Abstract

The needs and desperateness of the community in its economy make the transaction also buy goods with the object of buying and selling vehicles that are used as objects of fiduciary guarantee. Vehicle / object of fiduciary guarantee in can be credited to the financing/ leasing institution with payment in installments. Against guarantees for repayment of the financing is charged guaranteed in a fiduciary. In practice the transfer of the fiduciary guarantee without being known by the financing institution. Even though the transfer or sale and purchase of the fiduciary guarantee object must be registered in advance to the Fiduciary Registration Office. This resulted in the emergence of cases that can be punished debtor. The problem is how the legal consequences for debtors who sell fiduciary guarantees with late registration and how tosettle against creditors who sell the fiduciary guarantee. The approach method used is the empirical juridical approach, the research is analytically descriptive, the approach is used to analyze qualitatively. Regarding the legal consequences of transferring fiduciary guarantee objects that are transferred or sold to another party.  The right of creditors to get repayment on the loans granted is not lost even if it results from the invalidity of the fiduciary guarantee certificate, but results in creditors no longer having preferent rights. Law Enforcement through the means of criminal law is delayed, so there is no discussion, whether in this case there is a criminal act in the form of diverting, pawning or renting goods that become objects that become fiduciary guarantees without the permission of fiduciary recipients as referred to in Article 23 Jo Article 36 of Ri Law No. 42 of 1999 concerning Fiduciary Guarantee allegedly carried out by WARMO Bin (alm) CARWANbrothers.

Abstract

Kompleksitas Penegakan hukum Kekerasan dalam Rumah Tangga tidak hanya dapat diselesaikan melalui pendekatan yuridis semata, melainkan harus bersifat integral, tidak hanya sebatas budaya, tetapi juga faktor politik dan ekonomi. Konsistensi Penegakan hukum, peran serta korban dan masyarakat atas hak dan kewajibannya bahwa masalah kekerasan dalam rumah tangga bukan lagi merupakan domain privat melainkan domain publik akan memberikan jaminan atas perlindungan dan kepastian hukumnya.

Abstract

KUHAP merupakan konstruksi yuridis yang realitas legalistiknya telah memberikan Ten Commandments dengan asas perlindungan Hak Asasi Manusia dalam due process of law guna membentuk tatanan yang adil, karena keadilan berjalan beriringan dengan struktur HAM. Terwujudnya KUHAP yang berfungsi melindungi HAM secara komprehensif, sejalan dengan tuntutan Konvensi Anti Penyiksaan, merupakan kebutuhan dasar menuju era Supremasi Hukum.

Abstract

The response of the value of justice to the application of the principle of legality is essentially an attempt to make changes to the concept of the Criminal Justice System which is considered retributive and inhumane. The principle of legality with the guarantee of legal certainty does not fully guarantee community justice, therefore a shift in the orientation of thought which was originally only formal legality to material legality is needed.

Abstract

The phenomenon of reporting and spreading hoaxes on social media to drive public opinion is packaged in the concept of post-truth, where a pattern of a lie that is told repeatedly will disguise itself as the truth. Ignoring this will have an impact on the emergence of panic, hatred, anxiety, commotion, insecurity, fear, damage to reputation and can even lead to social movements and divisions in society. Law enforcement efforts with a responsive legal approach offer liberation from types, ways of thinking, not only texts, but also contexts, so as to place certainty, justice and benefit in one breath. The application of all of the above dimensions does not only affect the law from the process of its occurrence to its enforcement, but in particular will result in consistency in law enforcement without being selective (discriminatory) in accordance with the legal principle that all people are equal before the law (equality before the law).

Abstract

The drug problem in Indonesia is still something urgent and complex. In the past decade, this problem has become rife, as evidenced by the increase in the number of abuses and trafficking, to drug smuggling significantly, even spreading into prisons. The purpose of this study is to identify modes of smuggling, analyze the role and involvement of relevant parties, assess causal and driving factors, evaluate the effectiveness of surveillance and control systems. The method used in this research is empirical juridical by conducting direct research to the Cirebon Class I Penitentiary and also using the Deductive thinking method. Drug smuggling occurred at the Class I Cirebon Penitentiary, which was in the mode of visitors smuggling prohibited items into the Class I Cirebon Penitentiary, West Java, which was thwarted by officers of the Cirebon Class I Penitentiary. The items were 1 plastic meth clip and 150 grains of Alphrazolam type sedative into the Penitentiary. His modus operandi, the drug was hidden by a visitor inside his restricted area. The strategies carried out by correctional officers for the prevention of drug smuggling are physical security strategies and technological security strategies, as well as internal and external factors supervised by correctional officers. Over time, there have been many new modes of drug smuggling into prisons, so authorities continue to develop strategies to prevent drug smuggling by increasing security inside prisons and monitoring emerging modes of smuggling.

Abstract

The purpose of this study is to identify how the application of PERMA No. 4 of 2014 to diversion efforts and how the legal force of the law in the enforcement of diversion at the court level in order to achieve justice for children in conflict with the law (ABH). The research primarily utilized qualitative data derived from both primary and secondary sources. The primary data includes case files and court decisions related to Case Number 14/Pid.Sus-Anak/2021/PN.Cbn, as well as the legal text of OPREMA No. 4, while secondary data is obtained from literature reviews of law journals, books, and prior research. The data analysis is conducted using content analysis and the case study method, allowing for a comprehensive examination of how the COPREMA of 2014 has been applied in this specific legal context. The results of the author's research through an interview with Mr. Sukiran, S.H. as the Deputy Criminal Registrar of the District Court I B Cirebon on Tuesday, June 4, 2024 at 14.30 WIB, regarding different regulations related to the diversion in each law enforcement agency, among other things, it can trigger the smooth running and results of judicial decisions. A comparative analysis of cases where diversion was achieved versus those where it failed could provide deeper insights into how diversion attempts can be improved, especially for cases involving children who face significant legal and social challenges. Additionally, examining the impact of such legal frameworks on recidivism rates among juvenile offenders could offer practical recommendations for enhancing the juvenile justice system in Indonesia.

Abstract

Tanah atau lahan disini dapat dialih fungsikan sesuai dengan kebutuhan masyarakat yang ada, misalnya di daerah perkotaan dimana Pertumbuhan aktivitas kota mengakibatkanintensitas penggunaan lahan di pusat kota menjadi sangat tinggi. Seiring dengan perkembangan aktifitas penduduk tersebut menyebabkan lahan yang tersedia lebihdifokuskan kepada penyediaan lahan untuk pemukiman penduduk sampai dengan kegiatan yang berkaitan dengan perekonomian.Keterbatasan lahan sangat dirasakan oleh warga Kota Cirebon yangkeseluruhan luas wilayahnya sekitar 37,36 km 2 (14.42 sq mi) ini pun mendapatkan peringkat ke 83 dari 99 Kota di Indonesia dan total jumlah kependudukan di KotaCirebon sekitar 316.277 jiwa, dan kepadatan kependudukannya mencapai8,465.66/km 2 (21,926.0/sq mi). Hal demikian menjadi permasalahan keterbatasanlahan di Kota Cirebon, baik untuk pemukiman serta tujuan kesejahteraan masyarakat untuk menghuni rumah yang layak dan terjangkau di dalam lingkungan yang sehat, aman, harmonis, dan berkelanjutan di seluruh wilayah Indonesiamaupun lokasi pemakaman yang memang selayaknya untuk makam dan tidak bercampur bahkan tumpang tindih dengan tempat tinggal.Penelitian ini menggunakan pendekatan yuridis normatif, yaitu dengan mengkaji atau menganalisis data sekunder yang berupa bahan-bahan hukum sekunder dengan memahami hukum sebagai perangkat peraturan atau norma-norma positif di dalam sistem perundang-undangan yang mengatur mengenai permasalahan dalam penelitian ini. Spesifikasi penelitian yang digunakan adalah deskriptif analisis yaitu merupakan suatu pendekatan yang dilakukan terlebih dahulu memusatkan pemikiranTujuan dari penelitian ini diharapkan masyarakat di Kota Cirebon khususnya di wilayah kemlaten Cirebon agar dapat memperhatikan   aturan letak pemukiman yang layak untuk di huni terpisah dengan pemakaman serta di harapkan   dinas-dinas terkait   dapat memberikan sosialisasi kepada masyarakat terkait dengan hal tersebut.

Abstract

Sexual violence against children is a violation of human rights that has a long-term traumatic impact. The phenomenon of increasing cases of sexual violence against children has become a global problem that requires serious attention. This increase continues to occur in various regions, including Cirebon Regency. The role of the Regional Indonesian Child Protection Committee (KPAID) of Cirebon Regency in handling this case is very important. This study analyzes the role of KPAID Cirebon in overcoming sexual violence against children, identifies the factors that cause an increase in child sexual violence, and examines the role of KPAID Cirebon Regency in dealing with child sexual violence cases, focusing on prevention, case handling, and challenges faced. This study uses a qualitative method with a case study approach. Data was collected through in-depth interviews with the Chairman of the Cirebon Regency KPAID, the victim's family, and other related parties. The results of the study show that KPAID Cirebon Regency plays an active role in receiving reports, providing legal and psychological assistance and advocating to protect the rights of victims. However, KPAID faces challenges that affect its effectiveness in carrying out its role, such as limited resources, lack of public awareness and weak coordination between institutions. And this phenomenon continues to increase supported by many external and internal factors such as environmental factors and the victim's own family factors.
