Abstract

Abstract: In essence, marriage is one of the things desired by everyone, male or female, in their lives. It is also seen as a change of status in a person from living in single life into family one through the media dealing with this. In terms of kinship, the relationship between society and family can occur through marriage and mate selection in order that a new family is established. This is an event in people’s life which is considered important and sacred in their lives. For ethnic group of Kaili, marriage will give a meaning in community’s life, which is represented in the phrases of Kalinese language, such as, among others, momboli tanda tuvu (leaving consecrated life).Kata Kunci: upacara mematua, mandiu pasili, hukum slam, hokum adat, suku Kaili

Abstract

This paper aims to analyze the ideas and policy proposals for simplification of ballot papers implemented in the 2024 simultaneous elections. This simplification of ballots is carried out in an effort to make it easier for voters to vote on voting day in the simultaneous elections, especially in getting to know election participants and their candidates in the right way and legitimate. In addition, simplification of ballot papers makes it easier for election organizers in the process of vote counting accuracy. The design of the electoral ballot must always be relevant to the electoral system and the context of a country's system of government. How is the design of election ballots in the context of the electoral system and the presidential government system adopted in Indonesia. Abstrak Tulisan ini bertujuan untuk menganalisis gagasan dan usulan kebijakan penyederhaan surat suara yang dilaksanakan dalam pemilu serentak 2024. Penyederhanaan surat suara ini dilakukan dalam upaya untuk memudahkan pemilih dalam memilih saat hari pemungutan suara pada pemilu serentak terutama dalam mengenal peserta pemilu dan kandidatnya dengan cara yang benar dan sah. Selain itu penyederhaan surat suara memberikan kemudahan bagi penyelenggara pemilu dalam proses akurasi penghitungan suara. Desain surat suara pemilu harus selalu relevan dengan sistem pemilu dan konteks sistem pemerintahan suatu negara. Bagaimana desain surat suara pemilu dalam konteks sistem pemilu dan sistem pemerintahan Presidensial yang dianut di Indonesia.

Abstract

This study aims by using qualitative methods with data collection techniques, namely interviews, observation, verification in order to obtain data that is truly valid and can be accounted for. The results of this study indicate that the marriage in the adat of the Tajio Tribe in Siney Village, Tinombo Selatan District, Parigi Moutong Regency is to open the tajalang to open the road, that is, the man will tell his desire to propose to the woman but with satire words, then Nalolo Tevulang Nombosi is looking for a day or It is a good month to meet the family of the woman who wants to be married to, the next stage is to open the first tejarita, namely the man comes to the woman's house to discuss further the matchmaking plan and the last marriage process is tevea nelili, which is sprinkling yellow rice on the man's family This is a sign that the woman's family has officially accepted the proposal of the male party and the view of Islamic law on the marriage of the Tajio Tribe in Siney Village, Tinombo Selatan District, Parigi Moutong Regency is not against Islamic Law and even in accordance with Islamic Law because of the marriage in The traditions of the Tajio Tribe in Siney Village, South Tinombo District, Parigi Moutong Regency contain elements of faith, elements of worship and contain elements of akhlakul karimah.

Abstract

This paper describes the concept of a fairness theory of justice with integrity applied in elections in Indonesia, drawing on the transformation of John Rawls' fairness theory. This theory is employed to examine various components of the electoral legal framework, focusing on the technical implementation of elections and the resolution of electoral disputes to achieve electoral justice in Indonesia. The research utilizes normative legal methodology, characterized by dogmatic legal analysis and theoretical-rational reasoning, employing a logical-deductive approach. It constructs the facts of electoral justice through an extensive review of legal literature and relevant data sources concerning the electoral process in Indonesia. The study addresses electoral practices as instruments of popular sovereignty, highlighting dissatisfaction among stakeholders regarding the election process. The theoretical variables associated with fairness with integrity are critically analyzed for their applicability in fostering electoral justice in Indonesia, emphasizing that a fundamental aim of electoral law enforcement is to ensure the realization of electoral justice.

Abstract

Penelitian yang berjudul “Alasan Dispensasi Nikah Usia Dini (Studi Kasus di Pengadilan Agama Palu klas IA” ini bertujuan untuk memberikan gambaran dan penjelasan terhadap pengajuan permohonan dispensasi nikah usia dini di Pengadilan Agama Klas 1.A Palu dan pertimbangan hakim dalam memberi atau menolak permohonan dispensasi nikah usia dini di Pengadilan Agama Klas 1 Palu. Penelitian ini di desain dengan menggunakan jenis penelitian deskriptif, dengan menggunakan pendekatan kualitatif dalam teknik pengumpulan data. Hasil penelitian, menujukan bahwa alasan permohonan dispensasi nikah di Pengadilan Agama Palu dikarenakan khawatir timbulnya fitnah, hamil diluar nikah, aspek ekonomi, aspek sosial, dan aspek moral. Sedang mengenai pertimbangan hakim dalam memberikan penetapan dispensasi nikah di persidangan, Majelis Hakim menggunakan”kaida yaitu al-mashlahah al- mursalah”. karena ketentuan pembatasan umur dan dispensasi nikah tidak dijelaskan secara rinci di dalam al-Quran, tetapi kandungan maslahatnya sejalan dengan tindakan syara’ yang ingin mewujudkan kemaslahatan bagi manusia (kedua calon mempelai beserta keluarga).
