Abstract

General Background: The regulation of halal products in Indonesia is critical for ensuring compliance with Islamic dietary laws and consumer protection. Specific Background: The Halal Product Guarantee Agency (BPJPH), established in 2014, manages halal certification, but its effectiveness is hindered by limited public resources, complex certification processes, and low public awareness. Knowledge Gap: While existing literature addresses the legal aspects of halal regulation, there is insufficient exploration of the socio-legal dynamics influencing compliance and enforcement in Indonesia. Aims: This study aims to analyze BPJPH's regulatory effectiveness in the halal certification process, identify the challenges faced, and propose actionable solutions. Results: Utilizing socio-legal methods, including legal analysis and interviews with key stakeholders such as the Ministry of Religion and the Indonesian Ulema Council, the findings reveal that BPJPH's implementation efforts are hindered by resource constraints and public ignorance about halal certification's significance. Novelty: This research uniquely integrates legal and social perspectives to provide a comprehensive understanding of the regulatory landscape, highlighting the interplay between law and societal values in shaping halal compliance. Implications: The study emphasizes the need for improved socialization, inter-agency collaboration, and educational initiatives to raise public awareness and enhance enforcement of halal products in Indonesia. Abstract

Background: Marriage and divorce are central issues in Islamic family law and need to be analyzed in the context of modern society. Specific Background: Many divorce cases arise due to infidelity and communication breakdown, creating challenges for legal and social resolution. Knowledge Gap: Few studies analyze court decisions comprehensively by combining Islamic law interpretation and legal practice. Aim: This study aims to examine marriage validity and divorce resolution from the perspective of Islamic law and statutory regulations. Results: The study reveals that court decisions are largely consistent with Islamic principles but highlight areas requiring better public understanding of legal grounds for divorce. Novelty: This research integrates legal analysis with social implications, providing a holistic view of divorce resolution. Abstract

General Background: Environmental conservation is a crucial legal and ecological concern, especially regarding the protection of rare plants in conservation areas. Specific Background: Edelweiss (Anaphalis javanica) is one of Indonesia’s protected plants, yet violations continue to occur in the Mount Butak area. Knowledge Gap: Previous studies have not fully examined how Article 21 of Law No. 5 of 1990 is implemented in real practice and its enforcement challenges. Aims: This study aims to analyze the implementation of Article 21 in protecting Edelweiss within the Mount Butak conservation area. Results: The findings show that law enforcement remains weak due to limited public awareness and the absence of strict supervision from authorities.Novelty: The study integrates empirical and juridical perspectives to highlight the inconsistency between legal norms and field practices. Implications: Strengthening law enforcement and environmental education is recommended to enhance conservation effectiveness and ensure the sustainability of protected ecosystems. Abstract

General Background: The modification of air rifles has become increasingly common in Indonesia, raising complex questions regarding legal boundaries and intellectual property protection. Specific Background: These modifications often involve both technical and aesthetic changes that may intersect with patent and industrial design rights. Knowledge Gap: Previous research has not thoroughly addressed how such modifications align with Law No. 13 of 2016 on Patents and Law No. 31 of 2000 on Industrial Designs, particularly when carried out for commercial purposes. Aims: This study aims to analyze the legal implications of air rifle modifications from the perspective of patent and design law. Results: The findings indicate that personal modifications pose minimal legal risk, while commercial alterations without permission from patent or design holders can lead to civil and criminal sanctions. Novelty: This paper provides a structured legal interpretation differentiating technical and aesthetic alterations under respective laws. Implications: The study contributes to clearer regulatory understanding and encourages compliance with intellectual property rights in mechanical innovation and design practices. Abstract

General Background Corruption is an extraordinary crime that continually threatens national stability and public trust in Indonesia. Specific Background This systemic threat is highlighted by the recurring corruption cases in Sidoarjo Regency, where three consecutive regional heads were implicated in a short period. Knowledge Gap Current literature lacks a focused, comparative analysis of these specific Sidoarjo cases through the specialized lens of State Administrative Law (HAN) to precisely identify the administrative roots of the crimes. Aims This study employs a normative juridical method with case and statutory approaches to trace the forms of administrative violations that precede and trigger criminal acts of corruption, and to analyze the preventive role of HAN. Results Findings confirm that all three regional heads committed violations in the aspects of authority, procedure, and policy substance, establishing acts of abuse of power and neglect of legal procedures as the core problem. Novelty This research offers a unique perspective by identifying a systemic pattern of administrative deficiencies spanning three successive administrations. Implications The results necessitate the urgent application of good governance principles and the substantial strengthening of the administrative supervision system to prevent future recurrences. Highlights: Systematic administrative abuse is the core cause of corruption involving three consecutive Sidoarjo regional heads. Violations occurred in authority, procedure, and policy substance, transitioning to criminal acts. Specific Background: This study explores administrative structures and practices in the United Kingdom and Australia, two countries that share a historical connection yet implement distinct administrative systems. Knowledge Gap: Previous research has generally focused on single-country governance without a structured comparison highlighting administrative efficiency and decentralization. Aim: This study aims to analyze and compare the core characteristics of public administration in both nations. Results: The findings show that while the UK applies a centralized parliamentary system, Australia adopts a federal approach that emphasizes state autonomy. Abstract

General Background: Penanganan perkara penganiayaan di Indonesia umumnya dikaitkan dengan hukum pidana, namun terdapat pula aspek perdata yang berhubungan dengan tuntutan ganti rugi terhadap korban. Specific Background: Kasus penganiayaan yang melibatkan Mario Dandy dan David Ozora menunjukkan adanya kebutuhan untuk memahami mekanisme penyelesaian perdata yang berjalan paralel dengan proses pidana. Knowledge Gap: Belum banyak kajian yang mengulas bagaimana prosedur hukum perdata diterapkan dalam konteks tindak penganiayaan yang bersifat pribadi dan merugikan secara material maupun psikologis. Aims: Penelitian ini bertujuan untuk menjelaskan perlindungan hukum bagi korban serta tahapan penyelesaian perkara penganiayaan melalui jalur perdata sesuai hukum positif Indonesia. Results: Hasil menunjukkan bahwa korban kini memperoleh perlindungan melalui UU No. 13 Tahun 2006 tentang Perlindungan Saksi dan Korban serta memiliki hak menuntut ganti rugi melalui proses mediasi dan gugatan perdata. Novelty: Studi ini menyoroti penerapan prosedur perdata yang sistematis dalam kasus penganiayaan yang umumnya dianggap ranah pidana. Implications: Temuan ini menegaskan pentingnya sinergi antara hukum pidana dan perdata untuk memastikan keadilan serta pemulihan hak korban secara menyeluruh. Abstract

General Background: Trees play a vital role in maintaining environmental balance, particularly along roadways, contributing to ecological stability and human well-being. Specific Background: In Sidoarjo, tree protection policies are implemented by the Environmental Service to regulate business activities, yet challenges remain in enforcement. Knowledge Gap: Despite existing regulations, including Regent Regulation No. 29 of 2018, the protection of tree functions has not been fully effective, highlighting gaps between national law, local regulations, and practical implementation. Aims: This study aims to examine the legal protection of tree functions in Sidoarjo and assess regulatory implementation. Results: Findings indicate that while national and local regulations, such as UU No. 32/2009 and Perda No. 8/2013, provide a legal basis, the execution of tree protection policies remains suboptimal due to overly comprehensive local regulations that dilute enforcement strength. Novelty: The study integrates normative juridical analysis with local policy evaluation, providing a critical perspective on the alignment of environmental protection laws with administrative practice. Implications: Strengthening regulatory coherence and enforcement mechanisms is essential to ensure sustainable urban environmental management and fulfillment of citizens’ rights to a healthy environment. Highlights: National and local laws provide a strong legal basis for tree protection. Enforcement of tree protection in Sidoarjo is not yet optimal. Abstract

General Background: The railway system serves as a vital component of public transportation supporting human mobility and logistics. Specific Background: However, persistent violations of the prohibition against being on railway tracks remain a serious safety issue in Indonesia, particularly in suburban and rural regions. Knowledge Gap: Despite the existence of Law Number 23 of 2007 concerning Railways, limited studies have examined the law’s juridical interpretation and its uneven enforcement between urban and rural areas. Aims: This study aims to analyze the legal basis, enforcement barriers, and implementation differences regarding the prohibition of being on railway tracks. Results: Findings reveal that enforcement is more consistent in urban settings due to stronger supervision and infrastructure, while rural areas face challenges stemming from weak law enforcement, poor coordination, and low legal awareness. Novelty: This research provides a juridical and comparative insight into the disparities in legal application across regions. Implications: Strengthening safety infrastructure, community legal education, and interagency coordination are essential to achieve legal compliance and public safety in railway operations. Highlights: Law enforcement is stronger in urban areas than in rural ones. Legal awareness and safety infrastructure remain key challenges. Abstract

General Background: Divorce rates in Indonesia have shown a consistent increase, prompting the Supreme Court to issue various regulations aimed at maintaining marital harmony. Specific Background: One of these efforts is Supreme Court Circular Letter (SEMA) No. 3 of 2023, which introduces a six-month separation requirement before divorce can be granted in Religious Courts. Knowledge Gap: Despite its legal intent, limited empirical evidence exists on how this regulation affects divorce dynamics at the local court level. Aims: This study investigates the implementation of SEMA No. 3 of 2023 and its practical role in reducing divorce cases at the Sidoarjo Religious Court. Results: Findings reveal that while the policy initially reduced divorce numbers in 2023, the effect was temporary, with cases increasing again in subsequent years due to its non-binding nature. Novelty: The research offers a contextual empirical analysis of SEMA’s role within Indonesia’s Islamic judicial system. Implications: Strengthening the juridical framework and integrating social counseling mechanisms are crucial for ensuring the sustainability of family law reforms in Islamic courts.Highlights: SEMA functions as an internal legal guideline, not binding law.
