Abstract

Comparison Of The Requirements For Candidate For President And Member Of House Of Representative In The Election Law (Based On The Perspective Of Pancasila). Ideally, the President and House Of Representative are free from nepotism, collusion and corruption in accordance with Law No. 28 of 1999 concerning State Adinistrators Who Are Clean And Free From Corruption, Collusion And Nepotism. However, Law No. 7 of 2017 concerning General Election imposes different conditions between candidate for President and member of House Of Representative. Former corruptors are prohibited from running for President, but can run for the member of House Of Representative on condition that they announce their status as convicted of corruption. This normative juridical research will analyze the unequal requirements of candidate for President and members of House Of Representative, while the positions for the state institutions are equal. The conceptual approach is used to analyze the requirements of candidate for President and members of House Of Representative. Primary legal materials collected through library research include statutory regulations. Furthermore, extensive and systematic (logical) interpretations are used to analyze requirements of candidate for President and members of House Of Representative in various laws and values of Pancasila.

Abstract

AbstractAct No. 40 of 2007 on Limited Liability Company is precisely change the character of voluntarily to be mandatory, and leads to a confusion between the meaning of responsibility and liability in the TJSL. TJSL can be interpreted differently so it needs to be synchronized. This normative study used the Stufentheorie (by Hans Kelsen) and die Theorie der vom Stufentordnung Rechtsnormen (by Hans Nawiasky), systematiche interpretatie or dogmatische interpretatie, conceptual approach and statute approach, as well as vertical and horizontal synchronization TJSL to interpretation in a variety of legislation. The concept of TJSL can be found in 13 (thirteen) acts, four (4) government regulations, one (1) East Java Provincial Regulation, 1 (one) Regulation of the Governor of East Java, 14 (fourteen) Regional Regulation Malang, and four (4) Regulations governing Mayor of Malang, relating to social and environmental responsibility of companies.Key words: interpretation, social responsibility, local regulations AbstrakUU No. 40 Tahun 2007 tentang Perseroan Terbatas merubah sifat voluntarily dari CSR/TJSL menjadi mandatory. Hal ini menyebabkan terjadi kerancuan makna antara responsibility dan liability dalam TJSL. Konsep TJSL dapat ditafsirkan berbeda sehingga perlu dilakukan sinkronisasi terhadap penafsirannya. Dalam penelitian yuridis normatif  ini digunakan Teori Jenjang Norma (Stufentheorie) dari Hans Kelsen dan Teori Jenjang Norma Hukum (die Theorie vom Stufentordnung der Rechtsnormen) olehHans Nawiasky, Metode Tafsir Sistematik (systematiche interpretatie/dogmatische interpretatie), Pendekatan statute approach dan conceptual approach, serta sinkronisasi vertikal dan horizontal terhadap penafsiran TJSL dalam berbagai peraturan perundang-undangan. Konsep TJSL dapat ditemukan pada 13 (tiga belas) perundang-undangan, 4 (empat) Peraturan Pemerintah, 1 (satu) Peraturan Daerah Propinsi Jawa Timur, 1 (satu) Peraturan Gubernur Jawa Timur, 14 (empat belas) Peraturan Daerah Kota Malang, serta 4  (empat) Peraturan Walikota Malang yang mengatur kinerja perusahaan yang berhubungan dengan tanggung jawab sosial dan lingkungan perusahaanKata kunci: penafsiran, tanggung jawab sosial, peraturan daerah

Abstract

 AbstractFive years after the enactment of National Social Security System Act (UU SJSN), President Susilo Bambang Yudhoyono still not approved Social Security Agency Act (UU BPJS) as required by previous law. As government neglect these, 120 (one hundred twenty) citizen filed the law suit to the Central Jakarta District Court (PN Jakarta Pusat) by case No. 278/PDT.G/2010/PN.JKT.PST. Based on the tort, PN Jakarta Pusat punished the Government. Against the decision, President Susilo Bambang Yudhoyono appealed to Central Jakarta District Court (PT DKI). By decision No. 404/PDT/2012/PT.DKI, PT DKI canceled decision of the PN Jakarta Pusat. By using case approach, this normative research compares and analyzes both decisions and try to understand the judges’ ratio decidendi (reason). This paper aims to show the contradictions between decision of PN Jakarta Pusat and PT DKI. The judges of PN Jakarta Pusat had made law finding and progressive decision by punished the government because of the tort (ignorance of the social security as the citizen’s constitutional right). In the opposite, the judges of PT DKI prefers legal formal aspects, and ignore the substance of justice for citizens which had been made by the judges of PN Jakarta Pusat. AbstrakLima tahun setelah UU No. 40 Tahun 2004 tentang  Sistem Jaminan Sosial Nasional diundangkan, Presiden Soesilo Bambang Yudhoyono tidak segera mengundangkan Undang-Undang Badan Penyelenggara Jaminan Sosial (UU BPJS) sebagaimana yang disyaratkan oleh UU SJSN. Terhadap pengabaian pemerintah tersebut, 120 (seratus dua puluh) orang WNI mengajukan gugatan citizen lawsuit kepada PN Jakarta Pusat dengan perkara No. 278/PDT.G/2010/PN.JKT.PST. Hakim PN Jakarta Pusat menyatakan Pemerintah telah lalai tidak melaksanakan UU SJSN sekaligus menghukum Pemerintah. Terhadap putusan tersebut, Presiden Susilo Bambang Yudhoyono mengajukan banding. Dalam putusan No. 404/PDT/2012/PT.DKI, hakim PT DKI membatalkan Putusan PN Jakarta Pusat tersebut.  Penelitian yuridis normatif ini membandingkan dan menganalisis perbedaan kedua putusan tersebut, dengan pendekatan kasus (case approach) dan memahami ratio decidendi (reason) hakim PN Jakarta Pusat dan PT DKI. Tulisan ini bertujuan menunjukkan kontradiksi putusan PN Jakarta Pusat dan PT DKI. Hakim PN Jakarta Pusat telah membuat penemuan hukum (rechtvindig) melalui putusan yang progresif dengan menyatakan Pemerintah telah lalai tidak melaksanakan UU SJSN sekaligus menghukum Pemerintah untuk segera melaksanakan UU SJNS dengan langkah-langkah konkret. Sebaliknya hakim PT DKI yang membatalkan putusan PN Jakarta Pusat tersebut hanya mempertimbangkan aspek legal formal saja karena terfokus pada kewenangan mengadili PN Jakarta Pusat dan mengabaikan substansi keadilan bagi warga negara yang telah diputus oleh PN Jakarta Pusat.

Abstract

Penerapan e-government di Indonesia juga berdampak pada sistem perizinаn, pendaftaran maupun pembubaran suatu Badan Usaha di Indonesiа pun menjаdi berubаh yаng mаnа perubаhаn tersebut sаlаh sаtunyа mengenаi pendаftаrаn CV di Indonesiа. Perubаhаn yаng dimаksud adalah mekаnisme dаri Sistem Аdministrаsi Bаdаn Usаhа dalam Ditjen Adminstrasi Hukum Umum dаlаm melаyаni pendаftаrаn badan Usaha salah satunya adalah CV di Indonesiа yаng mаnа melаlui Sistem Аdministrаsi Bаdаn Usаhа sesuai dengan Permenkumham Nomor 17 Tahun 2018. Artikel ini bertujuan untuk mengаnаlisis kedudukаn Perаturаn Menteri Hukum dаn Hаk Аzаsi Mаnusiа Nomor 17 Tаhun 2018 tentаng Pendаftаrаn Persekutuаn Komаnditer, Persekutuаn Firma, dаn Persekutuаn Perdаtа terhаdаp Kitаb Undаng-Undаng Hukum Dаgаng sesuаi dengаn hierаrki Peraturan Perundаng-Undаngаn di Indonesiа , аkibаt hukum bаgi pendаftаr аtаu pemilik Persekutuan Komanditer yаng tidаk mendаftаrkаn Persekutuan Komanditer nyа pаdа Sistem Аdministrаsi Bаdаn Usаhа dаlаm jаngkа wаktu yаng telаh ditentukаn. Serta kepastian hukum pendaftaran Persekutuan Komanditer Melalui Sistem Administrasi Hukum Umum dikaitkan dengan Undang-Undang Informasi dan Transaksi Elektronik. Artikel ini termasuk penelitian hukum normatif dengan Pendekatan Perundang-Undangan Dan Pendekatan Konseptual serta menggunakanTeknik Analisis Data Dengan Logika Deduktif. Hasil Penelitian ini menunjukan bahwa ketentuan didalam Permenkumham Nomor 17 Tahun 2018 bertentangan dengan ketentuan didalam KUHD, menimbulkan beberapa akibat hukum bagi pelaku usaha yang tidak mendaftarkan Persekutuan Komanditernya pada Sistem Administrsi Badan Usaha, serta adanya keterkaitan antara Pendaftaran dalam Sistem Administrasi Badan Usaha dan UUITE yaitu adanya pengakuan secara tegas didalam UUITE terutama mengenai adanya tanda tangan elektronik didalam Surat Keterangan Terdaftar.

Abstract

The formation of legal products in the regions cannot be separated from the preparation of academic texts as the basis for their formation. However, the existence of alternative explanations/information as a substitute for academic texts has caused legal products at the regional level not to fully use academic texts. Based on this, it is necessary to elaborate on the urgency of academic papers in the formation of legal products at the regional level. In addition, further explanation regarding the mechanism for implementing academic papers in the formation of legal products at the regional level is the main research objective. The research method used in research is normative legal research or doctrinal legal research which bases arguments on theories, principles, concepts, and laws and regulations. The selection of the normative method is based on the existence of legal issues regarding the blurring of norms regarding the regulation of academic texts in the formation of legal products at the regional level. An explanation of this can only be obtained by conducting a doctrinal study. The results of the research lead to the conclusion that academic papers are needed as guidelines in drafting legal products at the regional level. Implementation of academic drafting should be carried out in the pre-legislative stage by identifying problems in society and elaborating them theoretically so that solutions can be formulated as outlined in the draft legal products at the regional level. The preparation of academic manuscripts also requires collecting data through interviews, observations, and literature studies to find solutions to problems in society. These results then go through a dissemination process in the form of FGDs with community representatives and parties related to the regional regulations that will be formed.

Abstract

As a based on law state, Indonesia is demanded to be able to construct justice for citizens, through legal regulation. The constitution as the highest legal regulation contains basic norms that guarantee the rights of citizens, determine and divide state institutions’ structures, and limits their duties. The Indonesian constitution, which has been amended four times, can be said to be imperfect. By comparing the state's legal requirements and the pattern of distribution of power in the Egyptian Constitution, Indonesia, and Egypt have similarities in pattern for the formation of a state, which begins with the birth of a nation that lives in a certain territory, so that they have the political awareness be on one’s own and have a common will in forming their respective government systems. Meanwhile, the difference lies in the pattern of distribution of power and check and balance practices, where the power given by the constitution to the President of Egypt is greater than the others. In addition, it is also necessary to recognize the forms of application of the theory of social contract and the theory of consent of governed in both constitutions.
