penelitian yang secara deduktif dimulai analisa terhadap pasal-pasal dalam peraturan perundang-undangan yang mengatur terhadap permasalahan sinkronisasi aturan hukum terkait Desentralisasi di Provinsi Papua. Undang-Undang Nomor 21 Tahun 2001 tentang Otonomi Khusus bagi Provinsi Papua, merupakan political will Negara Kesatuan Republik Indonesia, kepada rakyat Papua, dengan dasar pertimbangan bahwa penyelenggraan pemerintahan pelaksanaan pembangunan di Provinsi Papua selama berintegrasi dengan Indonesia belum sepenuhnya memenuhi rasa keadilan, mencapai kesejahteraan dan mewujudkan penegakan hukum dan belum sepenuhnya memenuhi rasa penghormatan terhadap hak- hak asasi manusia, khususnya orang asli Papua. Dalam penulisan ini penulis menggunakan metode kualitatif deskriptif denga hasil penelitian mengenai aturan hukum terkait desentralisasi di provinsi papua.Kata Kunci: Sinkronisasi Aturan Hukum, Sistem Desentralisasi, Daerah Otonomi Khusus

Abstract

Abstract The principle of reversed proof (omreking van het bewijslast) in the DSN Fatwa No. 105/DSN-MUI/X/2016 concerning guaranteeing the return of capital for the financing of mudharabah, musyarakah and wakalah bil istitsmar is the new norm in the legal framework of sharia economic procedures. This study aims to find the ratio legis of the existence of an inverted evidentiary norm in the DSN fatwa No. 105/DSN-MUI/X/2016. This type of research is normative law with a descriptive-comparative approach by describing all legal materials and comparing them with the reverse proof norm in the Consumer Protection Act. The results of the study indicate that the legal reason for the reverse evidence in the DSN fatwa is because the capital manager is a more active and knowledgeable party in developing the business so that he has absolute responsibility (strict liability) for all errors and omissions in managing the project being carried out. Abstrak Asas pembuktian terbalik (omreking van het bewijslast) dalam Fatwa DSN No 105/DSN-MUI/X/2016 tentang penjaminan pengembalian modal pembiayaan mudharabah, musyarakah dan wakalah bil istitsmar merupakan norma baru dalam kerangka hukum acara ekonomi syariah. Penelitian ini bertujuan untuk menemukan ratio legis adanya norma pembuktian terbalik dalam fatwa DSN No 105/DSN-MUI/X/2016. Jenis Penelitian ini bersifat normatif law dengan pendekatan deskriptif-komparatif dengan memaparkan seluruh bahan hukum dan membandingkannya dengan norma pembuktian terbalik dalam Undang-Undang Perlindungan Konsumen. Hasil penelitian menunjukkan bahwa alasan hukum pembuktian terbalik dalam fatwa DSN ini karena pengelola modal merupakan pihak yang lebih aktif dan mengetahui dalam mengembangkan bisnis sehingga memiliki tanggungjawab mutlak (strict liability) atas segala kesalahan dan kelalaian dalam mengelola projek yang dijalankan.

Abstract

Salah satu lembaga negara yang muncul melalui perubahan ke-tiga UUD 1945 antara lain adalah Dewan Perwakilan Daerah (DPD). Hadirnya DPD dalam struktur ketatanegaraan di Indonesia diatur dalam Pasal 22C dan 22D UUD 1945, tujuan dari pada pembentukan Dewan penvakilan Daerah (DPD) semula dimaksudkan dalam rangka mereformasi struktur parlemen indonesia menjadi dua kamar (bikameral) yang terdiri atas DPR dan DPD Akan tetapi, ide bikameralisme atau struktur parlemen dua kamar itu mendapat tentangan yang keras dari kelompok konservatif di panitia Ad Hoc Perubahan UIJD 1945 di MPR 1999-2002, sehingga yang disepakati adalah rumusan yang ada sekarang tidak dapat disebut sebagai menganut sistem bikameral sama sekali. Dalam ketentuan UUD 1945 dewasa ini, jelas terlihat bahwa peran DPD tidaklah mempunyai kewenangan yang sama dengan DPR terutama dalam membentuk undang-undang.

Abstract

Youth has a very important position in the history of the struggle for Indonesian independence. Youth development is Indonesia's strategic agenda in order to prepare future generations who are strong and able to play a role in the development of the nation as a whole. In the present, youth are expected to continue to be able to fulfill independence in order to support national development. Seeing the very high potential of youth, the Government then saw the need to formulate special policies related to youth development. The research method in this writing is qualitative. The type of research in this research is using normative juridical law research. The purpose of the establishment of the Youth Law which provides specificity for the implementation of affairs in the field of youth cannot be carried out optimally so that it also has an impact on the Government's efforts in implementing youth development which is expected to support national development.Keywords: Authority; Youth; National development AbstrakPemuda memiliki kedudukan yang sangat penting dalam sejarah perjuangan kemerdekaan Indonesia. Pembangunan pemuda merupakan agenda strategis Indonesia dalam rangka mempersiapkan generasi masa depan yang tangguh dan mampu berperan dalam pembangunan bangsa secara keseluruhan. Di masa sekarang, pemuda diharapkan terus dapat mengisi kemerdekaan guna mendukung pembangunan nasional. Melihat potensi kaum muda yang sangat tinggi, Pemerintah kemudian memandang perlu menyusun kebijakan khusus terkait dengan pembangunan kepemudaan. Metode penelitian dalam penulisan ini adalah kualitatif, jenis Penelitian dalam penelitian ini yaitu menggunakan penelitian hukum yuridis normative. Abstract

There are two main problems in this research, first regarding the impact of the emergency, in this case the Covid-19 pandemic, on the implementation of passport issuance services at the TPI Tanjung Priok Class I Immigration Office. Second, regarding the obstacles faced during the implementation of passport issuance services in an emergency (Covid-19 pandemic) at the TPI Tanjung Priok Class I Immigration Office. This research is a descriptive qualitative research, which means that the data collected is not in the form of numbers, but rather the data comes from interview texts, field notes, personal documents, and other official documents. The data collection method used in this research is triangulation, namely, literature study, interviews, and observation. The results of this study indicate that the Covid-19 Pandemic has an impact on public services, especially in the service of issuing passports at the TPI Tanjung Priok Class I Immigration Office. The government issued a Large-Scale Social Restriction policy to prevent the transmission of Covid-19. This policy is also supported by the Director General of Immigration regarding a Circular regarding Limitation of Immigration services, people must be able to adapt through changes in lifestyle in the Covid-19 situation which is called the New Normal Period. So in this case the issuance of a Circular on the Implementation of Immigration Duties and Functions in the New Normal Order Period. There were several obstacles in implementing passport issuance services during the Covid-19 pandemic at the TPI Tanjung Priok Class I Immigration Office.

Abstract

Hubungan antara warga dengan negara merupakan suatu hal yang kompleks. Dalam praktik keduanya seringkali berseberangan atau berbeda pandangan maupun pendapat, seperti ketika negara menerbitkan peraturan atau mengeluarkan kebijakan tertentu, sebagian warga negara melakukan penolakan karena tidak sesuai dengan kehendak dan kebutuhan rakyat. Salah satu contoh sengketa yang sering terjadi karena adanya kepentingan yang saling berseberangan antara negara dan rakyat adalah sengketa di bidang tata usaha negara. Pengadilan Tata Usaha Negara berwenang untuk memeriksa, memutus, dan menyelesaikan suatu sengketa tata usaha negara jika telah dilakukan upaya administratif. Artinya, orang/atau badan hukum yang merasa dirugikan atas suatu Keputusan Tata Usaha Negara (KTUN) harus menempuh upaya administratif terlebih dahulu sebelum mengajukan gugatan tata usaha negara secara tertulis ke suatu Pengadilan Tata Usaha Negara. Bentuk upaya admnistratif itu sendiri terbagi menjadi 2 (dua), yaitu prosedur keberatan administratif dan prosedur banding administratif. Dalam rangka mengoptimalkan upaya administratif perlu ditumbuhkan kesadaran pejabat tata usaha negara untuk segera menindaklanjuti suatu keberatan administratif yang diajukan. Selain itu Pembentuk Undang-Undang perlu untuk mempertimbangkan revisi terhadap Undang-Undang Administrasi Pemerintahan dengan memasukkan norma yang sedikit lebih memaksa agar pejabat tata usaha negara serius untuk memberikan tanggapan dan menyelesaikan keberatan administrasi.

Abstract

The implementation of cyber notary in Indonesia raises legal phenomena. On the one hand, cyber notary enhances the capabilities of Notaries in accordance with current technological developments. On the other hand, cyber notary creates an unsynchronization between traditional Notary tasks and digital Notary tasks. The purpose of writing is to synchronize the implementation of the tasks of the Notary according to the Law and the Civil Code, and the implementation of the tasks of the Notary according to the ITE Law. The research method used by the author is Normative Juridical supported by empirical research. The results of the study and the conclusion that the application of cyber notary in Indonesia raises doubts for the Notary regarding the saving of the minutes of the deed, must be stored manually or electronically, in line with the lack of legal basis governing the mechanism for the storage of the minutes of the deed. The conclusion is cyber notary in Indonesia should not be fully implemented and there needs to be some consideration because the legal system in Indonesia with the legal system in other countries is much different.

Abstract

The freedom of judges in handing down sentences for criminal acts of corruption often creates legal uncertainty. Judges are given the freedom to assess sentences in corruption cases based on punishment theory and happiness theory. Very often the imposition of sentences actually causes injustice because of the leniency given by the judge. Positivism basically comes from a philosophical school that borrows the views, methods and techniques of Natural Science in understanding reality (scientism). So, as a result, legal science is freed from hermeneutics and is required to follow the rules in order to achieve legal certainty. Therefore, this article tries to answer how to reconstruct the use of legal positivism theory in enforcing criminal acts of corruption in Indonesia. This research is a qualitative type of normative juridical research with secondary data from decision No.34/Pid.Sus-Tpk/2021/PN.Jkt.Pst. Based on the research results, it shows that the positivist thinking pattern should be used as a guide for judges as law enforcers in prosecuting criminal acts of corruption, so that criminal acts of corruption in Indonesia no longer receive leniency and provide legal certainty

Abstract

Harmonization is a process of harmonizing the substance and technique of drafting laws and regulations. Within the framework of the national legal system, follow-up harmonization is regulated in Permenkumham Number 22 of 2018 and Permenkumham Number 23 of 2018. The method used in this study is normative legal research. The research data comes from primary legal materials, secondary legal materials and tertiary legal materials which are collected through library techniques. The analysis of legal material used in this study is by means of legal interpretation (interpretation) and legal construction methods. From the research results it can be obtained that explicitly, the positions of drafters and drafters of legislation in the formation of laws and regulations according to Permenkumham Number 23 of 2018 are contained in Article 3 paragraph (1) and (2) which explains that the designer has the task of preparing, formulate and process draft laws and regulations and other legal instruments and in implementing this matter the designer of laws and regulations must carry out harmonization, and must attach a letter of completion of harmonization, and the designer has an important role, because the designer must be able to create regulations that are in harmony with existing regulations . In addition, the designer must also be able to make regulations whose contents do not give rise to dubious interpretations. In the stages of drafting regulations, the designer always plays an important role in each stage. In the formation of regional regulations, the designer is always present at every stage of formation.
