Abstract

There are several customers who apply for financing at BMT NU Kalitidu for reasons of meeting their consumptive needs and paying debts, actually the contract that must be used is a qarḍ contract, but because there is no qarḍ product at BMT NU Kalitidu, a mudārabah contract was chosen, which facilitates the collaboration process because they are accustomed to using Mudārabah financing in entering into an agreement. Two things that become problems are first, How is the practice of qarḍ financing with a mudārabah contract at BMT NU Kalitidu, and How is the Sharia Economic Law Review of the practice of qarḍ financing with a mudārabah contract at BMT NU Kalitidu. This research is a field research with the place of research at BMT NU Kalitidu. The data sources include primary data, namely observations and interviews, while secondary data is obtained from reference data sources such as books, journals, articles and others. The method of collecting data in this research is from observation, interviews, and documentation, while the method used to analyze the data is a qualitative. The results of the study are: First, qarḍ financing does not exist in BMT NU Kalitidu, then the need for funds for a consumptive item in BMT NU Kalitidu is the same as mudārabah financing. The provision of funds for consumptive needs with a mudārabah contract is inappropriate (not allowed) because the use of a mudārabah contract must be accompanied by work carried out by the customer with funds from BMT NU Kalitidu.

Abstract

Penelitian ini bertujuan memaparkan pandangan al-Qaradawi tentang hukum nikah misyar Kajian Analisis Kritis Prepektif Dhawabith Al-Maslahah Syekh Ramadhan AlButi. Rumusan masalah dalam penelitian ini, Pertama, Bagaimanakah al-Qaradawi menghukumi (berfatwa) tentang nikah misyar? Kedua, Bagaimanakah hukum nikah misyar menurut al-Qaradawi ditinjau dari perpektif dhawabith al-maslahah Ramadhan al-buti?. Implementasi dari penelitian ini adalah: pertama, Untuk mengetahui hukum nikah misyar menurut Yusuf al-Qaradawi, dan landasan fatwa hukum nikah misyar. Kedua, Untuk mengetahui dhawabith al-maslahah dalam syariat Islam dan aplikasinya terhadap problematika kontemporer, dalam hal ini problematika nikah misyar yang masuk dalam kategori problematika kontemporer. Ketiga, Kritik ilmiah terhadap fatwa al-qaradawi seputar hukum nikah misyar dengan menggunakan “dhawabith almaslahah” perspektif Ramadhan al-Buti sebagai pisau analisa. Hasil penelitian ini, pertama, Hukum nikah misyar menurut al-qaradawi adalah boleh akan tetapi makruh karena beberapa hal, salah satunya karena terpenuhinya syarat dan rukun dalam pernikahan. Kedua, Pandangan al-qaradawi ditinjau dari “dhawabith al-maslahah” dalam syariat Islam tidak bertentangan dengan hukum legal (fiqh) karena sempurnanya syarat dan rukun. Apabila ditinjau dari tujuan-tujuan syariat (maqosid syari’ah) terdapat pertentangan karena tidak adanya sakinah, mawaddah dan rahmat yang tidak bisa digapai kecuali dengan pernikahan syar’i dan umum. Ditinjau dari dhawabith (kriteria) ke lima dari dhawabith al-maslahah,yaitu “tidak adanya pertentantangan dengan maslahat yang lebih besar atau sejajar”, pandangan al-Qaradawi masih menjadi ranah perdebatan. Karena al-Qaradawi kurang memperhatikan masa depan anak-anak yang lahir dari pernikahan misyar berupa pendidikan, pengasuhan, arahan dan nasehatnasehat bagi mereka.

Abstract

Wakaf uang merupakan terobosan penting bagi umat Islam yang sesuai dengan prinsip hukum Islam demi menciptakan kesejahteraannya. Hal ini dicermati dengan lahirnya hukum positif seperti Fatwa Majelis Ulama Indonesia tanggal 11 Mei 2002. Undang-Undang Nomor 41 tahun 2004 tentang wakaf, dan Peraturan Pemerintah Nomor 28 Tahun 1977 sebagai bentuk penyempurnaan konsep wakaf yang terdapat dalam  Kompilasi Hukum Islam. Pelaksanaan wakaf produktif bukanlah suatu hal yang baru dilakukan karena dalam berbagai litelatur sejarah Islam sudah termaktub bahwa pada zaman Rasulullah SAW sudah terlaksanakan sesuai dengan prinsip hukum Islam.  Sebagaimana contoh wakaf produktif yang dilakukan oleh sahabat „Umar Ibn Khattab ketika mewakafkan sebidang tanah sebagai lahan produktif yang digunakan untuk kepentingan umat Islam pada waktu itu. Kajian dalam tulisan ini merupakan suatu penelitian yang akan diarahkan pada kajian fikih klasik dengan mengambil sejumlah pendapat utama dari ulama‟ empat madzhab, yakni Hanafi, Maliki, Syafi‟i, dan Hambali bersama para pengikutnya yang termaktub dalam kitab dan buku yang dapat memberikan deskripsi komparatif secara objektif.

Abstract

Sroyo merupakan salah satu desa yang berada di kecamatan Kanor, Kabupaten Bojonegoro, provinsi Jawa Timur, Indonesia. Sebelah utara berbatasan dengan Desa Drajat. Sebelah timur berbatasan dengan Desa Banjar Anyar. Sebelah selatan berbatasan dengan Desa Mejuwet, dan sebelah barat berbatasan dengan Desa Nglarangan. Walaupun letaknya di desa, namun desa Sroyo memiliki pasar Tradisional yang cukup terkenal di kecamatan kanor. Adanya letak geografis yang sangat strategis belum menjadikan icon bagi masyarakat Sroyo yang tergolong masih pasif dalam mengembangkan potensi yang dimilikinya. Atas dasar itu, peneliti ingin melakukan pendampingan terhadap ibu – ibu PKK Desa Sroyo yang berorientasikan pada peningkatan di bidang ekonomi melalui pelatihan produk olahan kripik Danong (daun nanga) dan olahan stick tempe serta pelatihan dan pemasaran dan pengemasan. Dalam melaksanakan pendampingan, peneliti mengadakan beberapa pelatihan dan kerja sama dengan home indutry Tempe, perangkat Desa dan ibu – ibu PKK. Begitu juga peneliti mengadakan seminar dalam rangka meningkatkan mengetahuan masyarakat dalam pemasaran dan pengemasan produk olahan.

Abstract

The basic concept of marriage in Islam is the formation of a family that is Sakinah mawadah Warahmah. However, due to a situation that requires husband and wife to be separated by distance, they are in a long-distance relationship (LDR). In a household, husband and wife have rights and obligations that have become normative law (legal norms) that need to be considered by all parties in the household, both husband and wife. This type of research is field research, namely research conducted directly into the field to obtain complete and valid data. Data collection techniques are interviews and documentation. This interview was conducted to obtain information by interviewing informants, interviews were conducted with pesantren kiai in Jember district. The research method used is a qualitative research method. Data collection in this study was carried out using interviews and documentation techniques. While the analysis technique used is descriptive qualitative analysis. The results of this study indicate that the factor that causes the Long Distance Relationship (LDR) phenomenon for married couples in Jember Regency is the factor of career demands, there are some migrants from outside Jember Regency who have the status of a wife leaving her husband to carry out their duties as servants of the state (PNS). , and vice versa. There is a difference of opinion among Islamic boarding school kiai, the first group argues that LDR is not permitted for a wife, meaning that a wife must always be by her husband's side because a wife cannot possibly carry out her obligations to serve her husband in the household at a distance. And this has deviated from maqasid marriage, namely the creation of harmony in the household. the second group allows LDR if in an emergency. For example, the goal of a wife or husband is to be away from their partner for the demands of family maintenance, the argument for this group is the rule of ushul fiqh addhorurot bodiul mahdzurat.

Abstract

Marriage is a religious call that must be carried out by humans for those who can afford to have a family. Everyone who wants to get married definitely wants smoothness in the procession of the marriage contract and smoothness in their household life. In this case the authors took samples in Wedi Village, Kapas District, Bojonegoro Regency. For some people in Wedi Village, the use of weton calculations in marriage is mandatory.The main question to be answered in this research is: How is the practice of determining the time of marriage in Wedi Village, Kapas District, Bojonegoro Regency, 'Urf Perspective?To answer this question, this research uses a normative juridical approach, where this research is often called doctrinal research, where the data used are secondary data sources. The process starts from the premises in the form of known positive legal norms and ends with the discovery of legal principles which are the starting point for the search for positive legal norms. Or in short, the method of normative juridical approach is an approach that examines secondary data in the field of law that exist as library data. Based on the results of research in the field, the practice of marriage in Wedi Village, Kapas District, Bojonegoro Regency is to use the weton calculation to determine whether the two prospective brides are matched or not. If based on the results of the weton calculation it turns out that they are matched, then the next step is to determine the day, date, month and hour of the contract also using the weton calculation. The factors behind the practice of determining and calculating the time for marriage in Wedi Village, Kapas District, Bojonegoro Regency are the reasons for not violating religious teachings, the reasons for customary calls, reasons for obligations and considerations of neptu, safety reasons, reasons for events that have occurred and reasons for preservation to generations. The custom that has been formed so far turns out to be in accordance with and absorbed by the rules of 'Urf. Thus, this shows that the determination of the wedding day in Wedi Village, Kapas District, Bojonegoro Regency is 'Urf valid.

Abstract

ABSTRACTMarriage in the period of ' iddah is a rare phenomenon. However, in some areas such marriages often occur, such as in Gunung Malang Village, Jember. In this case the perspective of radical feminism is used to provide an objective assessment . The purpose of this study was to determine the factors behind the husband and the wife carry out the marriage age ' iddah which occurred in the village of Gunung Malang and analyzing the views of religious leaders and the public about the mating period ' iddah in villages that Kate Millett's radical feminism perspective .The approach used in this study is a descriptive-qualitative approach to feminism with the type of field research.Results of research 1. Some factors behind the occurrence of marriage ' idda that occurred in the village of Gunung Malang d iantaranya are economic factors , tradition (long-term ' iddah died one hundred days ), understanding of religion mini m, emotional concerns that women will be the status of widows , internal environment ( family ), and external environment (a decision from the men to women to get married ) . 2. The existence of institutions that support patriarchal culture, including ideological , social classes, economics and education , psychology , and sociology. Can be analyzed that in practice, marriage period 'iddah actually supports the culture of the patriarchy with the existence of these five institutions. Abstract

Since the time of the Prophet Muhammad, mosques have been the center of Muslim activities. Even though the meaning of the word is that a mosque is a place of prostration to Allah SWT, history shows that mosques are not only used for ritual activities. In the long course of Islamic history, it can be said that mosques also played a significant role in the development of Islamic civilization. Therefore, in rebuilding Islamic civilization, which is able to spread grace to the surrounding environment, it is basically a center for Muslim activities. The mosque is located in a remote village, on a mountain slope far from the crowds. The majority of the population are advanced farmers who earn good incomes. Even though the average citizen has low education, most of them are Islamic boarding school alumni with strong religious basics. The population in this hamlet is dominated by adults and the elderly. Assistance through Community Development using the PAR (Participatory Action Research) method and theoretical concepts, is expected to be able to provide contributions, benefits and changes that are expected to occur in terms of the prosperity of the mosque and the realization of a religious, ideal and harmonious community life. companions include: First, the existence of new mosque takmir management. This is related to the management of the management structure and the congregational prayer imam's schedule. Second, changes in residents' awareness of the existence of flowing water sources that can be utilized and managed together in a cooperative manner. Third, changes in the attitudes of young people in Paleran hamlet towards self-confidence for a more advanced life. This is characterized by their more active role in every activity. It is no longer awkward and reluctant to get involved directly in helping, even though you are still not able to be independent (still based on instructions). Fourth, change towards social change that upholds solidarity (togetherness) between residents to build a proper ablution place in the mosque where they worship.

Abstract

One of the various reasons underlying the breakdown of a marriage is the departure or disappearance of the husband from the wife (mafqud). The issue of a husband's mafqud is a complicated and difficult problem because of course the absence or disappearance of a husband can cause misery to the people left behind who are his responsibility, especially his wife. On the issue of a husband's mafqud, each mujtahid has a different view. Imam Maliki and Imam Syafii are among those who have different views on this case. Therefore, in this research we will discuss what is the opinion of the Imam Maliki School regarding mafqud husbands and their marital status?, and what is the opinion of the Imam Syafii School regarding mafqud husbands and their marital status? The purpose of writing this thesis is to find out what the Imam Maliki School thinks about mafqud husbands and their marital status, as well as to find out what Imam Syafii Mahab thinks about mafqud husbands and their marital status. The type of research used in this thesis is qualitative research in the form of a library review, the primary data source is the books al-muwwatha' and al-Umm, while the secondary data sources are al-Fiqh Wa Adillatuhu, Bidayah al-Mujtahid Wa Nihayah al -Mustaqhid, Fiqh al-Sunah, al-Muhazab, al-Muntaqa Syarakh al-Muwwatha', Qawain al-Fiqhiyah, Munakahat fiqh books, Al-Qur'an translated by the Department of Religion, journals, and other appropriate literature with research themes.

Abstract

This research will focus on the study of KHR Thought. As'ad Syamsul Arifin on the State System and the System of Government in Islam which is stated in the form of Acceptance of the Single Principle of Pancasila. This study wants to answer First; how does KHR think. As'ad Syamsul Arifin on the State System and the System of Government in Islam. Second; how KHR thinks. As'ad Syamsul Arifin about accepting Pancasila as a Single Principle. Methodology This research uses qualitative research with a conceptual and historical approach. Primary data sources are the book al-ahkam as-Sulthoniyah and the book Biography of KHR. As'ad Syamsul Arifin, MUnas ALim Ulama' Situbondo Document in 1983. The data collection technique in this study is documentation. Meanwhile, the data analysis technique carried out in this study is descriptive-interpretive. The results of this study show that KHR Thinking. As'ad Syamsul Arifin on the State System and the System of Government in Islam which is stated in the form of Acceptance of the Single Principle of Pancasila. KHR's thoughts. As'ad Syamsul Arifin on the State System and the System of Government in Islam was obtained comprehensively and completely from his contact with Hadlrotus Shaykh KH. Hasyim Asy'ari, as well as his real work in defending and contributing to the nation's journey. Standing as a Fighter for the Jihad Resolution, against the Japanese, taking part as a Constituent Member, Fighting against the PKI, and directly involved as a Politician. Meanwhile, KHR's thoughts. As'ad Syamsul Arifin about accepting Pancasila as a Single Principle is the culmination of his thoughts on the State System and the System of Government. According to Kiai As'ad, the first precept of Pancasila is a reflection of the teachings of monotheism in Islam. Not stopping here, Kiai As'ad boldly presented his views and direct criticism to President Soeharto who wanted to make Pancasila a tool to generalize the truth of all religions. This research contributes to strengthening the mapping of the role and contribution of Kiai Pesantren in the concept of the State and the Government system. The research has not reached the aspect of KHR thinking. As'ad Syamsul Arifin which is outlined in works/books/manuscripts.
