Abstract

The authority of the Syar'iyah Court in the field of marriage has a lot of contact with the interests of women. The decisions made from these cases are expected to be able to fulfill women's rights in return for the perceived suffering. Has the Syar'iyah Court already played a role and function in its decisions and consideration has been gender responsiveness to protect women's rights. Specifically the rights of women arising from divorce, in the verdict and the rights of civil servants' wives due to divorce divorce. This study aims to determine the role of the Syar'iyah Court in protecting the rights of women in divorce through its decision. The method used is juridical normative with the conceptual approach and the statute approach. Data analysis uses a qualitative approach. After conducting research, the existence of legal innovations in the Syar'iyah Court and guided by Perma Number 3 of 2017 in protecting women's rights can be protected. The Syar'iyah Court has not yet fully given a concrete decision regarding women's rights as a result of divorced divorce by male civil servants. Judges' considerations are gender biased and have a patriarchal mindset, difficulty of execution due to the absence of structural relationship between the court and related institutions to be the reason for the judges to ignore Government Regulation Number 10 of 1983 as amended by Government Regulation Number 45 of 1990 concerning marriage licenses and divorce of civil servants civil. If the regulation has been ratified even though there is no structural relationship and order, the Judge is obliged to carry it out and that the Syar'iyah Court Judge in giving consideration must synergize between the divorce permit in filing the divorce request to court with the decision for civil servants

Abstract

Tesis ini mengkaji tentang tanggungjawab negara terhadap kebakaran hutan di Indonesia ditinjau dari perspektif hukum Internasional. Kebakaran hutan di Indonesia semakin kian parah, Kerugian yang dialami negara lain sebagai akibat kebakaran hutan membuat konsep pertanggungjawaban negara yang masyarakat adanya injury bagi negara lain kembali dipertanyakan. Penelitian ini kemudian merumuskan dua isu hukum yaitu Tanggungjawaban Negara terhadap kebakaran hutan dalam Perspektif Hukum Internasional dan  Penyelesaian Hukum Internasional terhadap kebakaran hutan di Indonesia. Penelitian ini menggunakan dua pendekatan, yaitu Pendekatan Peraturan Perundang-Undangan (statute approach) dan Pendekatan Konsep (conceptual approach). Berdasarkan hasil analisis penulis, maka dapat diperoleh kesimpulan bahwa tanggungjawab terhadap kebakaran hutan di Indonesia telah di atur dalam berbagai peratutan perundang-undangan, juga jika dilihat dari perspektif hukum internasional, dalam Draft Articles on State Responsibility yang di adopsi oleh Internationl Law Commision. Tanggungjawab negara diatur dalam pasal-pasal Draft Articles on State Responsibility. Penyelesaian sengketa hukum internasional dapat diselesaikan melalui pengadilan berupa Arbitrase Internasional yaitu suatu penyelesaian sengketa yang dilakukan dengan cara menyajikan sengketa kepada aorang-orang tertentu dan sengketa tersebut harus persetujuan kedua belah pihak yang bersengketa, kemudian penyelesaian sengketa melalui pengadilan internasional (Mahkamah Internasional) mahkamah internasional ini berfungsi mengadili setiap negara-negara baik anggota atau bukan anggota PBB yang bersengketa. Kemudian ada juga penyelesaian diluar pengadilan yang berupa negosisasi, mediasi, jasa baik, konsiliasi, penyelidikan, penemuan, dan penyelesaian regional.

Abstract

This research would explain the difference of bailout policy by England and United States of America in facing global financial crisis in 2008. This research use qualitative method and economic political perspectives. This research takes the range of time from 2009 until 2010 where in that year was a condition after buying bailout found by England and United States of America. Bail out is a term used to explain about situation for the bankrupt entity or almost bankrupt, like a company or a Bank by giving a liquid fresh fund injection. It can be said simply that bailout is a direct government intervention in economy. According to Keynes, government intervention is needed in economy minimal in the form ofpolicy. As countries with liberal economy, America and England have different bailout policy orientation to solve Subprime mortgage case. Subprime mortgage case was assumed as a trigger of this financial crisis. Bail out done by America refers to save their corporations and strengthen their economy in the future without damaging the system of liberal they believe. In spite of that England disposed to save their corporations and economy that was to side with the society, to avoid rush and public trust. As a result, England bail out was faster than America in decreasing crisis fluctuation by giving big budgeting. America was not as faster as England in decreasing crisis fluctuation because of the difference of time in giving bail out, bail out’s funding, corporations that should be given bail out, and another obstacle in the parliament.

Abstract

Kabupaten Aceh Utara memiliki lahan perkebunan kelapa sawit mencapai 33,781.64 hektar yang diberikan kepada 11 perusahaan perkebunan. dengan jumlah lahan tersebut memunculkan banyak persoalan di bidang sosial-ekologi. Oleh karena itu pemerintah kabupaten Aceh Utara membangun konsep pembangunan perkebunan yang berorientasi sustainability dan berpedoman pada Peraturan Menteri Pertanian Nomor 11/Permentan/Ot.140/3/2015 tentang Sistem Sertifikasi Kelapa Sawit Berkelanjutan Indonesia (Indonesian Sustainable Palm Oil Certification System /ISPO). Penelitian ini bertujuan untuk mengetahui dan menganalisis apa yang menjadi hambatan, serta bagaimana peran dan upaya  pemerintah Kabupaten Aceh Utara dalam mengimplementasi prinsip-prinsip perkebunan berkelanjutan melalui ISPO. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian yuridis empiris. Dalam penelitian ini menggunakan tiga pendekatan yaitu pendekatan dengan mengidentifikasi objek penelitian, pendekatan perundang-undangan (Statute Approach), dan pendekatan terhadap taraf sinkronisasi vertikal dan horizontal ialah untuk mengungkap kenyataan. Berdasarkan hasil penelitian ini, Pemerintah kabupaten Aceh Utara telah mendorong 3 perusahaan di sektor perkebunan kelapa sawit berkomitmen menjalankan sertifkasi ISPO. Dalam pelaksanaannya mengalami hambatan di karenakan kurangnya kesadaran perusahaan perkebunan sawit dalam menjalankan sertifikasi ISPO. Pemerintah Aceh Utara mengalokasikan anggaran untuk mengatasi hambatan tersebut, serta membentuk tim percepatan implementasi ISPO. Penulis menilai perlu adanya sinergitas antara pemerintah daerah dengan pelaku usaha di bidang perkebunan kelapa sawit dalam membangun terwujudnya perkebunan sawit berkelanjutan dengan konsep sertifikasi ISPO.

Abstract

In the context of Aceh, its society and social-ecnonomic development, based on a number of literatures, the meaning of local wisdom can be drawn from the values, norms, laws and knowledge formed by religious teachings, beliefs, traditional values and experiences inherited from ancestors ultimately forming a local knowledge system that is used to solve everyday problems by the community. Aceh, as a region, in addition to following national law practices and provisions, also has customary institutions and traditional / cultural values with its own management that involves community leaders who know a great deal about local wisdom in the region. This is where the roles of traditional leaders, religious leaders and socio-cultural figures are considered important in harmonizing local wisdom with spatial regulation and environmentally sustainable development
