Scientific writing, as delineated by its formal attributes, encompasses papers (for seminars or symposia), articles, practicum reports, theses, and dissertations, all of which fundamentally result from scientific endeavors. The facts, conclusions, and other information inside the scientific study serve as references for other researchers doing subsequent investigations or studies. Abstract

Based on Law Number 3 of 2024, an amendment to Law Number 6 of 2014 concerning Villages, it regulates the concept of a village as a legal community unit with certain territorial boundaries with the authority to regulate and manage its own government affairs. In carrying out village government led by the village head, one of the village head's obligations according to the law is to resolve disputes in the village community, this is stated in the provisions of article 26 of the law. This is interesting to research in socio-legal legal studies, especially in studies regarding dispute resolution models or village community disputes. These legal problems were analyzed based on empirical legal research methods by exploring field data based on interview techniques at the research location in Sewangi Island Village, Batola Regency, South Kalimantan Province. The research results show that the existence of a village head is very important in resolving disputes or disputes in village communities whose cultural characteristics are generally wetland-based, namely as communities on the banks of the Barito river, with a communal and traditional community culture. According to legal studies, the dominant form of dispute resolution is the non-litigation form of resolution. The dispute resolution model applied is a deliberative dispute resolution model which leads to a dispute resolution model towards Mediation and Conciliation, as well as directed coordination with law enforcement if it is resolved towards a Litigation process.

Abstract

The prevalence of child labor in Banjarmasin has significantly disrupted established interpretations of hadhanah under Islamic family law, exposing a complex intersection of doctrinal mandates, cultural expectations, and economic hardship. This study explored the extent to which child labor reconfigures custodial responsibilities and how local moral governance informs the ethical realignment of hadhanah within Banjarmasin’s socio-legal framework. Fieldwork was carried out in both urban and peri-urban settings across Banjarmasin, South Kalimantan, Indonesia, where child labor is not only widespread but often socially legitimized. Employing a qualitative methodology, the research gathered data through in-depth interviews, direct observations, and document review conducted between March and July 2025. Participants included working children, their families, religious authorities, community leaders, and judges from Islamic family courts. Data were interpreted using Creswell’s tripartite process of reduction, display, and verification. The findings demonstrate that economic pressures have redefined hadhanah, positioning children as economic actors in contexts traditionally defined by adult custodianship. In response, local actors mobilized culturally embedded ethical frameworks and religious values to resolve custody-related tensions, often compensating for inadequate formal legal interventions. The study concludes that hadhanah is undergoing a locally negotiated transformation, revealing the dynamic adaptability of Islamic legal norms and highlighting the potential for incorporating community-based ethics into state custodial practices.

Abstract

Law Number 3 of 2024, as an amendment to Law Number 6 of 2014, affirms the authority of village heads in resolving community disputes. This study examines the dispute resolution model in the Pulau Sewangi Village community, Barito Kuala Regency, South Kalimantan, which has a wetland-based cultural characteristic with communal life along the Barito River. The study used an empirical legal method with a socio-legal approach through interviews and field observations. The results show that the presence of the village head plays a central role in maintaining social harmony through non-litigation dispute resolution, which is more dominant than litigation. The settlement model implemented prioritizes deliberation based on local wisdom, which is directed at forms of mediation and conciliation. However, for certain cases that meet criminal elements, the village head coordinates with law enforcement officials towards the litigation process. Thus, the dispute resolution model in Pulau Sewangi Village reflects the synergy between formal legal approaches and local wisdom, which is relevant to the development of village governance based on wetland community culture.
