Abstract

Urban society is a complex and dynamic society, with various social identities that are formed and developed. In the midst of this complexity, law plays an important role in shaping and influencing the social identity of individuals and groups in urban society. This research aims to analyze the role of law in the formation of social identity in urban communities. This research uses a non-doctrinal research method. The data collection technique in this research is a literature study. The data that has been collected is then analyzed in three stages, namely data reduction, data presentation and conclusion drawing. The results showed that law has a complex and multidimensional role in the formation of social identity in urban communities. Law can act as a framework that regulates social interaction and maintains public order. Effective law enforcement contributes to creating a sense of justice and equality among urban citizens. It strengthens the social identity of individuals and groups by providing them with a sense of security and protection under the umbrella of the law. In addition, the law also influences the way individuals and groups interact with each other, shaping social norms that become an integral part of the social identity of urban communities.

Abstract

This study explores the dynamics of gender law that affect legal protection for women in Indonesia, especially in Cirebon City. Using a qualitative approach, data is analyzed from a variety of sources, including laws, policies, and legal practices. The results highlight challenges such as gender-based violence, discrimination, and limited access to health and education services. The proposed policy implications include harmonization of legislation, strengthening the role of the government and civil society, increasing gender awareness, and better legal protection for women.

Abstract

Intellectual property rights are a system of modern life that is interconnected with the system that exists today. Intellectual property rights are a by-product of human ideas and thought patterns, so they are currently one of the complex problems that arise in the world of commerce. The aim of this research is to analyze the sociology of law in the circulation of trademarks in Indonesia. Analytical descriptive methods are used in research specifications to describe facts and realities relating to trademark law in Indonesia. The research results show that, within the framework of the rule of law, respect for trademark rights is a national honor given to individuals who have taken the time to consider developing original and distinctive works of intellectual property. Legal sociology has a role in violations that occur in trademark cases; apart from filing criminal and civil charges for failure to reach a resolution, there are other options to overcome existing problems. All parties must comply with certain requirements so that the conflict resolution process can be effective. Having a certificate is one of the components of feeling more comfortable running a business in the future. It is easier for trademark owners to demonstrate ownership rights to the trademarks they use, so they don't need to worry about their company if a lawsuit occurs. Based on the results of the analysis carried out, society, namely the private sector, must support intellectual property, including trademarks, by upholding corporate ethics that demand integrity in all business dealings. Strong business growth in terms of market share and product quality is a catalyst for economic expansion, raising living standards, and achieving economic development.

Abstract

This research focuses on exploring the extent to which the application/implementation of Permendag No. 31 of 2023 concerning Business Licensing, Advertising, Development, and Supervision of Business Actors in Trading Through Electronic Systems towards the Merger of Social Commerce TikTok Shop with E-commerce Tokopedia and how it impacts MSME actors which includes protection and an increase in their business turnover. This study aims to determine how the Implementation of Permendag No. 31 of 2023 is towards the merger of TikTok Shop with Tokopedia and to find out the impact on MSME players both in terms of Legal Protection and turnover income. In answering the problems in this study, we use a legal research method, namely Normative Juridical, where we focus on legal studies of Permendag No. 31 of 2023. The author examines the extent to which the implementation of the presence of the Permendag for MSME actors and the merger of TikTok Shop with Tokopedia. So in the end, we find the conclusion that the presence of this Permendag has fulfilled the need to protect business actors who carry out their activities through PMSE and the merger between TikTok Shop and Tokopedia which then merged into Shop Tokopedia which is currently managed under Tokopedia is by the contents of Permendag Number 31 of 2023, namely social commerce is not allowed to provide transaction services in it. Social media only functions as a social media service.

Abstract

All aspects of community life, whether political, social, cultural, or economic, are regulated by law. Therefore, the existence of this law is universal. Development and reform give rise to social changes that give rise to social problems, which puts pressure on the law because the law must be able to overcome these problems. The aim of this research is to analyze social changes in the development of law in Indonesia. This research uses a statutory approach, also called a statutory approach. The results of this research show that law and social change have a close interaction in the context of social change. Both have an impact on each other. Changes in law are influenced by changes in society, and vice versa. Social transformation in society is influenced by legal changes as well. Based on the analysis that has been carried out, social changes in the development of law in Indonesia are: 1) Law Number 11 of 2008 was born, which regulates electronic information and transactions. Law plays two important roles in social change: law as a tool of social control and a technique of social engineering; 2) institutions have an important role in society; the existence of Rukun Warga (RW) and Rukun Tetangga (RT) officials as well as Village Government institutions is also crucial. The role of the village government and RT-RW can be utilized to empower the community effectively in carrying out prevention. 3) Providing legal understanding refers to awareness of the rules established by written law for behavior, namely what the community can and cannot do.

Abstract

The principle of good faith is a fundamental basis for establishing contractual relationships, including trade contracts in Indonesia. The application of this principle is important to create a conducive, fair and transparent business climate. The purpose of this study is to examine the application of the principle of good faith in trade contracts in Indonesia. This research uses qualitative research methods by collecting data using literature review techniques. then after the data is collected, it is analyzed using steps such as selecting data, presenting data and finally making conclusions. The research findings show that the implementation of  the principle of good faith in trade contracts in Indonesia is regulated in Article 1338 paragraph (3) of the Civil Code, which emphasizes the importance of the principle of good faith and fair dealing in the entire contract process, starting from negotiation, contract arrangement, contract implementation, to dissolution. contract. In Indonesian law, good faith is applied not only during contract implementation but also in the pre-contract stage, namely before the contract is signed. This is important to protect the parties involved in the transaction from losses. The use of the good faith principle in commercial contracts in Indonesia has also been applied in several judicial cases, such as in life insurance contracts, where the court ensured that the good faith principle was applied to protect the rights of the parties involved. Apart from that, the principle of good faith is also applied in the choice of law for foreign direct investment contracts Indonesia.

Abstract

Halal food and beverage products are important, and business actors must protect consumers following the mandate of the Consumer Protection Law and the Halal Product Assurance Law. The government has issued a free halal certification policy until October 17, 2024. MSME actors must have it, one of which is for MSME actors in food and beverage products. Suppose they do not have a halal certificate until that date. In that case, MSME actors will be sanctioned by Government Regulation Number 39 of 2021 concerning implementing the Halal Product Assurance Sector. The author uses an empirical juridical research method by identifying the law, seeing the effectiveness of law enforcement in the community, and reviewing the legal consequences of its implementation, especially in the Pekiringan Village area, the economic center of Cirebon City. From the results of this study, the author obtained data that more MSME actors in food and beverage products in Pekiringan Village do not have halal certificates in distributing their products. Therefore, there will be legal consequences in the form of sanctions for MSME actors if they do not have a halal certificate until the date determined by the current regulations.

Abstract

Abstract: Background: Community service is one aspect of the Tri Dharma of Higher Education that contributes to social, economic, and educational development. Aim: The Thematic Community Service Program (KKN-T) aims to build the independence of the Ciledug Wetan Village community through education-based, economic, and social empowerment. Methods: This activity uses the Participation Action Research (PAR) method, which emphasizes the community's active involvement at every stage of the program, from problem identification to planning, implementation, and evaluation. Results: The activities show increased children's literacy through interactive storytelling activities, encouraging their reading interest and critical thinking. In the economic aspect, MSME actors received training in branding, digital marketing, and promotional material creation to enhance the competitiveness of local products. In addition, public awareness of environmental cleanliness has increased through education on clean and healthy living behaviors (PHBS) and the management of organic and inorganic waste. Conclusions: This program has a direct impact on the community and students through knowledge application, leadership development, and the enhancement of communication and collaboration skills. Implication: These results affirm that student involvement in community-based empowerment programs can be an effective strategy for supporting sustainable development and innovation based on local wisdom.

Abstract

Background. Real Work Lecture (KKN) is a form of implementation of the Tri Dharma of Higher Education, which aims to encourage student involvement in community empowerment through a participatory approach and based on local needs. Aims. This service activity was carried out in Gegesik Wetan Village, Gegesik District, Cirebon Regency, with a focus on increasing public knowledge in the health sector, empowering the local economy through strengthening MSMEs, and improving environmental safety. Methods. The method used in this activity is a qualitative descriptive approach with a participatory method through the stages of field observation, problem identification, program design, and implementation of activities involving the community and village government. Result. The programs implemented include socialization on anti-bullying, juvenile delinquency, skin health, Clean and Healthy Living Behavior (PHBS), stunting prevention, prevention of Dengue Hemorrhagic Fever (DHF) and chikungunya, and reproductive health education in schools and communities. In addition, MSME empowerment is carried out through the One Village One Product (OVOP) approach, with assistance to traditional geplak food business actors in managing Business Identification Numbers (NIB), halal certification, and product identity development, including brand and logo development. Another program is community empowerment through socialization of the decile concept and training in making ecoenzymes as well as improving traffic safety through the installation of convex glass at several accident-prone road points. Conclusion. The results of the activity show an increase in public knowledge and awareness of health, an increase in the understanding of MSME actors regarding the importance of business legality and product branding, and the creation of preventive efforts to improve village traffic safety. Overall, this KKN activity makes a positive contribution to community empowerment and the sustainable development of local potential in Gegesik Wetan Village.

Abstract

Permasalahan pengelolaan sampah, khususnya praktik pembakaran sampah di berbagai daerah dengan keterbatasan lahan, menunjukkan belum optimalnya keseimbangan antara aspek lingkungan dan sosial masyarakat. Penelitian ini bertujuan menganalisis sinkronisasi hukum pengelolaan sampah berdasarkan asas ecoregion dan kearifan lokal dalam perspektif perlindungan lingkungan hidup. Penelitian ini menggunakan metode pendekatan yuridis normatif dan dipadukan dengan data empiris dari hasil wawancara kepada warga sekitar untuk melihat sejauh mana kesesuaian antara ketentuan hukum yang tertulis (das sollen) dengan pelaksanaannya di lapangan (das sein). Hasil penelitian menunjukkan bahwa meskipun aturan mengenai pengelolaan sampah sudah tergolong lengkap dan terstruktur, penerapannya masih belum sepenuhnya memperhatikan kapasitas daya dukung dan daya tampung lingkungan, serta belum sepenuhnya menyesuaikan dengan kondisi sosial masyarakat di masing-masing wilayah. Praktik pembakaran sampah masih menjadi pilihan utama di tingkat lokal, namun menimbulkan dampak terhadap kualitas udara dan kenyamanan masyarakat sekitar. Kesimpulannya, diperlukan penguatan sinkronisasi regulasi dengan pendekatan ecoregion dan kearifan lokal, peningkatan pengawasan, serta pengembangan sistem pengelolaan sampah berkelanjutan yang lebih adaptif terhadap kondisi wilayah.
