Abstract

The provision of assimilation and integration programs is one of the answers to the problem of overcrowded prisons . As a result of being overcrowded, prisons cannot implement the health protocol, namely physical distancing recommended by the government. Policies for implementing assimilation programs during the Covid-19 pandemic should be accompanied by legal policies whose impacts can be beneficial for the legal system in Indonesia, especially regarding criminal policies, namely through reconstruction and/or reformulation of the criminal system and criminal sanctions through the application of social work criminal sanctions and prevention and/or or crime prevention through restorative justice efforts and this is taken into consideration as an effort to resolve the over capacity problem.

Abstract

Repeating songs or covering songs uploaded on a digital platform is done in practice, but among them there is covering the songs and music commercially without the permission of the Creator and the Related Rights Owner. This research is carried out using normative legal methods through legislative approaches. The study discusses the application of the economic rights protection of Creators and Related Rights Holders on songs reproduced commercially without permission on the uploaded digital platforms of yuotube and the role of LMKN in protecting the copyrights of songs and music uploaded on the digital platform of youtube.  Based on this legal normative study, it is concluded that the protection of recorded and unrecorded song and music works remains protected by law as well as the role of the National Collective Management Agency in collecting royalty on song and musical works on digital platforms is part of the protection granted to Creators and Owners of related rights over their economic rights.Keywords: Copyright, cover song, digital platform, LMKN

Abstract

Ondel-Ondel is a cultural heritage that is used as a complement to various traditional ceremonies and art activities that are performing, introducing Betawi culture or art performances but at this time there is a diversion of the function of ondel-ondel art which should be an Intangible Cultural Heritage, turning into a tool for busking, begging is considered a form of violation of public order. This study aims to analyze the protection of Betawi people's rights to Ondel-Ondel art as communal intellectual property whose use by the State and examine the application of legal protection for changes in the function of Ondel-Ondel art for busking by the DKI Jakarta government. This research uses normative juridical research. The protection of the Betawi people's rights to the art of Ondel-Ondel as Communal Intellectual Property, Traditional Cultural Expressions, by the state is still unclear and needs an explanation of the rules for the application of the state as a holder and who protects EBT and needs to involve indigenous peoples, as holders of EBT, in order to protect the ownership of Communal Property and concrete actions of the State in collaboration with the local community, public awareness, supervision and provide strict sanctions against violations of public order. Keywords: Ondel-ondel; Order; Communal.
