Abstract

The difficulty of finding a job with the level of education and low skills has its own problem in the society. It had an impact on changing the role of women. Not only required to perform internal functions as a wife, but also required to earn a living to support the family as a function of the external economy. One of the efforts that became Labor Women (TKW) as domestic workers in Saudi Arabia, because the income earned from the same job in the country is bigger. In addition they can also be all the pilgrimage (Haji), which will raise their social status in the community when they return to their homeland. This Study combine both qualitative and quantitative method. Results of this study indicatethat the use of their incomes as domestic workers in Saudi Arabia is 25% of the money they spend on the cost of daily living, 18% for renovating the house, 17% to pay off debt, 15% separately childrens school fees and his brother, 14 % for new businesses, and 11% is used to provide working capital loans to families. From this it can be seen that the presence of women who work as migrant workers contribute not only to his family but also to the siblings and other family aggota. In addition they are also able to address problems of families faced before leaving, which is to fulfill the needs of daily life arevery high, it is also a matter of debt that are not able to be paid by the family, and even some of them are capable of air over the business of the original only become laborers farmer and jobs that do not generate large revenues into efforts were quite promising

Abstract

The United Nations Declaration on the Rights of Peasants and Other Peoples Working in Rural Areas (UNDROP) recognizes and protects the dignity of peasants for their contributions to food production and climate change mitigation and adaptation. For Indonesia, signing UNDROP complements its international commitments to human rights and environmental protection, particularly climate change. Indonesia has ratified the Paris Agreement, which includes climate change mitigation in peat ecosystems as one of its agendas. At the regional level, Indonesia supports the ASEAN Human Rights Declaration and the ASEAN Transboundary Haze Agreement. The Indonesian government has established a zero-tolerance policy towards peatland burning. This policy has resulted in legal vulnerability for peasants who have a tradition of burning peatlands for agriculture. This article examines the influence of laws and policies to control forest and land fires as a form of climate change mitigation in protecting peasants' rights to food and a better environment. In particular, it discusses community-based and participatory approaches to peatland ecosystem restoration implementation in Indonesia and how they relate to the provisions of UNDROP. The research underpinning this article used a participatory legal research method involving the authors in policy making. The authors collected data and analysed laws and policies concerning peatland restoration and peasants' protection. The participatory observation was carried out on agricultural innovation practices and the legal empowerment of the peasants. This article concludes that although UNDROP is not used as a reference in forming peatland restoration policies, some activities have demonstrated the fulfilment of several UNDROP provisions Keywords: Climate change, peatland, peasants, right to food, UNDROP

Abstract

Law Number 3 of 2024, as an amendment to Law Number 6 of 2014, affirms the authority of village heads in resolving community disputes. This study examines the dispute resolution model in the Pulau Sewangi Village community, Barito Kuala Regency, South Kalimantan, which has a wetland-based cultural characteristic with communal life along the Barito River. The study used an empirical legal method with a socio-legal approach through interviews and field observations. The results show that the presence of the village head plays a central role in maintaining social harmony through non-litigation dispute resolution, which is more dominant than litigation. The settlement model implemented prioritizes deliberation based on local wisdom, which is directed at forms of mediation and conciliation. However, for certain cases that meet criminal elements, the village head coordinates with law enforcement officials towards the litigation process. Thus, the dispute resolution model in Pulau Sewangi Village reflects the synergy between formal legal approaches and local wisdom, which is relevant to the development of village governance based on wetland community culture.

Abstract

Penelitian ini berfokus perlindungan lahan basah yang ada di Kabupaten Hulu Sungai Utara Provinsi Kalimnatan Selatan. Di pilihnya lokasi di Kabupaten ini mengingat daerah Kabupaten HSU ini memiliki kawasan lahan basah yang sangat besar luasannya untuk wilayah provinsi Kalimantan Selatan ini. Berdasarkan konsep perlindungan hukum menurut ilmu hukum bahwa perlindungan bersifat preventif dan bersifat represif. Salah satu bentuk perlindungan hukum preventif (pencegahan ) adalah ketika konsep dan tujuan perlindungan diatur atau dituangkan dalam tataran peraturan peraturan hukum. Yang menjadi fokus penelitian tentang perlindungan hukum lahan basah ini di teliti tentang bagaimana pengaturan dan pemanfataan kawasan lahan basah di wilayah pedesaan  oleh pemerintah Kabupaten Hulu Sungai Utara dan tentang bagaimana implementasi perlindungan  terhadap lahan basah dalam pranata hukum Kabupaten Hulu Sungai Utara.Penelitian ini dilakukan dengan metode penelitian hukum normative dengan didukung data data empiris. Hasil Penelitian ini menunjukkan bahwa pemanfatan kawasan lahan basah ini dalam pengaturannya akan mengacu secara umum pada ketentuan kawasan dalam Perda tentang Tata Ruang, juga pengaturan yang terkait dengan perlindungan lingkungan. pemanfataan kawasan lahan basah di Kabupaten Hulu Sungai Utara ini dikembangkan untuk berbagai kegiatan yakni : Usaha transportasi/pengangkutan ( Transportasi sungai ),usaha pemeliharaan ikan  dan pengolahannya,usaha pertanian (untuk kawasan persawahan ),usaha wilayah/ tempat pengembangan Peternakan itik, kerbau,usaha pengembangan wisata (Kolam pemancingan ikan, wisata Lomba renang kerbau rawa) Implementasi perlindungan hukum kawasan lahan basah di kabupaten HSU Provinsi Kalimnatan Selatan dalam bentuk kegiatan pemanfataan kawasan lahan basah yang disesuaikan dengan potensi geografis kabupaten ini dan  penyusunan konsep perlindungan lingkungan lahan basah ini dituangkan dalam berbagai pranata hukum di kabupaten ini yakni dalam bentuk Peraturan Daerah dan Peraturan Bupati serta dalam pertauran desa
