Abstract

Salah satu desa yang ada di Kecamatan Labuhan Deli Provinsi Sumatera Utara Kabupaten Deli Serdang adalah Desa Pematang Johar. Orang tua harus menempatkan prioritas tinggi pada pendidikan anak-anak mereka. Pendidikan masih belum menjadi perhatian utama di masyarakat Pematang Johar karena orang tua di sana masih lebih memilih anak-anak mereka bekerja sebagai petani karena mentalitas mereka yang belum dewasa. Penelitian ini bertujuan untuk mempengaruhi sikap orang tua dalam meningkatkan kualitas pendidikan remaja di Desa Pematang Johar Dusun XV. Metodologi yang digunakan dalam penelitian ini adalah pendekatan observasional kualitatif, yang melibatkan pengamatan dan pencatatan keadaan atau objek sasaran. Temuan penelitian ini menunjukkan bahwa masih ada jumlah hambatan dalam sistem pendidikan Indonesia, termasuk ketersediaan guru dan sikap masyarakat. Selain itu, perlu melatih tenaga pendidik, melibatkan masyarakat dalam kegiatan sosial, dan menyelenggarakan program belajar untuk mengubah pola pikir lingkungan.

Abstract

This research is a qualitative study which aims to find out the reasons for the prohibition on marriage in the month of Muharram for Javanese people and the views of Islamic law regarding this prohibition. The techniques used in this study are observation and interview techniques. The target population is the entire community of Jati Mulyo Village, Pegajahan District. However, there were only 2 subjects as the research sample. From the research results, it was found that the people in Jati Mulyo Village, Pegajahan District, Serdang Bedagai Regency still have great confidence in the customs that have been passed down from generation to generation regarding the prohibition of marriage in the month of Muharram. However, in the view of Islam there is no prohibition on getting married in that month. Precisely if we do the right and good worship in that month then we will get glory.

Abstract

Ilmu mantiq merupakan ilmu yang mempelajari tentang logika, ilmu mantiq pertama kali dipopulerkan oleh para filsuf yunani yakni Sokrates, Plato, dan Aristoteles. Kehadiran ilmu mantiq di dalam Islam membawa perbedaan di kalangan para ulama, yakni dalam hal mempelajarinya, Imam An-Nawawi adalah salah satu ulama yang mengharamkan mempelajari ilmu mantiq, sedangkan Imam Al-Ghazali adalah salah satu ulama yang memperbolehkan mempelajari ilmu mantiq bahkan menganggap mempelajarinya adalah fardhu kifayah. Tujuan dari penelitian ini adalah untuk mengetahui pandangan Imam An-Nawawi dan Imam Al-Ghazali terkait dengan mempelajari ilmu mantiq, kemudian untuk mengetahui analisis perbedaan pendekatan dan sudut pandang yang digunakan oleh Imam An-Nawawi dan Imam Al-Ghazali dalam mempelajari ilmu mantiq. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian kepustakaan, data yang diambil melalui studi yang mendalam terhadap literatur-literatur yang relevan, seperti buku, artikel, dan tulisan-tulisan Imam An-Nawawi dan Imam Al-Ghazali. Imam An-Nawawi melarang mempelajari ilmu mantiq karena menggagap ilmu mantiq merupakan inti dari filsafat, sedangkan Imam Al-Ghazali menganggap ilmu mantiq sebagai penghantar dari filsafat.

Abstract

This study discusses the synergy between law and education in providing protection for contract workers in Indonesia. Contract workers are one of the labor groups that often face problems related to legal status, job uncertainty, and limitations in obtaining normative rights as stipulated in labor regulations. Although Law Number 13 of 2003 on Manpower and its derivative regulations have provided a legal framework, implementation in the field often shows that there are loopholes that weaken the position of contract workers. Therefore, an interdisciplinary approach is needed that integrates the legal and educational dimensions to provide more comprehensive protection. The research method used is normative legal research with a qualitative approach, through an examination of laws and regulations, doctrines, and labor practices, and enriched with educational studies that emphasize the importance of legal literacy for workers. The results of the study show that legal protection for contract workers has not been fully effective due to weak supervision, low understanding of workers about their rights, and the practice of contract abuse by employers. In this context, education plays an important role as an important instrument to increase the legal awareness of contract workers, both through formal and non-formal education, as well as legal and employment skills-based training. The conclusion of this study confirms that legal and educational synergy is a relevant strategy to strengthen the protection of contract workers. The law provides a binding normative framework, while education forms the awareness and empowerment of workers in demanding their rights. Thus, the combination of the two is expected to be able to realize social justice and improve the welfare of contract workers in Indonesia.

Abstract

Theft and corruption are social problems that have existed since ancient times and continue to be serious challenges in various countries, including countries with Muslim majorities. From an Islamic perspective, these two acts are not only considered as violations of positive law, but also as major sins that damage the social and moral order of society. Islam provides clear guidance in overcoming theft and corruption, both from a legal and ethical perspective. Therefore, this study aims to examine how Islamic law regulates sanctions against theft and corruption and to find the right approach in eradicating them. This study uses a normative juridical method with a literature study approach that focuses on the analysis of sources of Islamic law, including the Qur'an, Hadith, fiqh books, and regulations in force in Muslim countries. The results of the study show that Islamic law has a firm mechanism in dealing with theft and corruption, with the main principle of upholding justice and the welfare of the people. In conclusion, Islamic law not only provides sanctions as a form of punishment, but also emphasizes preventive aspects through moral education and the formation of individuals with integrity. With a comprehensive understanding, Islam can be a solution to combating theft and corruption effectively and fairly.

Abstract

Polygamy in Indonesian law is positioned as an exception to the principle of monogamy and is permitted only in a limited manner under strict requirements, including court authorization and the consent of the lawful wife. Nevertheless, unauthorized polygamous practices remain prevalent, giving rise to legal uncertainty regarding marital status and causing both material and immaterial harm to the lawful wife. This study aims to analyze the juridical implications of Law Number 1 of 2023 for unauthorized polygamy, particularly with respect to legal certainty and the protection of the lawful wife’s rights. The research employs a normative legal method with statutory, conceptual, and philosophical approaches, examining provisions of marriage law, the National Criminal Code, as well as doctrines of criminal law and Islamic law. The findings indicate that Articles 411 and 412 of the National Criminal Code provide legal certainty by affirming that the validity of marital and sexual relations is determined by recognition under state law. Unauthorized polygamy that fails to comply with family law procedures may be classified as the criminal offense of adultery or cohabitation, both of which are complaint-based offenses. This legal construction strengthens the protection of the lawful wife by positioning her as a legal subject with control over the initiation of law enforcement processes. The study concludes that the reform of the National Criminal Code is not intended to criminalize polygamy as an institution, but rather to prevent its misuse in ways that undermine the rights of the lawful wife.
