Abstract

In Indonesia, there have been many disputes over famous trademarks which ended by the cancellation and deletion of registered. This research aimed to describe and find out about, first, the legal protection of the right of famous trademarks rights based on law trademarks and second, implementation the legal protection of the right of famous trademarks rights (MA decision study of IKEA and SEPHORA brand). This research used the normative juridical method with a statutory and a case approaches. The result of this research first is the legal protection of the right of famous trademarks rights based on based on law trademark uses a constitutive system. One of the rules governing the Protection of Famous Marks is regulated in Article 21 (1). Furthemore, the implementation of the legal protection on the right of famous trademark in the case of the IKEA trademarks constrained by the difference interpretation of Article by the Panel of Judges and resulted ended by famous trademarks are fail to be protected. Meanwhile in the case of the SEPHORA trademarks implementation of the legal protection of the right of famous have protected the trademarks.

Abstract

The case of a fictional character who became a trademarks is the case of the "Super Mario Bros" trademarks in which individual trademarks holders, Indonesian companies and the Director General of Intellectual Property were sued by a well-known game company, Nintendo. The crew of 'mario bros' characters were used as packaging designs and characters in the game, but because the game has been loved by people in countries such as Australia, Malaysia, India, China, including Indonesia in the 90s (nineties), Nintendo decided to register the character. "super mario bros" and its variants use trademark registration media. This means that the Nintendo company avoids legal turmoil caused by irresponsible parties to use fictional characters have sold tens of thousands of copies.However, even though it has been registered, there are still parties who have managed to get the rights to the brand with the "Super Mario Bros" logo. Registered in 1994 in the name of an individual or individual before being transferred to a legal entity or company.

Abstract

Rendahnya literasi hukum konsumen di kalangan remaja dalam memilih produk skincare yang aman, halal, dan bebas dari klaim berlebihan (overclaim) berpotensi meningkatkan risiko kerugian akibat penggunaan produk yang tidak sesuai dengan standar keamanan maupun ketentuan hukum. Kegiatan pengabdian ini bertujuan meningkatkan pengetahuan dan kesadaran hukum remaja mengenai pentingnya memilih produk skincare yang aman serta memahami hak-haknya sebagai konsumen. Kegiatan dilaksanakan di SMP Negeri 13 Kota Pekanbaru bersama 30 siswa sebagai mitra melalui penyuluhan hukum dalam bentuk ceramah, diskusi interaktif, dan tanya jawab. Materi mencakup pengenalan produk skincare, identifikasi kandungan yang aman, bahaya klaim berlebihan, serta hak dan upaya hukum konsumen berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Evaluasi dilakukan melalui observasi partisipatif terhadap keterlibatan peserta, sesi tanya jawab, serta wawancara singkat dan diskusi reflektif bersama peserta dan guru pendamping. Hasil kegiatan menunjukkan peserta memiliki pemahaman yang lebih baik mengenai pentingnya memilih produk skincare yang aman, mampu mengenali karakteristik klaim yang menyesatkan, serta memahami hak konsumen dan upaya hukum yang dapat ditempuh apabila mengalami kerugian akibat penggunaan produk skincare. Kegiatan ini memberikan kontribusi positif dalam meningkatkan literasi hukum konsumen sejak dini dan mendorong terbentuknya perilaku konsumsi yang lebih kritis, cerdas, dan bertanggung jawab di kalangan remaja.

Abstract

This study aims to provide solutions and knowledge to legal protection, especially in ownership of land rights in performing housing benefit sharing agreements in Pekanbaru City, in addition, this study also aims to find out the application of such legal protection to land ownership rights by sharing the proceeds of such housing. It is expected that there will be no more intersections of legal certainty about housing sharing agreements among communitiesThe type of research used by the authors is the Normative Law method, As for the result of this study, the legal protection related to ownership of land rights in the housing sharing agreement specifically in the city of Pekanbaru can refer to Article 1338 paragraph (3) of the Civil Code, which says that the agreement must be executed in good faith, Where the deed of construction agreement containing the rights and obligations of the parties is a deed made in front of a notary that is authentic so that in the presence of such an agreement it becomes a law among them, whereas in its specific application in Kota Pekanbaru Land division cooperation is carried out according to the principle for units, the share of land owners in the form of ownership of house units with a certain percentage, as well as the developer also gets a share of the number of units according to the agreement. The size of each party's share depends on the price of the house unit. Where the higher the price of the house, the greater the share of the owner of the land, so that the parameters of its division correspond to the agreement promised in advance.
