Abstract

Penelitian ini dilakukan an tujuan utuk mengetahui bagaimana kelayakan operasional bank dan bagaimana bentuk perlindungan hukum bagi nasabah debitur. Dengan menggunanakan metode penelitian yuridis normatif, maka dapat disimpulkan: 1. Kelayakan operasional bank harus ada izin dari Bank Indonesia sebab pada prinsipnya bank adalah lembaga keuangan yang harus tunduk kepada system dalam Undang-undang Perbankan dimana semua bank harus mendapat izin dari Bank Indonesia. 2. Di dalam Undang-undang Perbankan tidak ada perlindungan hukum bagi nasabah, hanya ada perlindungan hukum bagi nasabah penyimpan dalam bentuk informasi simpanan. Hal ini merupakan kelemahan dari Undang-undang Perbankan khususnya pengaturan tentang perlindungan nasabah. Kata kunci: Perlindungan hukum, nasabah, debitur.

Abstract

Tujuan dilakukannya penelitian ini adalah untuk mengetahui bagaimana bentuk kegiatan perbankan dan bagaimana tanggung jawab yuridis bankir berkenaan dengan kredit macet yang dialami nasabahnya, dari perspektif perdata maupun pidana. Dengan menggunakan metode penelitian yuridis normatif, maka dapat disimpulkan: 1. Bentuk kegiatan perbankan yaitu terdiri dari 3 (tiga) kegiatan pokok yakni kegiatan menghimpun dana dari masyarakat, menyalurkan kembali dana yang dihimpun tersebut kepada masyarakat/dunia usaha yang membutuhkan, serta menyediakan layanan jasa-jasa tertentu di bidang keuangan dan perbankan. 2. Tanggung jawab bankir belum di atur secara khusus di dalam Undang-undang perbankan. Untuk menuntut pertanggungjawaban masih memakai aturan-aturan yang bersifat umum seperti Undang-undang Perbankan, KUHPerdata dan Pidana. Belum adanya aturan khusus "lex spesiali" merupakan kelemahan dalam penunrutan pertanggungjawaban bankir bila terjadi kredit macet. Kata kunci: Tanggungjawab, bankir, kredit macet

Abstract

Indonesia’s Geographical Indication (GI) regime exhibits a persistent gap between formal legal eligibility and practical enforceability, particularly in rural contexts where institutional coordination and legal literacy remain limited. The case of Lobong Pineapple, a product with clear geographical specificity and socio-economic potential, underscores the systemic failure of the GI framework to translate normative protection into actionable development. This study aims to critically examine the regulatory and institutional barriers that hinder GI implementation in Indonesia, using Lobong Pineapple as a representative case. Employing a normative legal method complemented by comparative and empirical analysis, this research evaluates Indonesian GI law against successful practices in the European Union. The findings reveal that despite meeting substantive GI criteria, Lobong Pineapple remains unregistered due to administrative inertia, fragmented local governance, and the absence of enabling legal instruments such as a Regent’s Decree and product specification dossier. In contrast, the EU model demonstrates how institutional synergy, community participation, and integration with rural development policies can operationalize GI law effectively. This study offers a novel reconceptualization of GI protection as a transformative legal infrastructure—one that extends beyond protectionist aims to encompass cultural continuity, economic inclusion, and creative innovation. It proposes a shift from centralized, compliance-driven models to adaptive, community-anchored governance frameworks. By advancing this normative and structural critique, the research contributes to the refinement of intellectual property law as a tool for territorially embedded, culturally sensitive, and development-oriented legal reform.

Abstract

Prior to the implementation of the Job Creation Law, wastewater management in Indonesia was governed by the granting of liquid waste management permits. Nevertheless, the implementation of the new law has supplanted these licenses with a technical approval system that mandates adherence to wastewater quality requirements. This study aims to examine the current legal framework governing wastewater management in Indonesia and assess its execution under the Job Creation Law, with a focus on environmental sustainability. The employed methodology is a normative and empirical legal research strategy, utilizing qualitative analysis via document examination and field observation in Kendari City. The findings suggest that the new legislation encounters implementation difficulties, particularly in overseeing wastewater from home and small-scale enterprises, such as laundry services, which are predominantly unregulated. The conclusion is that the existing legal framework has not adequately integrated principles of environmental ethics, including anthropocentrism and ecocentrism. Consequently, legal reform and the establishment of ethical principles are essential to guarantee environmental preservation and foster the sustainability of ecological functions.

Abstract

This study examines the legal protection of traditional cultural expressions (TCEs) of North Sulawesi communities, which are frequently exploited without authorization for commercial purposes. Such exploitation raises significant legal issues, particularly concerning intellectual property rights violations and the neglect of the collective rights of Indigenous communities. The objective of this research is to analyze the existing legal framework for protecting TCEs and to propose a more adaptive and equitable model of legal protection. This is a normative legal study employing statute, conceptual, and case approaches. Data were analyzed qualitatively and descriptively through literature review and legal document analysis. The novelty of this research lies in its proposed community-based legal protection model that integrates customary law principles with national legislation and international cultural rights standards. The findings reveal that the current legal protections are fragmented and do not yet provide optimal safeguards for Indigenous TCEs. The study recommends the development of a more comprehensive legislative framework, the strengthening of local government roles, and the establishment of protection mechanisms based on the active participation of Indigenous communities
