Abstract

This research is motivated by the government's seriousness in realizing improvements in the community's economy, namely by creating a business competition compliance program to overcome or prevent unfair business competition practices among business people. The effectiveness and efficiency of the implementation of the program, it is still not fully realized, because there are still many companies that have not participated in the business competition compliance program. The legal issues in this research are: 1). Reviewing the supervisory role of KPPU on the effectiveness of the business competition compliance program in efforts to prevent unfair business competition. 2. Analyze the strategies for dealing with unfair business competition and implementing business competition compliance programs in society. This research is normative juridical. By using a statutory and conceptual approach. In this study, two sources of primary and secondary legal materials were used.. This institution has a very broad authority, namely being a supervisory institution, it also has authority in the judicial and legislative fields. One of the legislative powers issued is KPPU Regulation Number 1 of 2022 concerning the Business Competition Compliance Program. This program is expected to be a form of effort to prevent unfair business competition. In practice this program is still not effective. Therefore, it is necessary to revise Law Number 5 of 1999 so that it will provide a clear position for KPPU in carrying out its duties and be able to implement business competition compliance programs to the fullest. Second, regarding the strategy developed to create fair business competition, it can provide understanding for business actors to comply with and also build awareness independently to help implement the program and to be able to identify, assess and manage risks that will occur with the provision of mentoring.

Abstract

The Consumer Dispute Settlement Body (BPSK), in accordance with Law No. 8 of 1999 regulating Consumer Protection (UUPK) is regulated by the government, has a role to handle and resolve problems arising between consumers and business actors. The purpose of establishing BPSK is to reduce the complexity and time required in court proceedings, which are often long and difficult, by providing an out-of-court dispute resolution shortcut, focusing on the principles of speed, simplicity, and affordable costs. This study focuses on the Consumer Dispute Settlement Body in Bandung City, using a normative legal approach. In brief, the purpose of BPSK is to avoid resolving consumer disputes through the public courts. The general court is long and costly, but BPSK makes a fast and even cheap procedural law. The author analyzes legal literature related to consumer protection and consumer dispute resolution, and then compiles and classifies it in a detailed, systematic, and directed manner. The data collected is then analyzed descriptively to provide a comprehensive picture of the problem of consumer dispute resolution at BPSK Bandung City.

Abstract

The problem of teachers and education personnel at SMP Muhammadiyah 2 Malang is the ignorance of parents or guardians, including students, about the actions of educating teachers at school. Considering that this educational action is a process of educating and disciplining students, knowledge about this is needed, considering that legal proceedings often occur against teachers and staff who are deemed to have committed violence against students. So the community service feels the need to contribute to help provide appropriate counseling or education needed by society. So the role of a teacher in educating, teaching, guiding, directing, training, assessing, and evaluating so that educators are given the authority to rewards and punishment to students is not violence.   Abstrak Permasalahan yang dihadapi oleh Guru dan Tenaga Kependidikan di SMP Muhammadiyah 2 Malang adalah ketidaktahuan orang tua atau wali murid termasuk siswa tentang tindakan mendidik guru di sekolah. Mengingat bahwa tindakan mendidik ini, merupakan proses mendidik dan mendisiplinkan siswa maka pengetahuan tentang hal tersebut sangat dibutuhkan, mengingat sering terjadi proses hukum kepada guru maupun tenaga kependidikan yang dianggap melakukan kekerasan kepada siswa.. Maka pengabdi merasa perlu untuk berkontribusi membantu memberikan penyuluhan atau edukasi yang dibutuhkan oleh masyarakat. Maka peran seorang guru dalam mendidik, mengajar, membimbing, mengarahkan, melatih, menilai, dan mengevaluasi peserta didik, sehingga pendidik diberi kewenangan untuk memberikan penghargaan dan punishment kepada siswa bukanlah sebuah kekerasan.

Abstract

The rapid growth of online lending platforms in Indonesia has raised concerns regarding personal data misuse. This research examines the legal protections available to protect personal data in online lending by emphasising the importance of strict regulations and legal enforcement mechanisms. This research also explores how existing laws, including the Indonesian Personal Data Protection Law, exist. This normative legal research employs a statutory approach. This research highlights gaps in current legislation by analysing cases of personal data breaches and unethical practices. It offers recommendations for strengthening the legal framework to prevent misuse of personal information. The research concludes that a stronger legal approach is needed to protect consumers from potential harm from online lending and promote trust in digital financial services.

Abstract

The task of the Curator in Bankruptcy is to administer and settle the bankruptcy estate. It is also the curator who must carry out the execution of the bankrupt assets. In practice, it is not easy, and there are several obstacles faced, especially when the debtor in bankruptcy is a Limited Liability Company in the form of a State-Owned Enterprise Persero. Until now, there are no assets of BUMN PT Persero (in bankruptcy) that can be executed. The purpose of this study is to find out how the execution of assets of P.T. Kertas Leces Persero (in bankruptcy) and what the curator’s efforts are about it. Theresearch is juridical empirical. The results of the study show: There are two stages of asset execution— management and settlement of bankrupt assets. However, there are still obstacles, both internal and external, with considerable government intervention. The curator’s efforts to deal with these obstacles are by sending letters to all relevant agencies, taking an inventory of the assets and legal documents belonging to P.T. Kertas Leces Persero, which are needed in the process of executing the bankruptcy assets.

Abstract

This study aims to provide contributions and ideas in the form of efforts to prevent bankruptcy for debtors / companies affected by the COVID-19 pandemic. This is a normative juridical law research with a conceptual approach and legislation. Primary and secondary legal materials are analyzed in terms of their content. The results of the research and legal discussion show that Bankruptcy is the last legal effort in overcoming the Covid-19 pandemic in the event that the company experiences debt repayment difficulties (defaults). Efforts that can be made are by: Optimizing the application of Business Sustainability Principles; The Covid-19 pandemic is the reason for Force majeure, the importance of restructuring and renegotiation mechanisms by debtors and creditors through Postponement of Debt Payment Obligations, and Bankruptcy is the last legal remedy (ultimum remedium).

Abstract

International arbitration awards in practice do not always run smoothly in carrying out their executions, so there is a need for affirmation of regulations both fundamentally or the principles and regulations. That is the background why this needs to be studied. So the legal issues in the research are: How is the power of the executive principle in international arbitration decisions in terms of the Regulation of the Supreme Court of the Republic of Indonesia Number 1 of 1999 concerning Procedures for Implementing Foreign Arbitration Awards? The problems that arise in carrying out the execution of foreign arbitration awards in Indonesia?. This study uses a normative juridical research method using a doctrinal legal approach, which analyzes laws and regulations, legal theories, doctrines, legal principles, which are analyzed in the form of descriptions. The results of the study show that: basically the legal force of an international arbitral award which is final, binding and legally binding remains the same as a court decision that has permanent legal force. What makes the difference is that an international arbitral award does not have executive power before the award is registered and requested for executorial fiat at the Central Jakarta District Court. The problem that often arises in Indonesia is the use of reasons for decisions that are contrary to public order (public policy) to refuse the execution of decisions. So that in such circumstances the international community sees it as a legal uncertainty.

Abstract

Tujuan dari penulisan jurnal ini adalah untuk mengeksplorasi bagaimana hukum melindungi wanita dalam situasi kawin lari. Penelitian ini memeriksa perlindungan hukum yang diberikan kepada perempuan dalam situasi perkawinan lari, yaitu pernikahan yang terjadi tanpa persetujuan dari orang tua atau wali dan tanpa mengikuti prosedur resmi yang ditetapkan oleh hukum di Indonesia. Kawin lari sering kali mengakibatkan dampak negatif bagi wanita, seperti kerentanan terhadap hak-hak mereka, mencakup hak atas properti, hak asuh anak, serta perlindungan dari kekerasan. Secara hukum, Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan menetapkan persyaratan usia dan persetujuan orang tua untuk melangsungkan pernikahan, serta ketentuan dalam KUHP yang mengatur sanksi terhadap pelaku kawin lari. Namun, dalam praktiknya, perempuan yang menjalani kawin lari sering kali mengalami kesulitan untuk mendapatkan pengakuan hukum dan perlindungan yang memadai. Secara keseluruhan, pemerintah menganggap perkawinan ini tidak sah. Penelitian ini menggunakan pendekatan normatif yuridis dengan mengumpulkan data dari studi dokumen guna memahami pelaksanaan perlindungan hukum dan tantangan yang dihadapi oleh perempuan yang menjadi korban kawin lari. Temuan dari penelitian ini menunjukkan bahwa perlindungan hukum untuk perempuan dalam konteks kawin lari masih jauh dari optimal dan diperlukan kolaborasi antara hukum positif dan nilai-nilai sosial budaya untuk memastikan hak-hak perempuan terlindungi secara adil dan menyeluruh.
