Abstract

The appointment of an official head in the area, as regulated in the provisions above, gives rise to polemics at the level of implementation. Some of the polemics that arise as a consequence of appointing an official head area, among other things, is the lack of transparency in the appointment process of the official head area, and the appointment of an active TNI member as an acting head disfigures the spirit of reform. Additionally, there is not yet a rule managing the executor mechanism for the appointment of the official head area.This study aims to analyze the appointment process of the existing head area position at this moment as an effort to guard popular sovereignty, ensuring it is not injured by inadequate mechanisms, transparent, and yet firm policies that arrange the mechanism for appointing the official head area to prevent conflicts of interest. This study is a normative legal study, where the search uses secondary data with material references. The result of this study is the arrangement of the mechanism for appointing the current Regional Head acting is not yet arranged systematically, so the appointment process of the acting Regional Head experiences several problems, including the existence of a conflict of interest in appointing the acting Regional Head, and the duration of appointing the Acting Regional Heads, who have been around for quite a long time, has implications for the governance of the government area. Additionally, there exists the appointment of acting Regional Heads who are active TNI soldiers.

Abstract

Sikap Mahkamah Konstitusi terhadap pengujian undang-undang yang merupakan kebijakan hukum terbuka, telah berubah dengan dikemukakannya argumentasi baru, tentang pengertian atas salah satu prinsip konstitusi yaitu prinsip proporsionalitas. Putusan MK Ri No. 116/PUU-XXI/ 2023 telah menyatakan bahwa Pasal 416 ayat (1) UU No. 7 Tahun 2017 tentang Pemilihan Umum inkonstitutional bersyarat. Paper ini mengkaji implikasi putusan MK ini terhadap pelaksanaan UU No.7 Tahun 2017, khususnya yang berkenaan dengan Pasal 416 ayat (1) maupun kemungkinan perubahan sikap MK atas ketentuan Presidential Threshold (Pasal 222). Kajian ini merupakan kajian doktrinal, dengan menggunakan bahan hukum primer dan sekunder, berupa peraturan perundang-undangan, putusan-putusan Mahkamah Konstitusi, hasil penelitian yang relevan dengan kajian. Hasil kajian ini menyatakan bahwa pendirian Mahkamah Konstitusi akhirnya melakukan perubahan, dengan dikemukakannya argumentasi baru ketika memaknai sesuai tidaknya dengan konstitusi. Perubahan ini akan membuka peluang dimohonkannya kembali kasus-kasus pengujian tentang Presidential Threshold , yang selama ini ditolak oleh Mahkamah Konstitusi.

Abstract

The digitalization of public services has positioned state auctions as an integral part of constitutionally guaranteed public service delivery. In Indonesia, the implementation of electronic auctions (e-auction) by the Directorate General of State Assets (DJKN) through the State Assets and Auction Service Office (KPKNL) represents the state’s obligation to provide transparent, accountable, and legally certain public services. This study examines the regulation of electronic auctions, particularly the implementation of Minister of Finance Regulation Number 86 of 2024, from the perspective of the constitutional right to public services as guaranteed under Article 28D paragraph (1) and Article 34 paragraph (3) of the 1945 Constitution and Law Number 25 of 2009 on Public Services. Using a legal research method that draws on statutory, conceptual, and case approaches, this study analyzes KPKNL's auction regulations, court decisions, and administrative practices. The findings indicate that PMK No. 86 of 2024 strengthens legal certainty, transparency, and accountability in electronic auction services by reinforcing the evidentiary status of auction minutes and standardizing procedural safeguards. However, empirical evidence shows that the fulfillment of constitutional public service rights remains constrained by administrative rigidity, information asymmetry, and limited access to legal remedies for service users. This study concludes that while electronic auction regulations improve public service quality, further alignment with constitutional principles of equality before the law, legal certainty, and accountable digital services is necessary to realize citizens’ constitutional right to public services fully.

Abstract

Ratification of the Convention on the Rights of Persons with Disabilities is a form of recognition and affirmation by the state that the Tribe disability can feel the same rights as citizens of other in civil, cultural, economic, political and social issues and includes all the rights and obligations of the state for the People with Disability in order to create fairness and independence. Elections is a feature or a sign of democracy in a democratic country. The limitations inherent in the disability does not necessarily eliminate the acquisition and fulfillment of the rights of persons with disabilities as citizens. Acquisition and fulfillment of the rights of persons with disabilities should be supported by the availability of infrastructure (Accessibility) that allows them to channel their political rights in general elections.Keyword: Disability, Political Right, General Election.

Abstract

The 1945 Constitution of the Republic of Indonesia (UUD) Article 1 paragraph (3) states that "The Indonesian state is a state of law" so that it can be clearly explained that Indonesia is a state of law, not a Machtsstaat state which is based on mere power, the existence of dynasties. Politics in the Indonesian constitutional system has recently become a very disturbing phenomenon. In the development of political dynasties in Indonesia with a pattern of centralizing power in certain families or relatives, it can kill the potential of other citizens who have integrity and credibility as leaders in the region and the democratic process does not run healthily and fair play.
