Abstract

South Kalimantan is not only rich in natural resources, but also rich in culture and religious values. This study aims to describe the local cultural traditions and Islam associated with the activity of "diamond" gemstone panning, which is one of the natural resources of South Kalimantan, as well as to examine the cultural changes in the diamond panning tradition. The research method used is a qualitative ethnographic method. Data analysis from observations, interviews and documents from diamond panners was conducted using Miles and Huberman's interactive model. The results showed that the local and Islamic cultures of the Banjar people were found before panning, during panning and after panning diamonds. Local culture such as visiting thieves, maintaining abstinence and speech (pamandiran) and Islamic culture such as visiting the pious, reading prayers, reading shalawat, faith, patience and tawakkal. Some of these traditions have changed, especially in the local culture, including the tools used for panning. Social change in panning activities is an evolutionary change where the shift in cultural traditions occurs slowly to adapt to internal and external factors so that the balance of the social system is maintained where malim, pious people, bosses/capital owners, panners perform their duties according to to their functions for the sustainability of panning activities. Abstract

This study examines the optimization of societal fiqh understanding within the Banjar community, focusing on the bahilah practice related to the payment of fidyah for missed prayers and fasting by the deceased in the Pahuluan community, South Kalimantan. The purpose of this research is to analyze how bahilah—a local tradition for fulfilling religious obligations for the deceased—is conducted and to understand its legal implications within the framework of Islamic law. The research employs a qualitative approach, utilizing observation, in-depth interviews, and document analysis. Data was collected from the Pahuluan community to gather primary insights into the practice of bahilah and the challenges faced by heirs in fulfilling fidyah obligations. The findings indicate that the practice of bahilah often involves the use of the concept of hilah (legal stratagem) to ease the burden on the heirs. However, this practice also raises issues, such as the validity of fidyah payments when the recipients do not meet the criteria of being impoverished, and the execution of grants that do not always comply with the essential requirements of Islamic law. The implications of this study highlight the need for increased community understanding of the proper implementation of bahilah in accordance with Islamic legal principles, as well as the necessity for oversight and guidance from religious scholars or authorities to ensure that this tradition aligns with the applicable Sharia regulations.

Abstract

ABSTRACT: Support is a wife's right that must be provided by the husband when marriage occurs, even when a divorce occurs, the husband still has several obligations related to support for his wife. However, the reality in Indonesia is that there are dynamics in fulfilling a wife's living in a divorce. That's why this research will describe these dynamics indicates a change in perspective is an integration between fiqh and the Indonesian context that supports strengthening women's rights in Indonesia. This research is a literature study by reviewing a number of fiqh literature and a number of regulations in Indonesia related to the problem under study as well as reviewing existing previous research. The findings in this research show that there has been a dynamic of wives' livelihoods in contested divorces in Indonesia, starting from the absence of clear regulations either in Law Number 1 of 1974 concerning Marriage or the Compilation of Islamic Law to strengthening women's rights which are supported by jurisprudence. as well as the birth of several Supreme Court Circular Letters. Keywords: dynamics, wife's maintenance, divorce lawsuit ABSTRAK: Nafkah merupakan hak istri yang wajib diberikan oleh suami ketika terjadi perkawinan, bahkan ketika terjadi perceraian-pun suami masih mempunyai beberapa kewajiban yang terkait dengan nafkah kepada istrinya. Akan tetapi kenyataan di Indonesia ada dinamika dalam pemenuhan nafkah istri dalam cerai gugat. Karena itulah penelitian ini akan menggambarkan dinamika tersebut yang menunjukkan adanya perubahan cara pandang yang merupakan integrasi antara fikih dengan konteks Indonesia yang mendukung kepada penguatan hak-hak perempuan di Indonesia. Penelitian ini merupakan studi literatur dengan menelaah sejumlah literatur fikih dan sejumlah peraturan-peraturan di Indonesia yang terkait dengan permasalahan yang diteliti serta menelaah penelitian terdahulu yang sudah ada. Temuan dalam penelitian ini menunjukkan bahwa telah terjadi dinamika nafkah istri dalam cerai gugat di Indonesia yang dimulai dari belum adanya pengaturan yang jelas baik dalam Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan ataupun Kompilasi Hukum Islam sampai kepada penguatan hak-hak perempuan yang didukung dengan yurisprudensi serta lahirnya beberapa Surat Edaran Mahkamah Agung. Abstract

Background: The customary and Islamic traditions that color Banjar diamond craft activities contain noble and important values in character formation in Islamic education. Objective: This research aims to examine Banjar diamond crafts, both in the activities of diamond panning and polishing, by exploring local and Islamic customs and the character values contained there in and analyzing them from the perspective of Islamic educational philosophy. Method: This research uses a qualitative method with an ethnographic approach. Data collection was conducted through observation, interviews, and triangulation with Banjar diamond miners and polishers. Result: The research results show that there is three dimensions of harmonization of custom and Islam in Banjar diamond crafts, namely the dimensions of religious practice, work ethics, and local wisdom. The three dimensions of harmonization of custom and Islam are relevant to character education as follows. First, religious practice forms the character of piety, obedience to worship, spiritual awareness that efforts must be intended as worship, responsibility, sincerity and gratitude as important elements in the dimension of religious character. Second, work ethics forms the character of hard work, resilience, honesty, and responsibility, as well as diligence, perseverance, tenacity and patience as the development of persistent and integrity character. Third, local wisdom forms the character of respect for tradition, cooperation, tolerance, civilization, and a strong cultural identity. Conclusion: The overall practice of harmonization of custom and Islam in diamond crafts from the perspective of Islamic Educational Philosophy, both perennially and essentially, strongly shapes the character of Banjar society. Harmonization between custom and Islam in Banjar diamond crafts is a manifestation of local wisdom as well as a primary source in character education. Thus, this study enriches the literature on character education, cultural education, and also the philosophy of Islamic education.

Abstract

Penelitian ini mengkaji persoalan hukum penggunaan duff (rebana) di dalam masjid, sebuah isu yang berada pada persimpangan antara ekspresi seni dan praktik ibadah dalam Islam. Meskipun seni merupakan fitrah manusia dan dapat berfungsi sebagai sarana kebaikan, penggunaannya dalam ruang sakral seperti masjid memunculkan perbedaan pandangan di kalangan ulama. Fokus penelitian ini adalah menganalisis dan membandingkan pandangan Imam Jalaluddin al-Suyuthi dan Imam Ibnu Hajar al-Haitami mengenai legalitas menabuh duff di masjid. Dengan metode studi literatur komparatif, penelitian menelaah karya-karya klasik kedua ulama dan literatur fikih terkait untuk mengidentifikasi dasar argumentasi, dalil syar‘i, serta batasan-batasan yang mereka tetapkan. Hasil analisis menunjukkan bahwa Imam al-Suyuthi mengharamkan penggunaan duff di masjid sebagai bentuk penjagaan kesucian dan ketenangan tempat ibadah, berpijak pada prinsip sadd al-dzarī‘ah (menutup jalan menuju kemudaratan). Sebaliknya, Imam Ibnu Hajar al-Haitami membolehkan penggunaan duff selama tetap menjaga adab, karena melihat adanya maslahat seperti sarana dakwah dan penguat ukhuwah, selaras dengan pendekatan tahqīq al-masālih. Penelitian ini memberikan kontribusi dalam memperluas pemahaman terhadap keragaman pendapat dalam fikih, sekaligus mendorong sikap bijak dan toleran dalam menyikapi perbedaan, sehingga praktik keagamaan dapat dijalankan dengan landasan ilmiah yang kuat dan penuh hikmah.

Abstract

Divorce in marriage is the untying of the knot that binds husband and wife in order to break and terminate their connection. However, divorce in practice contains a concept that may not be consistent with the rules of the Qur'an and Sunnah. This work employs an empirical research approach (Field research) or seeks sources of research data by conducting direct interviews with informants in the field linked to the subject under investigation. The findings of this study indicate that the Banjar community's understanding of divorce utterances is based on the meanings contained in the pronunciations spoken by husbands to their wives, namely the meanings of divorces, which are primarily based on the Syafi'iyyah school of thought and are consistent with the kitabun nikah written by Shaykh Arsyad al-Banjari about the many pronunciations and fall of divorce.
