Abstract

The Village Consultative Body (BPD) is a governmental institution whose members represent village residents based on territorial representation and are democratically appointed. The BPD plays a pivotal role in developing village economic potential, with one of its main functions being the drafting of village regulations (Perdes). This study seeks to examine the implementation of regulatory functions of the BPD in drafting Perdes and to assess the capacity-building efforts for BPD members in formulating Perdes for economic development in Tarumajaya District, Bekasi Regency. The research employed a combined normative juridical and empirical approach, with a review of relevant literature, followed by field observations in seven villages in Tarumajaya, interviews with stakeholders, and Focus Group Discussions (FGDs). The findings revealed that: (1) the implementation of BPD’s regulatory functions in formulating Perdes on economic development across the seven villages in Tarumajaya remained suboptimal. The challenges identified included: (a) limited expertise of BPD members in legal drafting, (b) insufficient capacity to analyze village economic potential, and (c) an unconducive working climate between village heads and the BPD. (2) Optimizing the capacity of BPD members in drafting Perdes on economic development was achieved through: (a) updating regulations concerning recruitment patterns and membership requirements of the BPD, (b) organizing training and workshops to strengthen members’ legal drafting skills, (c) providing mentoring and technical assistance through model templates of village regulation draft (Raperdes) to serve as references, and (d) fostering collaboration with academics and non-governmental organizations.

Abstract

The state of Indonesia is a state of law, when a child is in conflict with the law, the child faces public power which has the authority in the form of coercive measures that limit and even rob a number of children's rights in order to maintain public order. Children are gifts from God that must be protected and cared for according to their morals. The definition of a child in the Convention on the Rights of the Child which has been approved by the General Assembly on November 20, 1989, in Article 1 states that a child means every human being under the age of 18 (eighteen) years except under the law applicable to children. that maturity is reached more quickly. One of the cases that surfaced and became public attention was related to the crime of premeditated murder committed by minors, namely the case that occurred at the end of 2020 in the city of Bekasi. The perpetrator has been sentenced to 7 years in prison as stated in the decision of the Bekasi District Court Number 59/Pid.Sus-Anak/2020/PN Bekasi. Methods used: Normative juridical law research with analytical descriptive nature. Results of the study: The case started with hurt because previously Doni Saputra, who was the victim, forced to enter his genitals to Ahmad Yusuf, who was the defendant. But the defendant refused, but the defendant was threatened with a knife and the victim promised to give the defendant some money. However, because the amount of money continues to decrease and is often not paid, it creates feelings of resentment and hurt. Furthermore, on December 5, 2020, the perpetrator committed a murder which ended in the victim's death. Proof of elements of a criminal act of proof is planning to present evidence in the form of witness statements, letters, instructions for the defendant's testimony. The factor of the occurrence of the crime of murder committed by minors is caused by several factors, namely, factors within themselves (internal) and also factors around them (internal). Children commit the crime of murder because their emotional state is not stable and cannot control it properly and the child's lack of faith. Influences from outside the child such as the family who is not always there when needed, the weak economy and the circumstances of the surrounding environment also influence the child to commit the crime of murder. There are several factors that cause children to commit the crime of murder, namely: (1) Internal factors, namely emotional factors and religious factors, (2) external factors, namely family factors and environmental factors. Suggestion: for the community in particular parents should pay more attention to their children in the community environment so that unwanted things do not happen, especially murder cases, as parents must care for and protect children from the threat of crime that will befall them, in other words parents provide advice to children to be good children and not to commit crimes and to parents must provide sufficient education so that they can distinguish between good and bad.

Abstract

Legal protection for consumers for the distribution of food and beverages that are not halal certified still does not have clear information that can create bad impacts that commonly occur, including regarding the quality or quality of goods, information that is not clear and even misleading, counterfeiting and so on, by following and obeying laws and regulations, including protecting the halalness of a food and beverage to be circulated, it will create the welfare of consumers. Since the enactment of laws and regulations related to these matters, producers have begun to make changes and implement these laws. These changes, when viewed from the perspective of everyday life, have not been effective enough and the producers have not provided product information openly. From information that is not clear and even misleading, forgery and so on. Formulation of the problem in this study (1) What is the form of legal protection for consumers according to the law on halal product guarantees?, (2) What is the responsibility of business actors for food and beverage products that are not halal-certified?. The purpose of this study is to determine the form of legal protection for consumers according to the law on halal product guarantees and to determine the responsibility of business actors for food and beverage products that are not halal certified. This legal research is classified as normative juridical research. The data collected in this research is through research with premier legal materials, secondary legal materials, and tertiary legal materials. Primary legal materials are legal materials that are authoritative. Based on the results of the analysis of legal protection against consumers for the distribution of food and beverages that are not halal certified to consumers, especially food and beverages that are not halal certified that are not in accordance with the provisions of the legislation. The form of accountability of business actors by means of civil law and criminal law. Civil law in question is compensation after a lawsuit is against the law and criminal law in question is that business actors can be criminally prosecuted in court.

Abstract

Criminal acts are currently a major concern, both from the top, namely the government and from the general public. The number of abortions in Indonesia is currently quite high, no less than two million cases per year. Until now there have been many different responses to abortion, religious experts, health experts, economists have given statements, each of which is against or even supports, religious experts view that whatever the reason abortion is an act that is contrary to religion because it kills the life of the fetus which means committing murder. Sexual violence that generally occurs is violence in the public domain, such as rape, sexual abuse, sexual harassment, and so on. The rape crime case causes the most difficulties in settlement both at the stages of investigation, prosecution, and at the stage of imposing a decision, in addition to the difficulties within the limits above, as well as difficulties in proving it becauserape or sexual immorality is generally carried out without the presence of other people. The rise of the crime of rape has become a special concern for feminists and also the wider community. This concern arises because apart from looking at upholding justice by punishing the perpetrators, it is also necessary to regulate rape victims, especially for victims who are pregnant with the children of the perpetrators of rape. Considering the possibility that the victim of rape could have a child as a result of the rape, this can bring future suffering to the victim. In practice, the problem regarding the effectiveness of the law on abortion, especially for rape victims, still raises pros and cons. Being a victim of rape alone is hard enough, especially when coupled with the occurrence of pregnancy as a result of rape. Abortion is not only a medical or health problem, but also a social problem related to the notion of freedom that a society adheres to. Meanwhile, according to Indonesian law, abortion is seen as a criminal act, because abortion is a real phenomenon, although more cases are covered up than reported. The act of abortion is also an act of dilemma, because not least of the existing practices are actually many mothers who have lost their lives due to having abortions.

Abstract

This legal research on legal protection for Paspampres soldiers tasked with securing the President aims to examine and formulate forms of legal protection for Paspampres soldiers tasked with securing the President. The formulation of the problem includes: (a) how is the legal protection for Paspampres soldiers in charge of securing the president; and (b) and how to formulate the ideal concept of legal protection for the Paspampres which has the duty to protect/secure the president. The research method used in this research is explanatory with a normative juridical approach. The results of this study indicate that legal protection for soldiers who carry out the task of protecting the President is still low and inadequate with their very heavy duty as a safety, protector, and life shield for the Head of State. Paspampres soldiers are still often blamed when there is a security threat to the President, even though the threat actually comes from the President's lack of/disobedience to the security protocol, while Paspampres soldiers have clearly worked according to the SOP. Protection of Paspampres Soldiers in general with legal protection for other TNI soldiers. Until now, there has been no special protection arrangement for the Presidential Security Forces when it comes to securing the President. The ideal concept for the protection of Paspampres soldiers is to be specifically differentiated and improved in quality, commensurate with the weight of the duties and security of the President. Therefore, it is necessary to make special regulations regarding legal protection for Paspampres Soldiers. One of the contents of the special regulation is that the Paspampres soldiers are not blamed if there is a threat to the President's security due to the President not complying with the security protocol, while the Paspampres soldiers have clearly complied with the SOP in securing the President. The conclusion of this study is the need to formulate special regulations regarding legal protection for Paspampres Soldiers.

Abstract

Research on Optimizing the Handling of Narcotics Crimes Conducted by Children Through the Diversion Process aims to determine the diversion setting in the laws and regulations, to identify and analyze the implementation of diversion against children who are perpetrators of narcotics crimes based on Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, to find out what obstacles occur in handling child narcotics crimes in the diversion process. The approach that will be used is the empirical juridical/sociological juridical approach. In conducting the research, the writer will use descriptive analytical research method. The types of data used in this study are primary data and secondary data obtained from searching for definite data based on the results of data searches or interviews with parties concerned with this research and also from the literature. Methods of data collection using library research (Library Research). The data analysis method used is descriptive-qualitative analysis method. The results of this study are that diversion regulation in Indonesia begins with the idea of diversion in international law which is proclaimed in the SMRJJ (The Beijing Rules) as an international standard in the administration of juvenile criminal justice. 2012 on the Juvenile Criminal Justice System. The process of implementing the diversion carried out by investigators is guided by Article 7 paragraph (1) of Law no. 11 of 2012 concerning the Juvenile Criminal Justice System. As for the obstacles in the process of implementing the diversion of narcotics abuse crimes committed by children are: the lack of parental care will hinder the diversion process; lack of parental care also makes it difficult for investigators to obtain the child's identity; limited time for arresting children for the purpose of investigation; absence of parents; if what is caught is a homeless child, it will be difficult for investigators to obtain the identity of the child; lack of understanding of diversion efforts.

Abstract

Penelitian hukum mengenai Optimalisasi Perlindungan Konsumen Atas Kebocoran Pengelolaan Data pribadi Dalam Pinjaman Online bertujuan untuk memaparkan langkah-langkah optimalisasi perlindungan konsumen atas kebocoran pengelolaan data pribadi yang sering dilakukan oleh pelaku usaha dalam usaha jasa pinjaman online. Adapun rumusan masalahnya adalah: bagaimana managemen pengelolaan data konsumen yang di lakukan oleh pelaku usaha pinjaman online dalam menjamin perlindungan hukum terhadap konsume, dan bagaimana upaya perlindungan konsumen dalam penanggulangan kebocoran data secara optimal. Teori yang digunakan sebagai pisau analisis adalah teori perlindungan konsumen dan pertanggungjawaban pelaku usaha. Metode penelitannya berifat eksplanatif dengan pendekatan yuridis normatif. Data diperoleh dari studi kepustakaan ditambah dengan wawancara secara terbatas dengan aparat kepolisian. Hasil penelitian menunjukkan bahwa kebocoran data konsumen usaha jasa pinjaman online masih sangat sering terjadi, dan seringkali terjadi karena manajemen pengelolaan data yang dilakukan oleh pelaku usaha jasa pinjaman online tidak menerapkan sistem pengamanan yang baik. Pada beberapa kasus ada dugaan kesengajaan pembocoran yang dilakukan oknum penyedia jasa. Kebocoran data pribadi juga terjadi terjadi karena central data diterobos oleh hacker, penyalahgunaan oleh pegawai perusahaan pinjaman online maupun upaya-upaya kerjasama tidak legal antara perusahaan pinjaman online dengan kelompok debt collector (penagih utang). Meskipun ada ancaman sanksi pidana jika melakukan pembocoran data atau menjual data kepada pihak ketiga, namun kebocoran data pribadi konsumen penjaman online tetap terus terjadi. Meskipun telah ada berbagai peraturan perundang-undangan yang mengatur tentang perlindungan data pribadi di Indonesia, namun tampaknya belum ada yang mampu memberikan perlindungan menyeluruh atas hak dan kepentingan konsumen terkait privasi dan data pribadinya. Ketiadaan peraturan yang komprehensif ditambah dengan minimnya tindakan pencegahan teknis membuat konsumen di Indonesia rentan terhadap pelanggaran data pribadi, seperti kebocoran data dan penyalahgunaan data pribadi. Optimalisasi penegakan hukum terhadap Tindakan pembocoran data pribadi konsumen pinjaman online adalah peningkatan pengetatan izin pendirian/operasional perusahaan pinjaman online, pengawasan manajemen data pribadi yang dikelola perusahaan pinjaman online, dan audit mutu operasional pinjaman online oleh Otoritas Jasa Keuangan (OJK).

Abstract

Lingkungan adalah suatu hal yang sangat penting bagi kehidupan masyarakat, setiap masyarakat memiliki hak terhadap lingkungan yang baik dan sehat, masalah lingkungan berkaitan dengan pencemaran dan dampak yang akan terjadi setelah adanya perusakan terhadap lingkungan tersebut. tentunya hal ini sebagai bagian dari hak asasi dan hak konstitusional setiap masyarakat mengenai upaya perlindungan dan perwujudan kepada Pasal 28H ayat (1) Undang – Undang Dasar 1945. Rumusan masalah pada penelitian ini yaitu: bagaimana dampak pencemaran lingkungan bagi masyarakat akibat penumpukan sampah disekitar bantargebang, bagaimana perlindungan hukum bagi masyarakat disekitar TPST Bantargebang dan bagaimana implementasi perjanjian kerjasama antara Pemrov DKI Jakarta dan Pemkot Bekasi. Metode yang digunakan: adalah Normatif Deskriptif. Hasil penelitian: Perlindungan Hukum terhadap masyarakat sekitar TPST Bantargebang dilindungi dengan adanya peraturan-peraturan yang telah di buat untuk melindungi masyarakat, yaitu Berupa Peraturan Undang-Undang No. 32 Tahun 2009 Tentang Perlindungan Dan Pengelolaan Lingkungan Hidup, Peraturan Daerah Kota Bekasi No.15 Tahun 2011 dan Perjanjian Kerjasama Antara Pemkot Bekasi dan Pemprov DKI Jakarta dan dampak yang ditimbulkan oleh TPST Bantargebang sendiri adalah berupa dampak negatif maupun positif yang dirasakan oleh masyarakat sekitar. Tujuan perlindungan dan pengelolaan lingkungan hidup yang baik akan mendatangkan manfaat yang baik juga kepada masyarakat, pemerintah maupun negara tapi jika tidak dijalankan dengan baik maka dampak buruknya akan dirasakan pula oleh pemerintah dan masyarakat itu sendiri. Saran: Untuk Pemerintah maupun Pengelola TPST Bantargebang. Dampak negatif yang dirasakan adalah bau sampah yang menyengat dan air tanah yang tercemar. Oleh karen itu, diharapkan pemerintah dan pihak terkait menerapkan pengelolaan sampah dengan sanitary landfil dilakukan dengan baik dan sungguh-sungguh agar dampak negatif berupa bau dapat teratasi, begitu pun dengan air lindi penanganan dan pengelolaanya untuk masa yang akan datang harus lebih di perketat dengan memperhatikan standar yang berlaku. Untuk masyarakat dan pelaku usaha/kegiatan tetap menaati dan menjalankan aturan sesuai apa yang telah ditetapkan sehingga kelestarian lingkungan hidup tetap terjaga dari generasi sekarang sampai generasi yang akan datang.
