Abstract

Tindak pidana pencabulan merupakan salah satu bentuk kekerasan seksual yang marak terjadi di Indonesia, pada kasus pencabulan yang menjadi korban adalah wanita yang berada dibawah umur. Dalam terjadinya tindak pidana pencabulan penyebabnya tidak mesti berasal dari pelaku, karena dalam sudut pandang viktimologi faktor penyebab terjadinya suatu tindak pidana bisa juga berasal dari diri korban. Adanya keterlibatan korban dalam terjadinya suatu tindak pidana dapat disebabkan oleh beberapa hal yaitu kealpaan, ketidaktahuan, kurang hati-hati, kelemahan atau mungkin kesalahan korban. Penelitian ini bertujuan untuk mengetahui Peran korban dalam terjadinya suatu tindak pidana pencabulan apabila ditinjau dari aspek viktimologi dan mengetahui peran hakim dalam memutus perkara tindak pidana pencabulan ditinjau dari aspek viktimologi. Keterlibatan korban inilah yang menjadi salah satu faktor yang akan dijadikan bahan pertimbangan bagi hakim dalam memutus perkara. Oleh karenanya peran korban di sini cukup menentukan dalam suatu putusan. Dalam melakukan penelitian tentang peran korban dalam terjadinya tindak pidana pencabulan penulis menggunakan metode preskriptif analitis yaitu mempelajari tujuan hukum, nilai-nilai keadilan, validitas aturan hukum, konsep-konsep hukum, dan norma-norma hukum. Data tersebut diperoleh melalui dokumen-dokumen dan juga melalui proses wawancara dengan aparat penegak hukum yang dalam hal ini adalah hakim. Hasil penelitian yang dilakukan adalah dapat diketahuinya faktor-faktor yang berasal dari dalam diri korban sehingga menyebabkan terjadinya tindak pidana pencabulan. Kemudian dapat diketahui juga peran korban dalam perspektif tipologi. Dalam penelitian ini penulis juga mendapa informasi tentang hal-hal yang meringankan dan memberatkan tersangka dalam proses peradilan. Hal-hal yang meringankan dan memberatkan tersebut dijadikan hakim sebagai salah satu bahan pertimbangan dalam memutus perkara pencabulan. Selain hal yang meringankan dan memberatkan hakim juga memperhatikan hasil dari Visum Et Repertum (VER). Dan yang terpenting adalah dalam memutus perkara putusan hakim mengandung nilai kepastian hukum, kemanfaatan, dan keadilan.

Abstract

Desa Sitiwinangun Kecamatan Jamblang Kabupaten Cirebon merupakan salah satu desa yang memiliki potensi produk local ginuine yaitu gerabah yang sangat potensial untuk dikembangkan. Namum kondisi saat ini pasar kerajinan gerabah di Sitiwinangun masih perlu sentuhan akademisi agar potensi yang ada dapat kebangkan menjadi Desa Wisata Gerabah Sitiwinangun. Karena hal ini sangat menguntungkan bagi penjual yang mayoritas merupakan penduduk Desa Sitiwiangun itu sendiri maupun menambah pemasukan devisa negara. Pengembangan kawasan juga dimanfaatkan sebagai salah satu cara meningkatkan geliat perekonomian serta meningkatkan kualitas masyarakat setempat dengan memperhatikan kualitas lingkungan. Permasalahan yang timbul pada proyek pengembangan kawasan kerajinan gerabah Sitiwinangunadalah bagaimana menawarkan kenyamanan pengelolaan sirkulasi dan memunculkan aktifitas pendukung kegiatan perdagangan yang berupa; teknologi yang dipakai, rest area, restoran, sarana ibadah dan area parkir yang memadai seluruh pengunjung area kawasan kerajinan. Metode pendampiangan UKM gerabah melalui workshop dan penggunaan teknologi tepat guna dapat meningkatkan kreativitas dan inovasi bagi pengrajin gderabah di Sitiwiangun, sehingga diharapkan produknya dapat memiliki daya saing yang baik, yang pada akhirnya dapat memberikan dampak bagi kesejahteraan UKM itu sendiri.

Abstract

The drug problem in Indonesia is still something urgent and complex. In the past decade, this problem has become rife, as evidenced by the increase in the number of abuses and trafficking, to drug smuggling significantly, even spreading into prisons. The purpose of this study is to identify modes of smuggling, analyze the role and involvement of relevant parties, assess causal and driving factors, evaluate the effectiveness of surveillance and control systems. The method used in this research is empirical juridical by conducting direct research to the Cirebon Class I Penitentiary and also using the Deductive thinking method. Drug smuggling occurred at the Class I Cirebon Penitentiary, which was in the mode of visitors smuggling prohibited items into the Class I Cirebon Penitentiary, West Java, which was thwarted by officers of the Cirebon Class I Penitentiary. The items were 1 plastic meth clip and 150 grains of Alphrazolam type sedative into the Penitentiary. His modus operandi, the drug was hidden by a visitor inside his restricted area. The strategies carried out by correctional officers for the prevention of drug smuggling are physical security strategies and technological security strategies, as well as internal and external factors supervised by correctional officers. Over time, there have been many new modes of drug smuggling into prisons, so authorities continue to develop strategies to prevent drug smuggling by increasing security inside prisons and monitoring emerging modes of smuggling.

Abstract

This study aims to control water pollution by conducting observations on the hotel industry in Cirebon City regarding the implementation of compliance with the standardization of wastewater quality standard parameters according to Ministerial Regulation No. P 68 of 2016. Research methods were conducted openly through interview techniques regarding monitoring and management of wastewater produced by the Hospitality Industry in Cirebon City. The results of the study identified that from the hotel industry in the city of Cirebon which is the object of research, the quality standard of wastewater produced exceeds the standardization of meeting quality standards so that there is still a risk of water pollution. The handling can be this problem by conducting strict monitoring by the environmental service and providing knowledge or information related to the management of wastewater quality standards properly so that the content of the waste produced does not endanger the flow of rivers and seas in the city of Cirebon. The approach that must be taken in order to understand and be able to maximize the treatment of liquid waste with a wastewater management plant (IPAL) is to consult the Environmental Service in order to get direction to cooperate with third parties (outsourcing). Observations also state that there is still one hotel that does not use IPAL and in the hotel's activities, the waste is purely dirty and pollutes the river flow in Cirebon City.

Abstract

Plastic waste is still a problem that is difficult to solve due to the lack of awareness about the importance of keeping the environment clean and not leaving litter lying around. Usually, waste generation is generated by economic activities and has the potential to cause environmental pollution. In Cirebon City itself, plastic waste is still an unresolved problem. With the increase in population, there will be an increase in the volume of waste generated by human activities. The problem is how the Cirebon city local government policy related to handling plastic waste generated by street food business actors, this is intended to examine the regulations that have been implemented and run in the city of Cirebon, with an empirical juridical research approach and qualitative data included. This study aims to determine the procedure for handling plastic waste and the elements that influence plastic waste management in the city of Cirebon. Also to find out what anticipatory steps need to be taken in the future.

Abstract

Insurance for human life is very important, by requiring a sense of comfort and safety. So that many companies have established their business in the field of insurance, behind insurance companies that provide security protection. Not all companies run smoothly in other words the company is inseparable from the threat of bankruptcy. This research focuses on legal certainty for customers when an insurance company with claim obligations is declared bankrupt. The research problem addresses the challenges faced by customers in such situations and the legal protection available to them. The purpose of this research is to find out the responsibility of insurance companies that are declared bankrupt in fulfilling customer claims and to find out the legal certainty for customers in cases when insurance companies that have claims obligations are declared bankrupt. The methodology used is normative juridical, by analyzing the law based on literature study, articles in the Civil Code, Law Number 21 of 2011 concerning OJK, Law Number 37 of 2004 concerning Bankruptcy and postponement of debt payment obligations, and Insurance Law. The results discuss the importance of legal protection provided by the Financial Services Authority and the Deposit Insurance Corporation for insurance customers in bankruptcy cases. The findings underscore the need for compliance with certain legal provisions to ensure customer protection, especially in cases involving insolvent insurance companies. The implications of this study emphasize the importance of legal certainty and the role of regulatory bodies in protecting customer rights in the insurance sector.

Abstract

Malpractice is an error of medical personnel in carrying out their profession that is not in accordance with professional standards and standard operating procedures, resulting in the patient receiving serious injuries, disabilities, and even death. This study aims to analyze the factors that cause the alleged malpractice of midwives in assisting childbirth and the settlement of cases of alleged malpractice with penal mediation. In this study, the method used is a normative juridical approach that involves analyzing the applicable laws related to malpractice cases by midwives as well as reviewing recent cases, with the use of secondary data collection techniques focused on literature review. The results of this study conclude that the main factor in the occurrence of malpractice in midwives is the existence of errors in the form of both negligence and culpa caused by carelessness. The settlement of alleged malpractice cases with penal mediation is a settlement of cases outside the court by bringing together the parties involved, one of the alternative solutions is Penal Mediation. These findings can provide a deeper understanding of the application of responsibility in the context of alleged malpractice by midwives and can contribute to the improvement of legal norms that are more effective in dealing with these problems. The implications of the results of this study are expected to serve as a guide for the authorities, legal practitioners, and the public in facing and understanding the challenges associated with alleged malpractice cases involving midwives.

Abstract

This law has a significant impact on various aspects of people's lives, including the economy, labor, and the environment. This study aims to analyze the Omnibus Law on Job Creation from an Islamic perspective with a focus on aspects of social justice, protection of workers' rights, and environmental impacts. However, the problems are (1) How is the Islamic perspective on social justice regulated in the Omnibus Law on Job Creation Law? (2) How is the protection of workers' rights in the Omnibus Law on Job Creation Law seen from an Islamic perspective? (3) How is the environmental impact of the implementation of the Omnibus Law on Job Creation Law from an Islamic perspective?. This research uses a normative juridical method with a qualitative approach as well as conceptual and statutory regulations (normative-juridical). By analyzing legal documents, and Islamic literature, related to the Omnibus Law on Job Creation Law. This approach will help in understanding aspects of social justice, protection of workers' rights, and environmental impacts associated with the law. The results show that, although the Omnibus Law on Job Creation is designed for the public good with the aim of promoting economic growth and job creation, there are discrepancies with the principles of Islamic Law, particularly in terms of social justice, welfare, and protection of workers' rights. Some of the rules in this law tend to favor employers, which can be detrimental to workers and society, and contradict the concept of justice in Islam. In addition, the negative impact on the environment that may arise from the implementation of this law is also not in line with Islamic principles that emphasize the importance of preserving nature and the balance of the ecosystem.
