Abstract

Wasatiyah memiliki makna yang sepadan dengan tawassuth berarti tengah, i’tidal berarti adil tawazun berarti berimbang di dalam Al-Qur’an sendiri terdapat kalimat ummatan wasathan  yang menjadi konsep muslim sebagai umat pertengahan, tidak berat sebelah atau tidak ekstrim ke kanan dan ke kiri tetapi berada di tengah begitu juga dalam hukum Islam wataknya bersifat wasatiyah yang berarti dalam menerapkan hukum harus bersikap adil, dan seimbang. Pembahasan wasatiyah Islam sebenarnya bukanlah hal yang baru bagi bangsa Indonesia tetapi ini merupakan warisan dari para pendahulu bangsa sudah meletakaan dasar-dasar beragama yang toleran, inklusif, karena sejatinya ajaran Islam itu sendiri sangat moderat. Metode  penelitian yang digunakan adalah deskriptif-analitis dengan jenis library research (penelitian pustaka). Hasil penelitian ini menyebutkan bahwa menurut Hasbi Ash-Shiddieqy hukum Islam menempuh jalan tengah, jalan yang imbang tidak terlalu berat ke kanan mementingkan kejiwaan tidak berat ke kiri seperti antara suami dan istri seorang suami tidak boleh  berat sebelah seperti membuat istrinya terkatung-katung (terlantar) ditalak tidak, dipergaulipun tidak, kemudian tidak boleh hanya memihak kepada salah seorang istri apabila istrinya lebih dari satu sehingga menyebabkan timbulnya kekecewaan pada istri yang lain. Hakikat konsep wasatiyah dalam hukum Islam memberikan keselarasan dan keseimbangan hukum Islam selalu berdasarkan kepantasan dan kecukupan seperti hukum kafarat yang membatalkan sumpah,  kafaratnya sesuai kebiasaan dengan memberi makan sepuluh orang miskin dan makanan yang pantas dan secukupnya.

Abstract

Abstrak Imam al-Ghazali salah satu ulama terkemuka terutama dalam ilmu tasawuf, fiqh, akidah dan ilmu-ilmu lainnya pemikirannya telah memberikan kontribusi besar bagi perkembangan dunia Islam di dunia Islam dengan salah satu karya monumentalnya adalah kitab Ihya Ulum al-Din didalamnya terdapat aturan-aturan kehidupan seperti kehidupan dalam rumah tangga dan sosial kemasyarakatan lainnya. Metode penelitian yang digunakan adalah penelitian kualitatif dengan studi pustaka (library research ) penelitian yang bersifat deskriptif menggunakan content analisit  yaitu dengan mengkaji literatur primer dari kitab al-Ghazali. Hasil penelitian dengan pernikahan kedua belah pihak saling mewarisi apabila salah seorang di antara keduanya telah meninggal meskipun belum bersetubuh dan kedua pihak wajib bertingkah laku yang baik. Sementara, hak-hak sang suami terhadap istri  menurut Imam al-Ghazali adalah, taat dan berbakti pada suami, menjaga harta dan barang-barang suami tak boleh memberikan apapun barang-barang di rumah suaminya kecuali izin suami, tidak  boleh puasa sunat tanpa izin suami, tidak boleh keluar rumah tanpa izin suami, memelihara dan menutupi diri, jangan menuntut belanja lebih dari keperluan, menghindari uangnya jika berasal dari pencaharian yang haram, jangan menyia-nyiakan harta suaminya, tetapi hendaklah memelihara.Kata kunci: al-Ghazali, Hak Suami, Kewajiban Suami dan Istri AbstractImam al-Ghazali, one of the leading scholars, especially in Sufism, fiqh, faith and other sciences, his thoughts have made a major contribution to the development of the Islamic world in the Islamic world with one of his monumental works, the book Ihya Ulum al-Din in it there are rules of life such as life in the household and other social communities. The research method used is qualitative research with literature study (library research ) descriptive research using analyzed the content  namely by studying the literature first from the book of al-Ghazali.The results of research with the marriage of the two parties inherit each other if one of them has died even though they have not had intercourse and both parties are obliged to behave properly. Meanwhile, according to Imam al-Ghazali, the husband's rights to his wife are obedient and devoted to the husband, guarding the property and belongings of the husband, not giving anything in the husband's house except for the husband's permission, not fasting circumcision without the husband's permission. , may not leave the house without the husband's permission, take care of and cover himself, do not demand more than necessary, avoid the money if it comes from illegal livelihood, do not waste her husband's wealth, but should take care of it.Keywords: al-Ghazali, Husband's Rights, Duties of husband and wife

Abstract

Crimes such as murder and loss of a person's life are unlawful acts that are very contrary to humanity and justice in the Supreme Court circular letter number 4 of 2011 concerning justice collaborators (actors of witnesses who work together) will get legal remissions which are still limited to cases such as corruption, terrorism, narcotics, money laundering and human trafficking. The research method is a normative juridical descriptive method, namely the object of research related to the applicable laws and policies. The research results in the Supreme Court circular letter no. 4 of 2011 justice collaborators for the crime of murder are not clarified in the circular letter as a guide for judges to decide on a choice of criminal acts of murder while murder cases really need to be resolved with justice collaborators, maqasid sharia hifzul nafs (protecting lives) is a state commitment and Islam forbids killing.
