Abstract

Penelitian ini bertujuan untuk menganalisis hukum meninggalkan sholat jumat sebanyak 3 kali selama Covid-19 berdasarkan syariat Islam. Sebagaimana kita ketahui bersama pada awal wabah Covid-19 ditengah gegap gempitanya masyarakat Indonesia akan hal tersebut sehingga pemerintah memberlakukan berbagai regulasi untuk mencegah wabah tersebut mulai dari peniadaan sholat jumat, pembelajaran berbasis daring dan lain sebagainya. Penelitian ini menggunakan pendekatan kualitatif dengan jenis studi pustaka. Karena penelitian ini akan menganalisis secara kritis hukum meninggalkan sholat jumat. Hasil penelitian menunjukan bahwa meninggalkan sholat jumat selama pandemi Covid-19 terdapat 2 versi yaitu ada yang membolehkan karena kondisi darurat akan tetapi disisi lain ada yang mengatakan haram meninggalkan sholat jumat.

Abstract

On June 4 2020, the Indonesian Ulema Council (MUI) issued fatwa Number 31 of 2020 concerning "Organization of Friday and Congregational Prayers to Prevent the Transmission of the Covid-19 Outbreak. The fatwa then became the object of scientific study from various perspectives, including regarding prayers using masks and stretching the shaf when praying in congregation. However, no one has yet discussed the relevance and accuracy of the fiqh principles used in fatwas. In fact, the principles of fiqh are one of the normative dimensions of Islamic law which are directly related to practical situations. For this reason, the author feels the need to make aspects of fiqh principles in fatwa as study material - so that the discussion is carried out in a normative (doctrinal) way. After reviewing, the author concludes that the principles used in the fatwa are very relevant and accurate. Therefore, praying using a mask and stretching the shaf is a very appropriate fatwa, because this fulfills the elements of a syar'i intention, namely an endeavor to break the chain of the spread of the life-threatening Covid-19 pandemic

Abstract

This study aims to determine the method of the panel of judges of the Medan City Religious Court in taking law in mafqud inheritance cases, to find out the results of the decision of the panel of judges of the Medan City Religious Court in the case of mafqud inheritance, and to find out whether the decision of the panel of judges of the Medan City Religious Court in taking law in cases of mafqud inheritance is in accordance with the principles of justice and legal norms. This research method consists of several things: the type of research is empirical-juridical-normative, and the approach (approach) used is the statute approach, namely the decision approach of the Medan City Religious Court. Sources of data consist of observations, interview results, and results of documentation with Medan Religious Court Judges. The results of the research are as follows: The method of the panel of judges at the Medan City Religious Court in taking law in mafqud inheritance cases, which is almost the same as the methodology in other cases submitted to the Medan City Religious Court, is by following the formal legal rules and material law contained in the Code of Procedure Civil Code (KUHPerd.). The results of the decision of the panel of judges at the Medan City Religious Court in the mafqud inheritance case are that in four cases, three requests were granted, namely Determination Number 73/Pdt.P/2011/PA.Mdn., Determination Number 213/Pdt.P/2017/PA.Mdn., and Determination Number 68/Pdt.P/2018/PA.Mdn., while one case cannot be accepted, namely the lawsuit (contentious) in Decision Number 2317/Pdt.G/2017/PA.Mdn. The decision of the panel of judges at the Medan City Religious Court in taking law in the mafqud inheritance case was in accordance with the principles of justice and legal norms; in general, it fulfilled the principles of justice. On the other hand, there were decisions of the assembly that were inconsistent with the principle of equality before the law (equality before the law), as in cases of lawsuits that were not granted by the judge for reasons that were not strong in the author's analysis. The standardization of statements concerning a person's mafqud, including both heirs and heirs. In cases of application (volunteer), it seems that it is very easy to determine who is mafqud, whereas in lawsuits (contentious), the judge is very thorough and very strict in examining someone who is mafqud. Besides that, there is a disregard for the rights of the heirs of the heir's siblings who are mafqud, which is contradictory with the principles of Islamic inheritance law

Abstract

Hukum Islam adalah hukum yang berasal dari kaidah-kaidah ajaran islam. Secara historis dan sosiologis kehadiran dan pekembangan islam di Indonesia memiliki riwayat yang kompleks sehingga menimbulkan berbagai pendapat dari kalangan sarjana, namun sejarah membuktikan bahwa kerajaan-kerajaan islam di nusantara telah memberlakukan hukum islam sebagai instrumen yuridis dalam mengatur kehidupan masyarakat diwilayah kekuasaannya seperti kerajaan Samudra Pasai di abad 13 dan kerajaan-kerajaan di pulau jawa seperti kerajaan Demak, Jepara, Tuban, Ngampel serta Banten di abad ke 16. Selanjutnya dijaman kolonial karena keberadaan islam di Nusantara merupakan suatu kekuatan yang patut diperhitungkan maka pada tahun 1706, VOC memerintahkan DW Freijer menyusun Compendium Freijer yakni sebuah rujukan hukum guna mnyelesaikan sengketa dikalangan masyarakat islam yang berada dibawah kekuasaannya. Karenanya sejak di era kemerdekaan hingga kini di era reformasi, kaidah hukum islam senantiasa menjadi unsur pembentuk sistem hukum nasional dalam hal ini peraturan perundang-undangan seperti UU No 1 tahun 1974 tentang Perkawinan, UU No.41 tahun 2004 tentang Wakaf , UU No.21 tahun 2008 tentang Perbankan Syariah, UU No.5 tahun 1960 tentang Pokok-pokok Agraria serta lainnya.

Abstract

This study aims to explain the understanding of sharia and the impact of misunderstandings in understanding sharia in Indonesia. This study includes a qualitative study model with data collection techniques based on reference sources in the library and scientific references relevant to this title. Sharia is a basic legal norm that has been established by Allah which must be followed by Muslims based on faith related to morality, both related to their relationship with Allah and with fellow human beings. Sharia is actually the comprehensive teachings of the Islamic religion itself which contains provisions and rules of law and ethics which are all beneficial for the happiness of life in the world and the hereafter, but in practice the views of many people towards the term sharia are quite diverse and even some of them are quite implied if Leaving history to record at least three views that are misguided in understanding sharia so that it will keep Muslims away from where the true beauty of sharia freedom is: 1) The mistake of assuming that sharia is a variety of cutting hands and the like, 2) Assuming that sharia is only related to worship only 3) Shari'a sentences are only limited to symbols of the sacred and consider this to be quite noble.

Abstract

ABSTRAK Kesepakatan antara calon mempelai merupakan salah satu syarat pernikahan. Terdapat pernikahan di Kelurahan Mompang Jae yang tidak memenuhi standar tersebut, yaitu kawin paksa. Pernikahan ini merupakan sanksi bagi mereka yang telah melakukan khalwat/maksiat. Berdasarkan ketentuan peraturan adat setempat bagi mereka yang melakukan khalwat dan tertangkap basah oleh masyarakat akan diberikan sanksi sosial berupa denda atau diarak keliling kampung dan/atau sanksi menyelenggarakan perkawinan bagi pelaku khalwat/mesum. Hal ini bertentangan dengan hukum Islam, dimana salah satu prinsip perkawinan yaitu berdasarkan kesepakatan atau suka sama suka dan tidak terdapat unsur paksaan. Metodologi penelitian yang diterapkan adalah legal empiris. Data penelitian yang digunakan berasal dari data primer dan sekunder. Metode pengumpulan datanya yaitu melalui studi pustaka dan penelitian lapangan. Instrumen yang digunakan untuk pengumpulan data adalah pedoman wawancara. Penelitian ini bersifat deskriptif. Data yang diperoleh dievaluasi secara kualitatif. Sanksi bagi pelaku khalwat di Kelurahan Mompang Jae tetap menggunakan aturan turun-temurun yaitu dengan tradisi kawin paksa bagi pelakunya, denda (diyat), dan diarak keliling kampung. Hal ini dilarang oleh hukum Islam, dimana dalam islam tidak boleh melangsungkan perkawinan secara paksa, namun seharusnya menggunakan asas kerelaan dan keridhaan antar kedua belah pihak yang akan melaksanakan perkawinan

Abstract

Artikel jurnal ini merupakan studi literatur (literature review). Subjek pembahasannya adalah tingkat kesadaran hukum masyarakat muslim terhadap hukum kewarisan Islam di Indonesia. Alasan penelitian dilakukan, karena seringkali Islam tidak berbanding lurus dengan kehidupan masyarakat muslim, terutama soal kewarisan. Setelah menelaah bahan-bahan hukum, yaitu hasil penelitian hukum empiris dan menggunakan teori kesadaran hukum, tahun 2018-2023, di Indonesia, yang dipulikasikan pada laman jurnal yang berputasi (terakreditasi sinta); mengikuti alur dan berpedoman pada akurasi metodologis, dapat disimpulkan bahwa tingkat kesadaran hukum masyarakat muslim terhadap hukum kewarisan Islam di Indonesia berada pada ketegori rendah. Kurangnya pengetahuan hukum masyarakat muslim terhadap hukum kewarisan Islam, berakibat pada pemahaman hukum mereka yang tidak terbentuk (utuh). Pemahaman hukum yang tidak terbentuk, menjadikan sikap masyarakat muslim memilih untuk tidak menerapkan hukum kewarisan Islam. Alhasil, masyarakat muslim masih banyak tidak mempolakan diri dalam hukum kewarisan Islam, sehingga memilih alternatif hukum lain.

Abstract

Marriage is a worship that is highly recommended by religious teachings, which aims to continue the existence of the caliph generation on earth. The basis and references regarding marriage have been elaborated in various legal regulations, both fiqh and Indonesian legal regulations. The guardian in a marriage is one of the pillars that must exist in a marriage. This has been regulated by Islamic law including KHI. Even in the Marriage Law, the prerequisites regarding this matter have also been emphasized. Abstract

The MUI’s fatwa regarding zakat fitrah through qimah raises some dynamics and contradictions. The fatwa issued by the North Sumatra MUI in 2008, the Aceh MPU in 2014, and the DKI Jakarta MUI in 2018 have different decisions that give rise to contradictions at first glance. Through a literature study using the descriptive analytical method, this study aimed to unravel the dynamics of the fatwa of zakat al-fitr through bimah and analyze it based on the MUI fatwa stipulation guidelines. The results showed that the fatwa issued differed from the procedures for establishing a fatwa. In the MUI fatwa guidelines, it is stated that MUI and Regional MUI fatwa decisions, which are based on predetermined guidelines, have equal status and do not cancel each other, and if there are differences between MUI and Regional MUI fatwa decisions regarding the same issue, a meeting between the two leadership councils needs to be held to find the best solution. This study recommended that the Central MUI review the fatwa of zakat fitrah through bimah and guidelines for establishing fatwas.

Abstract

This research focuses on seeing how the integration between Islamic education and science, by looking at the case of pig eye cornea transplantation based on Al-Shatiby's perspective. Islamic education is important to adjust Islamic law as a guide for every Muslim to be a reference in carrying out all the activities of his life both his relationship with Allah and his relationship with fellow human beings even towards himself and other creatures. The development of medical technology today requires health experts to transplant / replace human eye corneas that experience blindness due to corneal abnormalities to be overcome while corneal donors derived from human eye corneas are very rare to obtain, one of which is due to the unwillingness of humans to become corneal donors, so doctors replace human eye corneas that experience corneal blindness with corneas derived from pigs that have been genetically engineered.  Islamic law comes from the Quran and the Sunnah of the Prophet, but if no clear text is found in a problem faced by humans, the scholars make ijtihad to determine the law through Ijmak and Qiyas. With the development of technology today, not all problems can be answered from existing sources and arguments of Islamic law, so other legal arguments are needed, such as Maslahah Mursalah. This also requires Islamic education in the medical field, so that patients and families understand the problems that exist, and understand the medical process. The integration of Islamic education in science, especially in the context of medical science can encourage the determination of Islamic law on pig corneal transplants as a substitute for human corneas, especially by using the Maslahah Mursalah Theory approach from Imam Al-Shatiby.
