Abstract

The use of products on goods and services by customer potentially creates conflicts due to material lost suffered by the customers as the result of using particular products. The Acts Number 8 Year 1999 of Customers Protection provides customer with a right to work out any conflicts by consulting a costumer’s conflict resolution board (BPSK). The resolution of the conflicts is achieved through such processes as mediations, conciliations and arbitration which involve three elements: government, businessmen, and customers. All verdicts made by BPSK in the form of mediation and are final and legal. However, the arbitration ones are possible to be proceeded to the trials.Kata kunci: sengketa, konsumen, BPSK

Abstract

Mediation in the settlement of consumer disputes at BPSK Bukittinggi Year 2014-2017 run effectively. 18 of the 33 cases registered inthe Bukittinggi BPSKfrom 2014 to July 2017 were settled by means of mediation, with the remaining 15 cases settled by arbitration. The effectiveness of such mediation is supported by Law no. 8 in 1999 and Kemendag no. 350 / MPP / Kep / 12/2001 which despite the perceived many weaknesses and need improvement, but with the presence of 9 members of the Bukittinggi BPSK assembly which majority of law educated and 3 of them are certified mediators and the existence of adequate facilities can be a counterweight and reinforcement mediation process as well as driving the legal culture of the parties to the dispute.

Abstract

Abstrak: Penelitian ini berdasarkan  kisah Nabi Adam As yang berbagai fragmennya tersebar diberbagai surah dan ayat, menurut Ibn Katsir dalam Tafsir al-Qur`anul Adzim.Tujuan dari pembahasan ini adalah mengetahui sekaligus menyusun kronologis narasi kisah Nabi Adam As dari proses awal penciptaannya hingga ia keluar dari surga.  Jenis penelitian yang digunakan adalah penelitian kepustakaan.  Untuk pengelolaan data penafsiran oleh Ibn Katsir digunakan pendekatan studi tokoh, konten analisis dan ilmu tafsir.Dari kajian terhadap tafsir Ibn Katsir, kronologis kisah Nabi Adam As terbagi tiga, yaitu pertama, penciptaan Nabi Adam : ini diawali dari zat yang disebut ???? dan ??? serta ???? ????? hingga menjadi ???????? ????????????. Setelah itu ditiupkan roh, pada proses inilah malaikat diperintah sujud kepada Adam As namun iblis enggan untuk bersujud. Kedua kisah Adam As tinggal di surga dengan segala fasilitasnya. Pada kejadian ini istri Adam As (Hawa) diciptakan oleh Allah. Ketiga, kisah Adam As dan istrinya dilarang mendekati pohon kuldi, yang kemudian aturan tersebut dilanggar oleh Adam As dan istrinya yang mengakibatkan Adam As dan istrinya dikeluarkan dari surga. Menurut Ibn Katsir keluarnya Adam As dari surga ini dalam dua tahap pertama tahap turun ke langit dunia dan kedua tahap turun ke bumi.

Abstract

Corruption as an extraordinary crime is treated extraordinarily in Indonesia. The state’s treatment of corruption is part of the legal policies of the country. Indonesia is an anti-corruption country, but the corruption index is relatively high. The presence of the Corruption Eradication Commission (KPK) seems more repressive as a representation of the current Indonesian criminal law politics. But prevention efforts have received little attention. Why have Indonesian criminal law policies not been oriented to the prevention of corruption? Ideally, efforts to prevent corruption in Indonesia use criminal law policies that are based on religious and moral values. Correlatively according to Islamic law, siyāsah syar’iyyah (Islamic legal policy) will have a positive effect on corruption prevention. Institutionalizing siyāsah syar’iyyah for prevention of corruption in Indonesia is relevant to the sociological conditions of religious communities. Is it preventing better than giving punishment? Emergency in dealing with corruption is the same as an emergency in dealing with morality. siyāsah syar’iyyah is used as a way of dealing with moral emergencies. Indonesian criminal law policy that is based on siyāsah syar’iyyah is the main solution in efforts to prevent corruption.

Abstract

Review of Islamic Law Regarding the Setting of the Selling and Buying Prices of Agricultural Products at the Nagari Campago Market in District V Koto Kampung Dalam, Padang Pariaman Regency, is the topic of this thesis. The writers of this publication combine library research with a form of outdoor research. where information is gathered via documentation, interviews, and observation. Permanent traders and migrant traders (urang darek) serve as the study's main sources of information. Based on the study's findings, it can be concluded that price fixing mechanism is carried out by permanent traders in Nagari Campago, namely by seeking information regarding prices that are based on other markets, besides that regular traders are also based on the previous market price. Not only that, in addition to being based on market prices on the previous Sunday, traders still apply prices from migrant traders, in the sense that traders still take goods from migrant traders A, but traders still ask the selling price of goods to newcomer traders B. Muamalah Fiqh's view regarding the determination of buying and selling prices for agricultural products that occurs at the Nagari Campago Market, V Koto Kampung Dalam District has become an Urf which means something that is no longer foreign to a community because it has become a habit and is integrated into their lives in the form of actions and words.

Abstract

Studi ini mendeskripsikan aktifitas perdagangan di Pasar Bawah Bukittinggi.Studi ini juga meninjau aktifitas perdagangan tersebut dengan kacamata Fikih Mu’amalah (Hukum Ekonomi Islam). Pertanyaannya adalah apakah perilaku yang dilakukan oleh pedagang sejalan dengan Hukum Islam atau tidak ? Pertanyaan ini penting untuk dijawab mengingat mayoritas para pedagang di Pasar Bawah adalah muslim. Di sisi lain Nabi Muhammad Saw menyatakan bahwa pasar adalah seburuk-buruk tempat dan mesjid sebaikbaik tempat. Seakan-akan pernyataan ini memberi peluang bagi pelaku pasar untuk melakukan perbuatan menyimpang atau melanggar hukum. Studi inimenemukan bahwa perdagangan di Pasar Bawah Bukittinggi berlangsung secara intens dengan pola perdagangan tradisonal. Dalam aktivitas perdagangan tersebut ditemukan banyak penyimpangan yang dapat dikelompokkan: 1. terkait dengan komoditi yang diperdagangkan, 2. bentuk transaksi yang dilakukan, 3. pelanggaran terhadap regulasi, 4. pengabaian terhadap etika bisnis yang sudah diatur dalam Islam.

Abstract

The enactment of Small claims court mechanism that marked with the enactment of PERMA Number. 2 Year 2015 concerning Procedure for Simple Quarrel Settlement is a new breakthrough in the civil justice system in Indonesia. This breakthrough was reached by the Supreme Court in order to reduce the queues for settling of civil Quarrel in court that the value is under $ 200 million. Implementation of Quarrel resolution by Small claim court mechanisms is done by a single judge assisted by a Registrar and can be completed within 25 working days and the decision is final and binding so that it is unable filed an appeal or judicial review to the Supreme Court, the decision of which can be directly execute in accordance with the civil judicial mechanisms in general. Small claims court jurisdiction which is set in PERMA No. 2 2015 is the General Courts, considering the Religious Courts are also authorized to settle a civil case with the Shari'ah economic and legal mechanisms of the same event with the civil court of the General Courts, the judicial application of the Small claims court mechanism in Religion Court is also possible and prospective,so that regulatory support as well as PERMA No. 2 of 2015 applied to the Religious Courts is required, especially in the process of sharia economic quarrel resolution.

Abstract

The main problem in this paper is how the effectiveness of mediation in sharia economic dispute resolution based on PERMA No. 1 of 2016 at the Bukittinggi Religious Court, and what are the inhibiting factors success of mediation. To answer this question, the author uses an inductive and deductive analysis framework regarding the law effectiveness theory of Lawrence M. Friedman. This paper finds that mediation in sharia economic dispute resolution at the Bukittinggi Religious Court from 2016 to 2019 has not been effective. The ineffectiveness is caused by several factors that influence it: First, in terms of legal substance, PERMA No.1 of 2016 concerning Mediation Procedures in Courts still lacks in addressing the problems of the growing community. Second, in terms of legal structure, there are no judges who have mediator certificates. Third, the legal facilities and infrastructure at the Bukittinggi Religious Court have supported mediation. Fourth, in terms of legal culture, there are still many people who are not aware of the law and do not understand mediation well, so they consider mediation to be unimportant. Tulisan ini mengkaji tentang bagaimana efektivitas mediasi dalam penyelesaian sengketa ekonomi syariah berdasarkan PERMA Nomor 1 Tahun 2016 di Pengadilan Agama Bukittinggi dan apa saja yang menjadi faktor penghambat keberhasilan mediasi. Untuk menjawab pertanyaan tersebut, penulis menggunakan kerangka analisa induktif dan deduktif dengan mengacu pada teori efektivitas hukum Lawrence M. Friedman. Tulisan ini menemukan bahwa mediasi dalam penyelesaian sengketa ekonomi syariah di Pengadilan Agama Bukittinggi dari tahun 2016 sampai 2019 belum efektif. Hal ini karena dipengaruhi oleh beberapa faktor.  Pertama, dari segi substansi hukum, yaitu PERMA No. 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan masih memiliki kekurangan dalam menjawab persoalan masyarakat yang terus berkembang. Kedua, dari segi struktur hukum, belum adanya hakim yang memiliki sertifikat mediator. Ketiga, sarana dan prasarana hukum di Pengadilan Agama Bukittinggi sudah mendukung mediasi. Keempat, dari segi budaya hukum, masih banyaknya masyarakat yang tidak sadar hukum dan tidak mengerti persoalan mediasi dengan baik, sehingga menganggap mediasi tidak penting.

Abstract

The increasing prevalence of negative campaigns during the 2024 presidential and legislative elections on social media platforms, such as TikTok, Instagram, and Facebook, has raised concerns regarding their impact on democratic ethics and societal harmony. From the perspective of Islamic constitutional law, these campaigns are considered detrimental, aligning with the concept of ghibah and slander, which are prohibited in Islam. This study employs a descriptive-analytical approach based on library research to differentiate between negative and black campaigns. Negative campaigns use verifiable data to highlight opponents' shortcomings, while black campaigns involve unfounded accusations and slander aimed at character assassination. The research identifies key patterns in the dissemination of these campaigns: targeting young and active social media users, repetitively spreading negative content, and exploiting pseudo-legitimacy through manipulated media. The analysis highlights the inefficacy of Indonesia's Law No. 7 of 2017 in addressing these digital challenges. The findings emphasize that while negative campaigns may rely on factual data, their intent to discredit opponent conflicts with ethical and moral principles, potentially fostering division and distrust. In contrast, Islamic teachings advocate campaigns centered on virtues and constructive dialogue. This study calls for strengthened regulatory measures and public awareness to counteract the adverse effects of unethical campaign practices, ensuring the preservation of democratic integrity and societal unity.
