Abstract

This article deals with the Islamic legal thought of Abdullahi Ahmed an-Na‘im from the sociology of knowledge approach. According to this approach, knowledge (including religious interpretation and practices) is sociologically, economically and politically determined. This article aims to understand how an-Na‘im’s Islamic legal thought is determined by his existence within social reality. This article concludes that an-Na‘im’s thought is determined by (1) socio-political and legal reality in Sudan, (2) Mahmoud Mohamed Taha who influenced his ideas, (3) British milieu, and (4) American environment which is politically secular, Islamo-phobic, racist, discriminative and intolerant towards Afro-Americans. The maturity of an-Na‘im’s thought is particularly influenced by the history of British colonialism in Sudan and his academic training in England, a place where human rights discourse develops as the result of post-enlightenment humanism and some major revolutions in Europe.

Abstract

Abdullahi Ahmed an-Na'im is deeply influenced by the Islamic Reform Movement in Sudan pioneered by Mahmoud Mohamed Taha. Together with other Taha supporters, an-Na'im formed a sociopolitical community that became famous for Tahaism. This article wants to show how the relationship of the two minds is so close and how Islamic legal thought of an-Na'im is partially influenced by Taha. In terms of historical research methodology, it can be said that Taha is a history of idea for an-Na'im. This is because the thought of an-Na'im turns out to be the same as Taha in terms of the importance of the naskh, and differs in worship, mysticism, socialism, and public reason. Moreover, the underlying power of the theorem an-Na'im is not merely an individual, not of individual processes aware of its importance in the flow of thought, but rather of the collective goals of a group that underlie individual thought. Most of his thoughts cannot be properly understood as long as their relation to life or to the social implications of human life are not taken into account.---Abdullahi Ahmed an-Na‘im sangat terpengaruh oleh Gerakan Reformasi Islam di Sudan yang dipelopori oleh Mahmoud Mohamed Taha. Bersama sama dengan para pendukung Taha lainnya, an-Na‘im membentuk sebuah komunitas sosial politik yang kemudian terkenal dengan Tahaisme. Artikel ini ingin menunjukkan betapa hubungan pemikiran keduanya sangat dekat dan betapa pemikiran hukum Islam an-Na‘im sebagiannya dipengaruhi oleh Taha. Dalam istilah metodologi penelitian sejarah, dapat dikatakan bahwa Taha adalah history of idea bagi an-Na‘im. Hal ini karena pemikiran an-Na‘im ternyata sama dengan Taha dalam hal pentingnya naskh, dan berbeda dalam hal ibadah, tasawwuf, sosialisme, dan public reason. Selain itu, kekuatan yang mendasari sikap teoritis an-Na‘im bukan semata merupakan sesuatu yang individual semata, yakni tidak berasal dari proses individu menyadari kepentingannya dalam arus pemikiran, akan tetapi lebih berasal dari tujuan-tujuan kolektif suatu kelompok yang mendasari pemikiran individu. Sebagian besar pemikirannya tidak dapat dimengerti secara tepat selama kaitannya dengan kehidupan atau dengan implikasi sosial kehidupan manusia tidak diperhitungkan.

Abstract

Income and wealth inequality in Indonesia persists despite efforts by central and local governments to address it. Maṣlaḥah mursalah provides a strong theoretical foundation for creating policies that are both religious and highly beneficial. This study aims to explain the history of using maṣlaḥah mursalah in income and wealth policies, provide evidence of income and wealth inequality in Indonesia, and explore the potential of using maṣlaḥah mursalah to address this inequality. This study examines two key facts: the history of maṣlaḥah mursalah's policies on income and wealth, and income and wealth inequality in Indonesia. They were obtained from Arabic uṣūl al-fiqh literature and the analysis of the Gini ratio and palm index. The data were compared to determine the most urgent policy needs and the possibility of using maṣlaḥah mursalah as the basis. This study found that maṣlaḥah mursalah has been widely used in income and wealth distribution policies. Since income and wealth inequality in Indonesia still exists and continues to increase in the ratio, maṣlaḥah mursalah will likely be the basis of settlement policy. This study aims to provide a robust theoretical foundation for the Indonesian government to design and implement maṣlaḥah mursalah-based policies to address income and wealth inequality, including human capital development, labour market opening for women, labour rights protection, improved access to finance, social transfer programs, zakat and tax optimisation, housing policy reform, and increased transparency and corruption eradication.

Abstract

Critique of uṣūl al-fiqh literacy is very crucial. The scarcity of critique can lead to the risk of intellectual stagnation and an inability to address the legal needs of a constantly changing society, simultaneously causing a lack of resonance with reconstructive ideas. The study aims: 1) to explore evidence of the scarcity of studies criticizing uṣūl al-fiqh from 1890 to 2023; 2) to explain the factors influencing the scarcity of critical works, and 3) to propose steps for the reconstruction of uṣūl al-fiqh. The data sources for this article are works collected from web publishers, digital libraries, and search engines. The data obtained was mapped and analyzed, and its trends were recorded. This study finds that during the period 1890-2023, criticism was the rarest aspect in uṣūl al-fiqh literature. The factors causing the scarcity of critique vary and complement each other, involving scholarly elements, uṣūl al-fiqh factors, and surrounding policies. Although criticism of uṣūl al-fiqh is relatively rare, it does not mean there is no space for reconstruction. Through this study, readers can understand the recent developments in uṣūl al-fiqh and assess the extent to which criticism has been undertaken while reflecting on how reconstruction can be initiated once again.

Abstract

The COVID-19 pandemic has not only posed a grave threat to global public health but also disrupted the socio-religious fabric of Indonesian society, particularly in how Muslims perform communal worship. In response to government-mandated restrictions, resistance emerged from various societal groups, exposing a growing distrust toward state policy and weakening public compliance. This study investigates the strategic role of the Indonesian Ulema Council (MUI) as a religious authority in supporting government efforts to manage COVID-19 as a non-natural disaster. Specifically, it addresses two key questions: (1) How did MUI contribute to the government's pandemic response through its fatwas? and (2) What was the strategic significance of these fatwas in the broader context of state development? Employing a qualitative case study approach, data were gathered through field observation, interviews, and document analysis in three regions of Central Java. The findings reveal that MUI fatwas were instrumental in aligning religious practice with public health directives at macro, meso, and micro levels. Through its fatwas and outreach programs, MUI functioned as both a moral guide and policy communicator. This study contributes to the discourse on religion-state relations in new democracies and highlights how religious legitimacy can enhance state resilience during public crises.

Abstract

Pemikiran Hukum Islam Abdullahi Ahmed an-Na`im meliputi spektrum yang luas, mulai hukum keluarga, isu permurtadan di Afrika, konstitusionalisme, hukum pidana, hukum internasional, HAM, hingganegara sekular. Dari banyak pemikirannya itu, isu HAM dan negara sekular yang paling banyak mendapat tanggapan dari pemikir lain. Kemudian HAM dalam perhatian an-Na`im dapat ditekankan pada isu-isu: perbudakan, gender, dan kebebasan beragama. Dilihat dari sociology of knowledge, pemikiran an-Na`im dimaksud tentu tidak bisa dilepaskan dari konteks sosial dimana an-Na`im hidup, belajar, dan bekerja. Sociology of knowledgemengandaikan bahwa pengetahuan seseorang sesungguhnya merupakan konstruksi sosial, bermotif dan berkepentingan, serta berkemungkinan ideologis atau utopis.
