Abstract

The rapid growth of Indonesia’s creative economy, driven by digital transformation, has created unprecedented opportunities for creative workers, while simultaneously leaving them legally vulnerable. This includes unclear employment status, inadequate contractual arrangements, and limited access to legal and social protection. This research develops an integrative model of an Artificial Intelligence (AI), powered Smart Legal Platform to strengthen legal protection for creative workers in the digital economy. Using a mixed normative-empirical research approach, the study combines legal analysis of labor regulations, intellectual property, and social security with field data from 30 creative workers across various digital subsectors. Quantitative data were analyzed using validity and reliability tests, while qualitative insights were obtained from structured interviews and focus group discussions (FGDs). The proposed platform integrates four key features: AI-based legal consultation, automated contract creation, online dispute resolution, and integration with the national social security service (BPJS). Findings indicate a high demand for AI-based legal solutions, with respondents emphasizing the need for a platform that is accessible, affordable, and easy to use. The proposed model contributes theoretically to the debate on AI use in law and practically offers a scalable, modular, and inclusive legal technology solution for the creative sector. Its implications extend to policymakers, platform managers, and the broader digital labor market, in line with achieving Sustainable Development Goals (SDGs) 8 and 16.

Abstract

Generasi Z adalah kelompok siswa yang berkembang di era digital dan sangat dekat dengan pemanfaatan perangkat, platform media sosial, serta interaksi berbasis internet. Situasi tersebut membuka kesempatan untuk pengembangan pengetahuan dan kreativitas siswa, namun juga menghadirkan risiko berupa gaya hidup tidak sehat, penyebaran informasi keliru, perundungan di dunia maya, pelanggaran privasi, serta rendahnya kesadaran hukum dalam aktivitas digital. Kegiatan Pengabdian kepada Masyarakat ini bertujuan membantu siswa SMK Mulya Husada Purwokerto memahami pentingnya menjaga kesehatan, menggunakan teknologi dengan bijak, serta membangun kesadaran hukum di era digital. Metode kegiatan menerapkan pendekatan partisipatif-edukatif melalui penyuluhan, diskusi interaktif, analisis kasus, refleksi peserta, observasi, dokumentasi, dan evaluasi pemahaman. Hasil kegiatan menunjukkan bahwa siswa menunjukkan minat besar terhadap topik yang berhubungan dengan penggunaan perangkat, keamanan akun, etika komentar, perlindungan data pribadi, dan risiko penyebaran konten tanpa izin. Penggabungan materi kesehatan, literasi digital, dan kesadaran hukum dapat mengaitkan isu remaja dengan kondisi nyata yang mereka alami dalam kehidupan sehari-hari. Diskusi yang berfokus pada kasus juga membantu siswa menyadari bahwa aktivitas digital berdampak pada aspek sosial, kesehatan, dan hukum. Kegiatan ini menunjukkan bahwa edukasi terpadu sangat penting sebagai strategi pencegahan untuk menciptakan siswa yang sehat, berpikir kritis, bijaksana dalam menggunakan media digital, dan bertanggung jawab secara hukum.

Abstract

The advancement of generative artificial intelligence (AI) presents significant legal challenges to modern copyright systems, particularly in redefining originality and authorship in relation to AI-generated works. This study critically examines how copyright law in Indonesia and South Korea addresses these challenges through the normative lens of the rule of law. It explores how generative AI disrupts conventional legal concepts, especially concerning authorship attribution, ownership, and the legitimacy of protecting non-human creations under copyright. Using a normative juridical method, the research applies statutory, conceptual, and theoretical approaches to analyze the comparative legal responses of both countries. The focus is on the presence or absence of specific legal frameworks governing AI-generated content and their implications for legal certainty, distributive justice, and the adaptability of copyright law in the face of technological change. Findings show that Indonesia’s Copyright Law Number 28 of 2014 remains centered on a human authorship model and has yet to address the complexities introduced by digital innovation. Conversely, South Korea demonstrates a more progressive legal posture, reflected in its legislative discourse and policy developments regarding AI-assisted works and exceptions for text and data mining. The study concludes that Indonesia must initiate legal reform to align its copyright system with the evolving nature of authorship in the digital era. This reform should be grounded in the principles of the rule of law to ensure the protection of both moral and economic rights of creators in an increasingly AI-driven creative landscape. This research provides timely insights for policymakers and legal scholars navigating the intersection of copyright law and artificial intelligence, emphasizing the urgent need for adaptive legal frameworks in the age of artificial creativity.

Abstract

Transactional crimes, particularly cross-border money laundering, disrupt the global economy. Globalization and scientific and technological advancements have made money launderers able to work across borders and quickly escape to other countries to avoid being prosecuted. In many nations, this scenario leads to the phenomenon of transnational fugitives. Because of this, those who commit crimes against justice and humanity may go unpunished. Cross-border money laundering has grown to be a global issue that calls for a worldwide response. This crime has grown due to globalization, which has also made it simpler for offenders to escape to other countries to avoid being prosecuted. Injustice and impunity may result from this situation. This is because the extradition tool used up to this point has recently lost some effectiveness. Consequently, after the ratification of the ASEAN Treaty on Mutual Legal Assistance in Criminal Matters 2004 (MLAT 2004), a different tool is required through Mutual Legal Assistance (MLA). This is meant to prevent offenders—particularly Indonesian fugitives who are still at large in Singapore—from going free. However, law enforcement against foreign TPPU in Indonesia must also be rebuilt, particularly regarding inbound extradition. It has not addressed human rights (HAM) or offered legal clarity thus far. The ASEAN principle of free movement of judgment is believed to prevent criminals from going unpunished, and the court should decide on overseas extradition to Indonesia. Recommendation: To combat cross-border money laundering, more formal agreements must be signed, and law enforcement and other nations must work together.

Abstract

Franchise businesses are a rapidly growing form of enterprise that significantly contribute to the national economy. However, in practice, various legal issues arise, such as unclear contractual clauses, intellectual property rights violations, and disputes between franchisors and franchisees. This study aims to analyze the legal protection of franchise businesses in Indonesia based on civil law. It employs a normative juridical approach, analyzing relevant regulations, including Government Regulation No. 42 of 2007, Minister of Trade Regulation No. 53/M-DAG/PER/8/2012, and the Indonesian Civil Code. The findings reveal that franchise agreements in Indonesia are clearly regulated under Government Regulation No. 42 of 2007, providing legal certainty for both franchisors and franchisees through written contracts. These contracts detail the rights, obligations, and responsibilities of each party, including critical aspects such as intellectual property rights (IPR), training, operational support, and the franchisee's obligation to operate the business according to established standards. Legal protection for franchise businesses is rooted in various regulations, including the Civil Code, which recognizes franchise agreements as reciprocal obligations. IPRs, such as trademark rights, patents, copyrights, and trade secrets, play a crucial role in protecting business elements that enhance competitiveness, including brands, technical innovations, and business concepts. Challenges in legal protection for franchise agreements in Indonesia involve several issues. One such issue is the failure to register franchise agreements, which can render them legally invalid. Additionally, unilateral termination by franchisors can harm franchisees. Trademark violations, such as unauthorized use, may also cause losses for both parties. Imbalances in bargaining positions between franchisors and franchisees often result in unfair contracts, potentially undermining the principle of freedom of contract in civil law

Abstract

Balinese customary inheritance law operates within a plural legal order in which the traditional patrilineal kepurusa system interacts with evolving principles of gender equality and internal adat reform. This creates a legal problem when courts apply different understandings of the inheritance status of women who marry out of their natal families, particularly after the 2010 Decision of the Majelis Utama Desa Pakraman (MUDP) expanded recognition of women’s inheritance rights. This study examines the sources and forms of judicial incoherence in Balinese inheritance disputes and evaluates whether judicial reasoning reflects the normative development introduced by the 2010 MUDP Decision. Using normative legal research, the study applies statutory, conceptual, and case approaches to legislation, customary-law instruments, the MUDP Decision, relevant court decisions, legal doctrines, and scholarly literature. The comparative analysis shows that judicial reasoning remains divided between decisions that acknowledge the evolving character of Balinese customary law and those that continue to prioritize traditional patrilineal concepts such as purusa, sentana rajeg, and nyentana. This divergence demonstrates that judicial incoherence is not merely a consequence of legal pluralism but also reflects a gap between internal adat reform and its recognition in state adjudication. The study contributes theoretically by conceptualizing this inconsistency as an adjudicative recognition gap between normative change within customary law and its translation into judicial reasoning. It argues that greater consistency requires clearer recognition of adat reform, stronger incorporation into awig-awig and perarem, gender-sensitive interpretation, improved evidentiary standards, and consistent jurisprudential guidance to strengthen legal certainty and women’s protection in Indonesia.
