Abstract

Dalam era industri 4.0 saat ini ekonomi kreatif berbasis kekayaan intelektual sangat berkembang pesat dan sekaligus menjadi tumpuan ekonomi Indonesia. Saat ini, siswa SMA khususnya SMA Negeri 8 Bandung merupakan tumpuan bangsa di masa yang akan datang, kreativitas yang dihasilkan dari ekstrakurikuler membuat banyaknya potensi kekayaan intelektual. Siswa siswi SMA Negeri 8 Bandung sangat kreatif dan inovatif dalam menyelenggarakan aktivitas baik yang termasuk di dalam kegiatan belajar mengajar maupun kegiatan ekstra-kurikuler. Mareka telah memiliki pengetahuan awal mengenai kekayaan intelektual namun belum dapat mengelompokkan potensi-potensi pelindungan kekayaan intelektual berdasarkan karya yang dihasilkan. Kegiatan pengabdian pada masyarakat ini bertujuan untuk meningkatkan pemahaman tentang hukum kekayaan intelektual di lingkungan SMA Negeri 8 Bandung seiring dengan industri 4.0 sehingga dapat mendukung ekonomi digital.Mengingat pandemi Covid-19 yang saat ini masih terjadi juga di Jawa Barat termasuk Kota Bandung, metode yang digunakan dalam pengabdian pada masyarakat saat ini adalah paparan dalam jejaring (daring). Hasil yang diharapkan diperoleh yaitu karya kreatif dan inovatif siswa SMA Negeri 8 Bandung berupa karya cipta, merek, paten, desain industri, desain tata letak sirkuit terpadu, rahasia dagang, perlindungan varietas tanaman dapat dimanfaatkan dalam era industri 4.0 dalam mendukung ekonomi digital.

Abstract

Privacy, as a part of Human Rights, is the right of freedom of private matters. The basic concept of privacy is “the right to be let alone” which state that every individual have the right to have his own solitude without intervention. One of the most important information which also can be associated with Information Privacy is Personal Data that shall be protected as a form of protection to the privacy itself. Some of the personal data has been used as the requirements of the SIM Card Registration, thus making new problems regarding its personal data protection since the comprehensive regulation still covered only by the Ministral Regulation. Research method used in this paper is Descriptive Analytic in which the writer analyze the research object by explaining the situation and the condition of the personal data protection obtained from literatures on the facts that can be associated with the implementation of SIM Card Registration Policy according to Indonesia’s Positive Law and International Law. According to the result of the study, the Ministral Regulation already covered most of the basic data protection needed in the SIM card registration policy, however the protection provided by the Ministral Regulation still has not covered the third party involved. The Involvement of this third party is inevitable and should be protected immediatelyin order to prevent any abuse of personal data.

Abstract

Developments in information and communications technology have significantly influenced and changed lives of peoples by  providing  new opportunities for consumers and businesses.  In digital economic era, an increasing number of consumers engage in e-commerce, which provides easier and faster access to products and services However it also presents some challenges for consumers that differ from offline commercial transactions. The impersonality of e-commerce weakens the relationship between businesses and consumers, thereby increasing consumer vulnerability that could lead to  to unfair commercial practices and causing uncertainty and lack of trust by consumers. Therefore,  there is a need by the government and busineese to promte and protect consumer trust in digital markets so it will not hamper development digital economy

Abstract

The practice of the regionalization principle in Article 6 Sanitary and Phytosanitary (SPS) Agreement is still conflicted. This is because of several cases regarding the members misinterpretation of international guidelines in the regionalization principle, such as India – Agricultural Products and Russia – Pigs (EU). Recently, Coronavirus Diseases 2019 (Covid-19) has been considered to affect animal trade. Such conditions prompt the World Trade Organization (WTO)  to recommend the Members to take SPS Measures to protect their domestic market. However, the trade would be inhibited in case the country-wide ban approach is applied. Therefore, this paper discusses the possible SPS measures under the regionalization principle to promote the trade during the pandemic according to WTO decisions from previous cases in line with the VCLT of 1969. The research result shows that the Covid-19 is an obstacle to international trade and makes humans and animals vulnerable to this virus. Consequently, many animal trades have been banned to prevent its spread. To deal with this condition, Indonesia could apply the regionalization principle in Article 6 SPS Agreement. Moreover, the government should update the quarantine law by pointing out the regionalization principle, unlike the zone system rules only applied to animals susceptible to Food Mouth Disease

Abstract

This book is written by Professor Graham Greenleaf, an expert in the field of privacy law from Faculty of Law, University of New South Wales, Sydney, Australia. This book compiles his research and advocacy in Asia's privacy development since 1970, as well as his writings on Asian Privacy Development in Privacy Laws & Business International Report. This book is the result of his long collaboration with many privacy law experts from many States in Asia and has been published in numerous books and journals. The book is written because the author believes that privacy in its many forms is worth protecting as one of the rights protected under human rights laws. Abstract

Data privacy that attached to every social media user has become a target of crime. One of the crime types that utilizes social media is doxing. Nowadays, the cases of doxing are increasing. There are still no specific and comprehensive normative rules that cover the data privacy protection to avoid doxing on social media. The fact makes the law enforcement still not optimal. This study is a descriptive study to answer some questions. Firstly, how to regulate doxing on social media based on the perspective of Indonesian law compared to the perspectives of other states in similar issue? Secondly, how the implementation of the right to be forgotten in doxing cases can optimize data privacy protection in Indonesia? This study used a normative juridical and case study approach. This study has resulted several results. Firstly, Indonesia needs special regulation for doxing on social media to protect the user data privacy. Secondly, the regulation of right to be forgotten should be reformulated and must be applied as a solution to doxing content. Doxing on social media regulation with the right to be forgotten can be further regulated through the legal regulation to provide a better data privacy protection.DOI: https://doi.org/10.22304/pjih.v9n1.a2

Abstract

Information technology changes people's habits in simple transactions to electronic systems (e-commerce). Along with technological developments, various new electronic contract innovations have emerged, one of which is the Blockchain-Smart Contract which relies on a decentralized ledger system in digital form that moves automatically (self-executing) using cryptocurrency on the blockchain. With its application in electronic transactions carried out without human intervention and based on computer code, it raises various questions regarding its validity as an electronic contract that is binding and enforceable both in the Law on Information and Electronic Transactions (UU ITE) in Indonesia, as well as internationally in UNCITRAL's Legal Model on e-Commerce with the implementation of technology neutrality principles.

Abstract

The rapid development of information technology that provides benefits turns out to have a negative impact on users, the possibility of personal data leakage. Cloud Computing is one example of the development of information technology (IT) that offers real convenience in storing, uploading, and downloading data. However, a few phenomenon involves the platform in the case of data leaks. The purpose of this research is to identify the arrangements and the responsibility of cloud computing service providers. Cloud computing is implicitly regulated in the Constitution of electronic information and transaction (UU ITE) and 2019 Government regulations on the Operation of Electronic Systems and Transactions (PP PSTE 2019), the registration of a reliability certificate to ensure its security. PP PSTE 2019 allows Electronic System Operator (PSE) to do storage both inside and outside Indonesia but is under the supervision of the ministry so it is understandable that cloud computing is regulated in Indonesia in the sense of storage. The law is progressive and does not comply with cloud computing regulations that have not been specifically regulated.

Abstract

Banyaknya kasus pelanggaran hak konsumen dalam transaksi direct carrier billing seperti pada kasus Putusan Mahkamah Agung Nomor 2219 K/Pdt/2013, Laporan Nomor LP/3409/X/2011/Ditreskrimsus, dan Perkara Nomor 464/Pdt/G/2020/PN.JKT.PST. Menggambarkan posisi konsumen yang sangat lemah di hadapan pelaku usaha. Tujuan dari penelitian ini adalah menemukan konsep perlindungan konsumen dalam transaksi direct carrier billing sebagai penyelenggaraan jasa penyedia konten berdasarkan dalam jaringan bergerak seluler dikaitkan dengan prinsip-prinsip keamanan siber. Transaksi direct carrier billing dalam prosesnya dibantu oleh Agen Elektronik maka diharuskan dalam memenuhi prinsip keamanan siber, inter alia, authentication, confidentiality, integrity, non-repudiation, authorization dan availability sesuai dengan Peraturan Pemerintah Nomor 71 Tahun 2019 tentang Penyelenggaraan Sistem dan Transaksi Elektronik (PP PSTE), Pelaku Usaha dalam transaksi ini yakni Penyelenggara Jaringan Telekomunikasi dan Penyelenggara Jasa Penyedia Konten diwajibkan untuk memenuhi prinsip-prinsip tersebut demi melindungi hak-hak konsumen dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UU Perlindungan Konsumen) yang telah diatur dalam Peraturan Menteri Komunikasi dan Informatika Republik Indonesia Nomor 9 Tahun 2017 tentang Penyelenggaraan Jasa Penyediaan Konten pada Jaringan Bergerak Seluler (Permen Kominfo 9/2017). Dalam penulisan ini, digunakan metode yuridis normatif yang berdasar kepada peraturan perundang-undangan juga studi kepustakaan yang akan menghasilkan beberapa upaya yang belum diatur dalam hukum positif dan yang dapat dilakukan oleh Penyelenggara Jaringan Telekomunikasi dan Penyelenggara Jasa Penyedia Konten demi melindungi konsumen dalam transaksi direct carrier billing antara lain seperti pelaksanaan audit teknologi informasi secara independen, penjaminan end-to-end data, sistem pengawasan perseorangan dan sosialisasi.

Abstract

Cyberattack issue in the shipping industries which was happened through some incidents towards ships, made the protection of cargo owners need to be reviewed. The seaworthiness obligation which interpreted as a means for a vessel to be fit to face the foreseeable perils in a voyage, makes cyberattack create its own discourse. This should not be separated with the cyberattack threat which has not been understood as an ordinary peril of a voyage. Moreover, the regulations in Indonesia which does not adopt the Hague-Visby Rules 1924, makes the industry fully rely on the Indonesian Shipping Law as a legal basis. The normative juridical research method makes the emphasis of the research on the use of library sources. The research specification uses an analytical descriptive that describes a literature study on the obligation of seaworthiness in dealing with the threat of cyberattack both in practice and regulation. The results of this study found that, first, the implementation of due diligence by the carrier in order to fulfil its seaworthiness obligations must also be applied to deal with the threat of cyberattack. The nature of the cyberattack that attacks the ship's information systems and technology, should make this attack predictable in a voyage. Moreover, the carrier's compliance with the cyber risk management guidelines on the ship should make the carrier declared to have fulfilled its seaworthiness obligations. Second, there is a legal vacuum in Indonesian positive law in regulating seaworthiness obligations in the face of cyberattack threats. Moreover, the legal gap between Indonesia's positive law and the 1924 HVR makes it difficult for Indonesian practitioners to follow global standards.
