Abstract

Russia's participation in the internal affairs of Ukraine is something that should not be done. Because, it can violate the provisions of the United Nations Charter. Currently the security of countries is something that should be guarded. The behavior of the Russian state in violation of the principle of non-intervention by interfering in the independence of Donetsk and Luhansk which is part of the Ukrainian state. Russia's behavior has disturbed the Ukrainian household, which is actually what is happening in Ukraine is Ukrainian business because Ukraine is the one who knows better about the problems in his country. The purpose of this paper is to find out the violations of the principle of non-intervention that have been carried out by Russia against Ukraine and the responsibility of the Russian state for violations of the principle of non-intervention in the conflicts that occur within the Russian state. This writing uses normative legal methods or legal research which is a document study, such as by using laws and regulations, decisions or decisions from courts, contracts or agreements or contracts, legal theory.

Abstract

Penelitian ini untuk mendapatkan implementasi perlindungan hukum yang bertujuan terhadap kesejahteraan perlinudngan pekerja dalam Perjanjian Kerja Waktu Tertentu (PKWT) dan Pekerja Waktu Tidak Tertentu (PKWTT) sesuai dalam ketentuan Undang-undang No.11 tahun 2020 tentang Cipta Kerja. Menggunakan pendekatan secara yuridis normatif. Sehingga para pekerja bisa aman berlindung dengan adanya uu cipta kerja, ketika terdapat kekurangan hak pekerja yang menimbulkan jauh dari kata kesejahteraan bagi mereka maka disitulah peranan dari pada uu cipta kerja tersebut perlu di implementasikan agar para pekerja mendapat kepastian hukum. Jika lebih teliti lagi perlindungan terhadap pekerja/buruh Perjanjian Kerja Waktu Tertentu (PKWT) dalam pelaksanaannya masih belum sesuai yang di harapkan untuk tercapai secara optimal, mengingat masih sering terjadi pelanggaran, dikarenakan oleh ketidak jelasan aturan tentang penerapanPerjanjian Kerja Waktu Tertentu, khususnya berkenaan dengan pekerjaan tertentu yang menurut jenis dan sifat atau pekerjaannya akan selesai dalam waktu tertentu, yaitu pekerjaan yang sekali selesai atau yang sementara sifatnya, pekerjaan yang diperkirakan penyelesaiannya dalam waktu yang tidak terlalu lama dan paling lama 3 (tiga) tahun, pekerjaan yang bersifat musiman atau pekerjaan yang berhubungan dengan produk baru, kegiatan baru, atau produk tambahan yang masih dalam percobaan. Selain itu kurangnya pengawasan dari pemerintah dalam proses pembuatan Perjanjian Kerja Waktu tertentu, sehingga membuat pihak pengusaha dengan mudah bisa saya melanggar peraturan yang ada tanpa menerima suatu sanksi hukum. Maka pekerja perlu di lindungi dengan harus adanya kepastian hukum yang kuat dalam lingkungan ketenagakerjaan, maski sangat sulit tercapai namun jangan samapi hal itu di abaikan oleh pemerintah, karna pekerja merupakan salah satu sumber daya manusia yang dapat melancarkan pembangunan yang lebih maju.

Abstract

Efforts to create a safe haven for workers are through copyright laws. When workers' rights are running low, causing them to be far from welfare, it is necessary to play the role of copyright law, so that workers can obtain legal certainty. The purpose of this study is to obtain the implementation of legal protection aimed at the welfare of the protection of workers in a Specific Time Work Agreement (PKWT) and an Indefinite Time Worker (PKWTT) in accordance with the provisions of Law No. 11 of 2020 concerning Job Creation. Using a normative juridical approach. The results of this study indicate that in view of the frequent occurrence of violations due to unclear rules for the application of a certain time work agreement, a certain time work agreement (PKWT) has not yet achieved the desired optimal effect in its implementation. In addition, the lack of government supervision in the process of drafting work agreements with deadlines makes it easy for entrepreneurs to violate existing regulations without being subject to legal sanctions. In conclusion, the regulation regarding the Work Agreement for Certain Time and Work for Uncertain Time which is a working relationship in which the arrangement is an attempt to achieve prosperity, then the law plays a role in providing protection, security, peace and order in the association of human life.

Abstract

Mining is an activity that is one of the biggest sources of regional income, but on the other hand mining activities often cause bad symptoms in the community. The existence of excavation c which causes environmental damage and loss to the surrounding community is a problem that never subsides for discussion. This study aims to identify and describe IUP Excavation C and its Impact on Community Development. This study uses a descriptive qualitative approach. The concept of legislation and spatial planning that has not been ideally actualized has resulted in this phenomenon not being handled properly, especially in the Cirebon and surrounding areas, even though there is already a legal basis and concept of environmental management but it seems as if it already exists. not yet realized.

Abstract

The abstract addresses the low awareness of environmental conservation in Indonesia, as showed by the Environmental Performance Index 2022 (EPI) report. Based on Undang-undang Number 6 Year 2023, this study seeks to investigate the use of law enforcement in environmental elements. The research method involves a literature study approach and a normative juridical approach. The results and discussion highlight the regulations and articles in Undang-undang Number 6 Year 2023 related to environmental law enforcement, including law enforcement authorities, administrative and criminal sanctions, and dispute resolution mechanisms. The implementation of good law enforcement can positively affect environmental protection and preservation. However, improper implementation may lead to negative consequences, such as the criminalization of people living near protected environmental areas. The study emphasizes the role of law enforcement agencies in the implementation of Undang-undang Number 6 Year 2023 and the control and prevention of environmental damage through licensing mechanisms. It also stresses the importance of protecting people's rights in a healthy and sustainable environment. The conclusion emphasizes the need for increased awareness, commitment, and effective environmental law enforcement mechanisms to address environmental problems and prioritize sustainable development in Indonesia.

Abstract

Crucial issues related to the protection and supervision of Indonesian migrant workers (PMI) working abroad. In the context of the Indonesian economy, PMI has an important role in generating economic contributions to the country and providing economic benefits for their families in Indonesia. Constitutional foundations, such as Article 27 paragraph (2) and Article 28D paragraph (2) of the 1945 Constitution, as well as the Indonesian Migrant Manpower Law No. 18 of 2017, have provided a clear legal framework on the obligations of local governments in regulating, fostering, implementing, and protecting the rights of migrant workers. However, there are still obstacles and violations that often occur in sending workers abroad, such as unsettled wage payments and contract problems. This study aims to analyze local government supervision of labor supply companies in Cirebon Regency and identify common violations in sending workers abroad along with the necessary solutions. The research findings highlight the importance of increased supervision, stricter law enforcement, and cross-border collaboration to protect and improve migrant workers' working conditions, and make it the basis for recommending further measures for the welfare of Indonesian migrant workers.

Abstract

Legal certainty is one of the objectives of law according to Gustav Radburch, with the development of the times, and the rise of digitalization, it is necessary to have a legal umbrella as a form of preventive effort so that there are no legal problems such as misuse of personal data in the labor scope. This legal research method uses normative juridical legal methods using qualitative data based on consideration of the purpose of this research itself to determine the importance of legal certainty and protection of personal data in the context of labor in the era of technology, and information that has developed rapidly. The clarity of legal norms guides community behavior, including the protection of personal data. The impact of technological advances is especially evident in changes in community behavior and information seeking through the internet. This change creates new challenges, especially related to the misuse of personal data in the world of work. Legal protection for personal data in the world of work in the era of digitalization of technology and information is very important. It has positive implications for companies, employees, and society as a whole. By implementing good personal data protection, all parties can benefit from the opportunities offered by digital technology while maintaining the privacy and security of personal data.

Abstract

Urban society is a complex and dynamic society, with various social identities that are formed and developed. In the midst of this complexity, law plays an important role in shaping and influencing the social identity of individuals and groups in urban society. This research aims to analyze the role of law in the formation of social identity in urban communities. This research uses a non-doctrinal research method. The data collection technique in this research is a literature study. The data that has been collected is then analyzed in three stages, namely data reduction, data presentation and conclusion drawing. The results showed that law has a complex and multidimensional role in the formation of social identity in urban communities. Law can act as a framework that regulates social interaction and maintains public order. Effective law enforcement contributes to creating a sense of justice and equality among urban citizens. It strengthens the social identity of individuals and groups by providing them with a sense of security and protection under the umbrella of the law. In addition, the law also influences the way individuals and groups interact with each other, shaping social norms that become an integral part of the social identity of urban communities.

Abstract

This study explores the dynamics of gender law that affect legal protection for women in Indonesia, especially in Cirebon City. Using a qualitative approach, data is analyzed from a variety of sources, including laws, policies, and legal practices. The results highlight challenges such as gender-based violence, discrimination, and limited access to health and education services. The proposed policy implications include harmonization of legislation, strengthening the role of the government and civil society, increasing gender awareness, and better legal protection for women.
