Abstract

Illegal marriage is a strange phenomenon that is still intense in the Acehnese community. In fact, Islam has very clearly forbade any form of marriage that is carried out in secret in order to produce a harmonious family and social community. The occurrence of illegal marriages when the condition of the bride still has a nasab guardian is a practice that is allegedly in bad faith, one of which is because the husband still has a legal wife who does not agree to polygamy. There are also those who do illegal marriages because they want to find an alternative to their work which prohibits polygamy status. This reality is a reality that can harm many parties, both for family members and society. In response to this, the Lhoksukon KUA has implemented various policies so that the problem of illegal marriages can be minimized. This article belongs to field research with a qualitative approach. The methodology used is a phenomenological study of the actions of KUA Lhoksukon North Aceh. The results of the study concluded that the KUA Lhoksukon North Aceh carried out various activities to prevent illegal marriage by way of socialization and guidance to the community regarding the negative impact of illegal marriage.

Abstract

This article intends to analyze the impeachment of the vice president from the point of view of Indonesian law and Siyasah Islamiyah, with special emphasis on the case of Indonesian Vice President Gibran Rakabuming Raka. The impeachment of high-ranking state officials, such as the vice president, is an important issue [there is an Indonesian system of government that adheres to the presidential system. The discussion on the impeachment of Gibran Rakabuming Raka as Vice President of the Republic of Indonesia has caused a deep debate, not only from the point of view of constitutional law but also from the perspective of leadership ethics and political legitimacy. This research is a juridical-normative research. The data sources of this study are composed of primary and secondary data sources collected through literature studies. After accumulation, the data is analyzed by qualitative descriptive analysis method. The findings of this study indicate that the process of impeachment of Vice Presidents in Indonesia is strictly regulated and very limited. The 1945 Constitution contains clear requirements, namely that there must be serious violations of the law and involve three institutions. This makes impeachment difficult to carry out without strong evidence. In the context of Siyasah Islamiyah, a leader can be impeached if he loses trust and justice, which emphasizes the importance of moral responsibility. Gibran's case shows a clash between legality and legitimacy, where even if he is officially elected, the process undermines the trust of the public.

Abstract

Mengonsumsi makanan dan minuman halal merupakan suatu keharusan ‎bagi umat Islam, sehingga sangat penting untuk dapat mengidentifikasi apakah ‎produk yang akan dikonsumsi halal. Indonesia sebagai negara dengan mayoritas ‎penduduk Muslim harus terus berupaya meningkatkan jaminannya sebagai ‎bentuk perlindungan hukum bagi masyarakatnya. Dalam penelitian ini akan ‎membahas urgensi penerapan jaminan produk halal dan penerapan sertifikasi ‎halal bagi produk yang beredar di masyarakat Indonesia. Untuk menjawab ‎permasalahan tersebut, peneliti menggunakan metode penelitian hukum, dengan ‎menggunakan pendekatan perundang-undangan dan pendekatan konseptual. ‎Sebagai bentuk perlindungan hukum bagi masyarakat Muslim, sangat penting ‎bagi Negara untuk membuat landasan hukum mengenai sertifikasi halal dalam ‎berbagai peraturan perundang-undangan, namun dengan adanya Undang-Undang ‎Cipta Kerja, banyak landasan hukum yang dihilangkan, diubah atau diganti ‎sehingga menjadi lebih sistematis. Implementasi penerapan sertifikasi halal ‎berlaku self declare, dimana pelaku usaha khususnya kecil dan mikro dapat ‎mengajukan self declare sepanjang bahan baku dan proses pembuatan produk ‎tidak mengandung bahan dan proses yang tidak berisiko atau tidak halal.‎

Abstract

The purpose of this study is to determine the position of heirs from interfaith marriages in the analysis of the decision of the constitutional court number 71/PUU- XX/2022, Interfaith marriages often cause problems in terms of legal status and inheritance rights, especially in Indonesia which has cultural and religious diversity. This research uses a normative juridical approach with the aim of examining various legal phenomena through analysis of the relationship between legal norms and their impact. The data used as the basis for this research is secondary data, which consists of various sources such as books, scientific journals, and academic articles. The results of the research indicate. Based on Constitutional Court Decision No. 71/PUU-XX/2022, it confirms that interfaith marriages that are not valid according to religious law cannot be recognised by the state. The state asserts that the validity of a marriage depends on the provisions of religious law, not just administrative registration. Because the petition was formally rejected (because it did not fulfil the legal standing requirements), the Court did not assess the substance of the norm being tested, so there was no change to the legal position of interfaith marriages. The provisions of Constitutional Court Decision No. 71/PUU-XX/2022 have not provided adequate constitutional protection for heirs of interfaith marriages. The rejection of the petition on formal grounds resulted in no change to the norm in Article 2 paragraph (1) of the Marriage Law.

Abstract

The phenomenon of terrorism in Indonesia, particularly in the city of Medan, poses a serious challenge that threatens social stability, national security, and national values. In this context, the North Sumatra Terrorism Prevention Coordination Forum (FKPT) acts as an extension of the National Counterterrorism Agency (BNPT) in implementing prevention programs based on local wisdom and a humanistic approach. This study aims to gain a deeper understanding of the FKPT North Sumatra's strategies in countering terrorism in the city of Medan through an approach that is not only functional but also theological, by examining these efforts from the perspective of maqāṣid al- syarī‘ah. This research uses a qualitative method with field research (empirical). Data is obtained through observation, in-depth interviews, and documentation studies of FKPT programs and the involvement of stakeholders such as religious leaders, academics, and local communities. The results of the research show that FKPT implements an integrated strategy, including educational, cultural, collaborative, and digital approaches. These efforts are carried out through moderate religious literacy, the involvement of women and youth, and the dissemination of peaceful narratives on social media and in arts and culture. Thisstrategy is not only in line with state policy but also reflects the implementation of maqāṣid al-syarī‘ah in protecting religion, life, intellect, lineage, and property. Thus, the FKPT North Sumatra strategy demonstrates that terrorism prevention can be achieved not only through repressive approaches but also through strengthening religious and national values that prioritize the public good.

Abstract

This study aims to analyze the implementation of rehabilitation for drug abuse victims based on Law No. 35 of 2009 on Narcotics and the application of Sharia principles in the rehabilitation practices at Baitu Syifa Drug Rehabilitation Center, Medan. Drug abuse in Indonesia has become a critical issue with multi dimensional impacts on health, society, economy, and law. Hence, integrating positive legal measures with Islamic values offer sastrategic alternative for addressing drug-related problems humanely and effectively. Using a juridical-empirical approach and a descriptive qualitative method, this research collected data through in-depth interviews, field observation, and document analysis. The findings reveal that the rehabilitation program at Baitu Syifa complies with Articles 54 and 103 of Law No. 35/2009, emphasizing medical and social recovery for addicts and victims. Furthermore, the center incorporates Sharia principles, particularly hifzhal-nafs (protection oflife) and hifzhal-‘aql (protection of intellect), through spiritual activities such as congregational prayers, religious studies, remembrance (dhikr), and moral counseling. These efforts enhance the physical, psychological, and spiritual well-being of residents, supporting their reintegration into society. Nevertheless, the study identifies several challenges, including inadequate facilities, lack of specialized personnel, and social stigma against former addicts. Therefore, strong collaboration between government, religious institutions, and the community is essential to create a holistic and sustainable rehabilitation system. This research contributes to the academic discourse on law and Islamic studies by emphasizing the integration of legal and spiritual dimensions in promoting human welfare, moral integrity, and national resilience.

Abstract

This study, entitled “A Study on the Customary Prohibition of Cousin Marriage in the Alas Indigenous Community: Perspectives from Customary Law and Islamic Law,” aims to analyze the reasons behind the prohibition of cousin marriage in the Alas community, examine its compatibility with Islamic law, and explore its social implications within indigenous society. The research specifically investigates why marriages between paternal cousins (sepekhinding) and maternal cousins (pemekhenen) are prohibited, while marriages with the daughter of the father’s sister (mekhimpal) are encouraged under the customary concept of kawin mekhimpal. The study employs a qualitative field research method, with data collected from traditional elders and community leaders in Southeast Aceh through interviews and observation. Data were analyzed descriptively to interpret the relationship between customary norms and Islamic legal principles. The findings reveal that the prohibition of sepekhinding and pemekhenen marriages is rooted in the principle of preserving family honor, maintaining the integrity of the nuclear family, and preventing internal conflict within close kinship structures. Meanwhile, the encouragement of marriage with mekhimpal cousins symbolizes reciprocal relationships that strengthen social and familial cohesion in the extended family system. The results indicate that, based on the Qur’an, Hadith, and Islamic legal analogy (qiyās), the practice of cousin marriage itself is permissible in Islam. Therefore, the customary prohibition of marriage with certain cousins, such as sepekhinding and pemekhenen, is not aligned with Islamic law, which does not restrict marriage among cousins. The discussion highlights that the Alas customary system reflects a sociocultural adaptation aimed at maintaining harmony within the community, even though it differs from Islamic legal provisions. Hence, the study concludes that the customary practice has sociological and moral value but should be reinterpreted in light of Islamic jurisprudence to ensure alignment between religious law and local tradition.
