Abstract

Healthcare services in hospitals require competent healthcare workers in accordance with Law Number 17 of 2023. Medical and healthcare workers receive legal protection when working according to professional standards, while hospitals are responsible for the negligence of their healthcare workers. Nurses, including vocational nurses, nurses, and specialist nurses, work based on hierarchical authority and doctor's instructions. Patients also receive legal protection in receiving safe and quality services. The problem formulation is how are nurses' responsibilities towards patients in healthcare services in hospitals? And how do doctors delegate authority to nurses? The research method used is normative juridical. The results of the research are: The responsibilities of nurses in healthcare services in hospitals include the obligation to comply with professional standards, operational procedures, and the implementation of duties based on the doctor's instructions. Legally, nurses can be held accountable for civil, criminal, and administrative actions for actions that harm patients. The delegation of doctor's authority must be carried out according to the nurse's competence. Hospitals are also responsible for the shortage of healthcare workers based on Law Number 17 of 2023 concerning Health.

Abstract

Abstract The development of the tourism industry in Badung regency is interesting to foreign investors to invest in Badung regency, especially in the area of ​​tourism accommodation services. What are the local government authorities of Badung Regency in granting approval and permission of foreign investment in tourism accommodation? How is the regulation of foreign investment in tourism accommodation services in Badung regency? The type of research used in this study was normative legal research. The results showed (1) the authority of the local government of Badung regency related to the granting of foreign investment permit in the tourism accommodation can be seen from the provision of Article 19 of Badung Regulation No. 2 of 2012 which generally states that the local government of Badung regency is entitled to regulate tourism activities in the region; (2) The arrangement of foreign investment in tourism accommodation services in Badung Regency has not been accommodated in a more specific way through the regulation of Badung Regency. The absence of the specification of this rule would also affect the legal security and legal protection for foreign investors for their investment in tourism accommodation in the area. Abstract

Penelitian ini mengkaji praktik perjanjian kredit dan wanprestasi di Koperasi Sari Sedana Luwih, Bali, dengan fokus pada efektivitas hukum dalam pelaksanaan jaminan. Latar belakang penelitian ini adalah meningkatnya kasus wanprestasi dalam perjanjian kredit koperasi meskipun telah tersedia jaminan serta pengaturan hukum yang mengaturnya. Tujuan penelitian adalah untuk menganalisis bentuk-bentuk wanprestasi, mekanisme penyelesaian sengketa, serta kendala hukum dalam pelaksanaan jaminan berbasis kredit. Penelitian ini menggunakan metode yuridis empiris yang memadukan analisis hukum normatif dan observasi lapangan. Populasi penelitian adalah seluruh anggota koperasi yang terlibat dalam perjanjian kredit, sedangkan sampel terdiri dari pengurus koperasi, debitur, dan penjamin yang dipilih dengan teknik purposive sampling. Data primer diperoleh melalui wawancara mendalam dan observasi, sedangkan data sekunder diperoleh dari peraturan perundang-undangan, literatur, dan penelitian terdahulu. Data dianalisis secara kualitatif menggunakan model interaktif yang menggabungkan interpretasi hukum dan analisis empiris. Hasil penelitian menunjukkan bahwa wanprestasi terjadi dalam empat bentuk, yaitu tidak melaksanakan prestasi, pelaksanaan tidak sesuai, keterlambatan pembayaran, dan pelanggaran klausul perjanjian. Penyelesaian sengketa lebih banyak dilakukan melalui jalur non-litigasi, sedangkan instrumen hukum formal seperti somasi, litigasi, dan eksekusi jaminan masih jarang digunakan. Kesimpulan penelitian ini menunjukkan adanya kesenjangan antara norma hukum dan praktik di lapangan yang dipengaruhi oleh rendahnya kesadaran hukum serta dominasi budaya kekeluargaan, sehingga efektivitas pelaksanaan jaminan belum berjalan optimal
