Abstract

The intrusive character inherent in international trade agreements makes the particular form of the treaty unique compared to other treaties. The trade agreements' intrusiveness means the treaty impacts individual rights relatively more than other treaties on its implementation. Confirming such a particular character, the Indonesian Constitutional Court, via its Decision No. 13/PUU-XVI/2018, provides additional criteria for the treaty ratified through an act, in addition to the general forms of treaties. This study comprehensively discusses the consistency of the instrument form and the clarity of the reference regulations related to the procedure for ratifying the international trade agreement in Indonesia after the ruling of the 2018 Constitutional Court Decision. This study uses a normative juridical approach by making a library of data covering principles, laws, and regulations or legal theories relevant to research as the main material. The study shows that Constitutional Court Decision No. 13/PUU-XVI/2018 has allowed the international trade agreement to be ratified consistently using a legislative act replacing the past practice of using a presidential act. Moreover, the provisions on international trade agreements ratification under Indonesian trade law and Indonesian treaty law must be enforced using "lex specialis derogat lex generalis" principle. Although they share the same norms after the Constitutional Court's Decision 13/2018, specific provisions under the trade law prevail over the general provisions of the Indonesian treaty law.

Abstract

Law Number 27 of 2022 concerning Personal Data Protection (UU PDP) has directly mandated the establishment of a data protection authority which determined by the President. The LPPDP has projected to become an authority that acts as a supervisor and law enforcer for personal data protection in Indonesia, the LPPDP must be able to perform its functions, duties, and authorities independently. The several DPA forms can be considered to establish LPPDP in Indonesia. This journal article examines the necessity of establishing DPAs as an essential component in strengthening personal data protection laws in Indonesia through a comparison of law and practices in Hong Kong and Singapore. The research utilizes a comparative normative approach with descriptive-analytical specifications, comparing the mechanism of the supervisory authority and positive laws related to privacy and personal data protection in Hong Kong and Singapore. This study has resulted in several results: First, the existence of an independent LPPDP will strengthen the personal data protection law effectively and comply the adequate level of protection with other developed countries. Thus, the President must immediately establish LPPDP regarding the minimum requirements for the DPA's establishment in international practice. Second, there are several recommendations that can be applied in establishing the formation of LPPDP, whether in the form single supervisory authority or ministry based-models.

Abstract

Throughout 2020, the People's Republic of China (PRC) stated that the United States (US) manipulated the electronic identity code of its military aircraft (transponder code) over the South China Sea by using the identity of a civilian aircraft to carry out reconnaissance missions. The discussion of the incidents has faded in the past two years, even being regarded by some observers as a 'common' practice having been used since the Cold War era by the US. These incidents have never been heard to reappear in the South China Sea situation. However, the escalation of reconnaissance practices heated up again after a PRC's high altitude balloon was shot down by a US fighter jet over the US's territorial sea on February 4, 2023. The US had claimed that the aircraft was on a spy mission. This incident could be a starting point for the US to resume the practices throughout 2020 by imprisoning civilian aircraft in the South China Sea or even on the PRC's mainland because this practice is considered 'common' on the US side. By using the international legal research method, in which international legal sources are juxtaposed with the current context in the field, this article concludes that the practice of manipulating civil transponder codes cannot be justified as a 'common' practice because it is endangered the civil aviation and contrary to the Chicago Convention 1944.

Abstract

The topic of liability under international law falls in the norms of the Outer Space Treaty 1967 and the Liability Convention 1972. The principled division of responsibility for harm incurred by a space object to the launching state(s) is the starting point in this regard. Since the conventions are legally binding for Indonesia, it become the outlining frame for regulating space insurance with national regulations. As small satellite industry and space insurance in Indonesia show a massive potential grow, this article focuses on the analytical explanation of Indonesian space insurance-related regulations covering small satellite operations. Even though international law does not require obligatory space insurance, Indonesian Space Act 2013 regulates mandatory requirement for all space activities conducted by private companies, including small satellites. One of the main issues discussed in this paper is whether the Indonesia regulation open opportunities to space insurance industry in Indonesia to grow. The study was conducted using descriptive-analytical approach, emphasizing on the normative juridical approach by literature studies.

Abstract

Flight Information Region (FIR) is an essential part of the aviation sector, providing air navigation and alerting services crucial for ensuring flight safety. States may delegate the management of FIR services to other nations for various reasons, primarily centered on aviation safety. However, such delegation requires careful consideration due to its potential impact on a state’s airspace sovereignty. This study focuses on the most recent FIR delegation involving the realignment of FIR over the Riau and Natuna Islands between Indonesia and Singapore in 2022. According to the signed agreement, Indonesia is obligated to delegate the management of specific areas of the Natuna FIR above its territory to Singapore. While this delegation poses potential challenges related to Indonesia's national security and economic interests, additional issues arise from the legal instrument chosen by the Indonesian government to ratify the agreement. The objective of this research is to analyze the sovereignty and ratification issues for Indonesia arising from the signing of the Indonesia-Singapore FIR Agreement 2022. The study utilizes normative legal analysis with a juridical approach. The findings indicate that the delegation of the Natuna FIR to Singapore has restricted Indonesia's right to exercise sovereignty over its airspace. Furthermore, the study concludes that Indonesia’s instrument of ratification for the Indonesia-Singapore FIR Agreement 2022 is inconsistent with Indonesian law and practice. This research contributes to understanding the legal implications of FIR management delegation, emphasizing the importance of aligning such agreements with domestic legal frameworks.DOI: https://doi.org/10.22304/pjih.v11n1.a1

Abstract

As a prerequisite to enter into the digital economic system, the government should be able to guarantee and secure public trust in online transactions and communications.  At the same time the need arise to secure and protect privacy and personal data. The author, utilizing a juridical normative or dogmatic approach,discusses the issue how the Indonesian government should provide better and more reliable protection of privacy and personal data. Notwithstanding the existence of a number of rules from different Acts which provides for such protection, these are considered not sufficient in providing certainty in the digital era. The authors main argument is that a legal instrument providing privacy and personal data protection should fulfil three criteria: (1) possessing international character; (2) protecting privacy and personal data as a positive right; and (3) function to co-relate individual to the economic community as such.

Abstract

Praktik penggabungan bandar udara militer-sipil (civil enclave) sudah sejak lama diinisiasi Indonesia, terutama penggunaan pangkal udara militer sebagai perintis di area dengan aksesibilitas darat atau laut yang terbatas. Sebagai landasan pembangunan suatu bandara, Indonesia telah memiliki Peraturan Pemerintah Republik Indonesia Nomor 40 Tahun 2012 tentang Pembangunan dan Pelestarian Lingkungan Hidup Bandar Udara (selanjutnya disebut PP No. 40 Tahun 2012). Namun, apabila dihubungkan dengan bandar udara sipil-militer, terdapat permasalahan hukum yakni tidak adanya norma pengaturan khusus yang secara tegas mengatur bandara berjenis civil enclave di dalam peraturan tersebut, khususnya mengenai aspek pelestarian lingkungan hidup. Dengan demikian perlulah dikaji mengenai kompatibilitas aturan mengenai pelestarian lingkungan hidup dalam PP No. 40 Tahun 2012. Penelitian yang telah dilakukan penulis menyimpulkan bahwa aturan-aturan dalam PP Nomor 40 Tahun 2012 masih dapat diimplementasikan dalam bandara udara sipil-militer.
