Abstract

This study aims at finding out how the inheritance system in the Civil Code (KUHPerdata) is. Second, to find out how the inheritance rights for the crime of forgery will be unforced. This type of research is library research and the research approach used is a juridical normative approach. The data sources for this research are primary, secondary and tertiary data sources through legislation, books, journals and decisions. The data analysis used are through identifying and classifying the existing data and arranging them systematically. The results of this study indicate that in the inheritance system according to the Civil Code there are two ways of obtaining inheritance, namely: first, obtaining an inheritance based on statutory provisions and second, obtaining an inheritance based on a will. There are restrictions on certain parties which result in the abolition of the right to inherit, which is one of the reasons for committing the crime of forging a will.

Abstract

Implikasi Hukum terhadap hak dan kewajiban dalam Pewarisan dapat memberikan dampak hukum guna mencegah ketidakseragaman pemahaman mengenai hak dan kewajiban dalam pewarisan maka perlu dilakukan sosialisasi untuk menyatukan pemahaman khsususnya kepada generasi muda di SMA Neg 2 Majene. Materi Sosialisasi atas implikasi ini diantaranya, defenisi kewarisan dalam hukum perdata, prinsip-prinsip pewarisan dan hak dan kewajiban dalam pewarisan. Adapun beberapa tahap yang dilakukan mulai dari persiapan sosialisasi, pelaksanaan sosialisasi, sampai dengan penyusunan laporan hasil sosialisasi. Pelaksanaan pengabdian masyarakat sosialisasi terlaksana dengan baik secara tatap muka. Hasil analisis sosialisasi menunjukkan pemahaman siswa SMA Negeri 2 Majene terhadap hak dan kewajiban dalam pewarisan

Abstract

The rapid integration of surveillance technology and big data analytics into law enforcement has transformed contemporary governance, generating both security benefits and serious human rights concerns. This article examines how existing regulatory frameworks inadequately address the dynamic risks embedded in surveillance ecosystems and proposes a lifecycle-based governance response. Using a qualitative normative-empirical methodology, the study combines doctrinal legal analysis of international human rights law with comparative regulatory assessment and interdisciplinary technology governance theory. The findings reveal structural fragmentation, insufficient algorithmic transparency, weak proportionality assessment, and reactive oversight mechanisms that fail to capture risks across data collection, storage, analysis, sharing, and deletion. In response, the study develops a Dynamic Human Rights Risk Assessment Model that operationalizes proportionality, necessity, transparency, and accountability at each stage of the surveillance data lifecycle. The model embeds continuous monitoring, mandatory impact assessments, and independent oversight within surveillance infrastructures, shifting governance from static compliance to adaptive human rights stewardship. The research concludes that lifecycle-based regulation provides a coherent and flexible framework capable of safeguarding fundamental rights while accommodating technological innovation in complex surveillance environments.
