Abstract

Many controversial decision made by Constitutional Court resulted in the emergence of the idea to limit the judicial power. One of the ideas that surfaced to limit the judicial power without disturbing the idea of judicial independence is judicial restraint. The idea of judicial restraint puts limitation on certain forms. The forms of limitation under judicial restraint could be limitation based on constitutional norms, limitation based on policies for restraint (self-restraint), and the limitation imposed by certain doctrines. Judicial restraint requires the judicial power to refrain from tendencies to act like a mini parliament   that can lead to the juristocracy. Judicial restraint also requires judicial power not interfere the other branches of power.

Abstract

The problem of asylum seekers has become a global humanitarian issue. Demands regarding the handling mechanisms based on the values of human rights is getting stronger voiced by the international community. In the Southeast Asian region, the number of ethnic Rohingya asylum seekers has increased and has started to demand settlement in non-immigrant countries like Indonesia. Although Indonesia does not have international obligations in handling asylum seekers, constitutionally, Indonesia has an obligation to guarantee the right of everyone to obtain asylum which has been included in the Constitution. In a global perspective, humanitarian issues in the handling of asylum seekers has begun to be driven towards the handling model based on regionalism. Therefore, ASEAN’s response to the issue of asylum seekers should start a discourse given the number of asylum seekers in Southeast Asia began to rise. This paper deals with the immigration policy on asylum seekers of Rohingya people in Aceh province of Indonesia who plight in 2015 “boat people crisis” with regionalism approach.

Abstract

The 1945 Constitution of the Republic of Indonesia does not regulate the relations and interactions between treaties and national law. The absence of constitutional norms regarding this matter raises the question of how treaties become a source of national law. This study puts forward the perspective of constitutional law to answer how national law perceives treaties in the dimensions of national law. It argues that the constitutional law paradigm views treaties as a product of the legislative and executive interaction within the framework of the theory of separation of powers. Based on this view, the formation of law is the original power of the legislature, which impacts the obligation to provide legislative consent before treaties can be applied to domestic jurisdictions, as well as placing treaties under the 1945 Constitution. Thus, Indonesia can remain selective in enforcing treaties at the domestic level. The 1945 Constitution paradigm indeed influenced Indonesia's closeness to the teachings of dualism. However, this paper also describes that in using treaties, the Constitutional Court often uses treaties that have yet to be ratified as a basis for strengthening arguments in decisions. Abstract

Artikel ini mencoba mengidentifikasi bagaimana peran desain sistem pemerintahan memberikan pengaruh terhadap pembusukan demokrasi dan kebangkitan otoritariansme di Indonesia.Terdapat dua identifikasi masalah yang akan coba dijawab, yakni Pertama, apakah desain sistem presidensil di dalam UUD 1945 memiliki pengaruh terhadap kemerosotan demokrasi dan kebangkitan otoritarianisme? Kedua, bagaimana aktor politik memanfaatkan celah di dalam sistem presidensil, untuk melemahkan demokrasi dan membangkitkan otoritarianisme? Artikel ini menggunakan pendekatan yuridis sosiologis, yang memadukan pendekatan doktriner dengan pendekatan empiris. Artikel ini berhasil menyimpulkan bahwa desain sistem presidensil di dalam UUD 1945 pasca perubahan, gagal mencegah otoritarianisme untuk bangkit, akibat lemahnya pembatasan kekuasan presiden di level politik formal yang mengakibatkan pemusatan kekuasaan di tangan presiden. Di level informal, UUD 1945 gagal menghadirkan partai politik sebagai salah satu pranata demokrasi yang demokratis. Artikel ini juga berhasil mengidentifikasi penggunaan instrumen hukum untuk melemahkan demokrasi yang sekaligus memicu kebangkitan otoritarianisme oleh para aktor politik.
