Abstract

The principle of freedom of contract can be interpreted as the freedom of the parties to make or not make an agreement, the freedom to choose or determine with whom the business partner will carry out the agreement, then the freedom to choose the content and form of the things you want to make an agreement with. However, the freedom granted in the principle of freedom of contract is not absolute or without restrictions at all. The existence of this principle must be given restrictions so that contracts made by business people do not harm one of the parties involved in the agreement. This study aims to find out how to limit the principle of freedom of contract in designing business contracts and to find out the structure of designing business contracts. The type of research used in this study uses a normative juridical approach, in obtaining several sources of law in this study derived from primary, secondary and tertiary legal sources. The data collection technique used was a literature review technique (study document). The results of this study found that the principle of freedom of contract contains restrictions that may not be violated in order to create justice and equality of the parties

Abstract

Challenge human resources management is creating various organizations' variety but demands efficient, effective, and also productive knowledge. This study discusses the creativity model in improving organizational performance at Hasanuddin University Hospital Makassar. This hospital has facilities and human resources consisting of medical and non-medical personnel to support all service activities. However, the application of the right model of creativity in work has not been fully implemented properly. there are still employees who do not have creativity at work, especially in solving problems when working. To be able to improve organizational performance at the Hasanuddin University Makassar Hospital, an appropriate creativity model is needed that can be applied in facing increasingly fierce competition in the Industrial Revolution era which features technological excellence. This study aims to determine the creativity model for improving organizational performance at Hasanuddin University Hospital Makassar. The type of research used is descriptive qualitative research where this research describes in depth by examining all the problems that occur related to the research focus with a phenomenological approach. Data collection techniques in the form of Observation, Interview, and Documentation. Data analysis techniques include examining all available data that has been obtained from various sources, presenting data, and verifying it. The results of the study show that the creativity model in improving organizational performance has been implemented quite well, where most employees have enough creativity at work. For organizational performance to get better, the Hasanuddin University Makassar Hospital should always develop an appropriate and appropriate model of creativity.

Abstract

Penelitian ini  bertujuan untuk menganalisis perlindungan hukum bagi konsumen terhadap pelaku usaha yang melakukan kesewenang-wenangan dalam transaksi bisnis yang dituangkan dalam kontrak baku. Penelitian ini menggunakan metode pendekatan yuridis normatif, teknik pengumpulan data dalam penelitian ini dilakukan melalui cara studi kepustakaan. Metode pendekatan yang digunakan adalah pendekatan Undang-undang dan pendekatan konseptual. Teknik pengumpulan bahan hukum yang digunakan pada penelitian ini yaitu baha hukum yang diperoleh dalam penelitian ini adalah dengan Studi Dokumen, yaitu menghimpun dan mengumpulkan bahan hukum primer yaitu Undang-Undang Dasar Tahun 1945, KUHPerdata, dan Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen. Upaya perlindungan hukum terhadap konsumen dalam penggunaan klausula eksonerasi di dalam kontrak baku dilakukan dengan upaya perlindungan preventif dan represif. Perlindungan hukum preventif atau pencegahan dilakukan melalui tindakan pemerintah yang diambil sebelum pelanggaran itu terjadi dan perlindungan hukum represif adalah perlindungan untuk menangani permasalahan yang terjadi yang disebabkan oleh pelaku usaha yang membuat konsumen merugi. Perlindungan ini dapat dilakukan melalui penyelesaian sengketa melalui pengadilan ataupun diluar pengadilan.

Abstract

Abstrak. Pengabdian pada masyarakat ini bertujuan untuk memberikan motivasi dan pengetahuan kepada para Warga Binaan Pemasyarakatan Lapas Kelas IIB Takalar mengenai Wirausaha. Melalui PKM ini diharapkan bermanfaat bagi warga binaan lapas kelas IIB Takalar. Selama menjadi warga binaan lapas diberikan edukasi pelatihan terkait berwirausaha sehingga nantinya dapat menjadi bekal yang sangat membantu dalam memulai kehidupan yang mandiri secara finansial untuk warga binaan setelah keluar dari lapas. Untuk kedepannya, dengan adanya kegiatan ini diharapkan ada peningkatan kualitas warga binaan lapas kelas IIB Takalar dalam berwirausaha dengan memanfaatkan pengetahuan dan pemahaman yang diberikan. Lokasi pengabdian ini dilaksanakan di Lapas Kelas IIB Takalar. Metode yang digunakan adalah dengan memberikan ceramah pada sesi pertama, lalu sesi kedua yaitu diskusi dengan tanya jawab, kemudian sesi terakhir adalah evaluasi. Hasil dari kegiatan pengabdian ini yaitu meningkatkan pengetahuan dan motivasi warga binaan Lapas Kelas IIB Takalar mengenai kegiatan berwirausaha. Abstract

Pengaruh Harga dan Kualitas Pelayanan Terhadap Kepuasan Pelanggan Perusahaan Umum Daerah Air Minum (PDAM) Tirta Jeneberang Kabupaten Gowa. Skripsi, Program Studi Ilmu Administrasi Bisnis, Fakultas Ilmu Sosial dan Hukum, Universitas Negeri Makassar, dibimbing oleh (1) H.Muhammad Guntur (2) Siti Syarifah Wafiqah Wardah. Penelitian ini bertujuan untuk mengetahui bagaimana pengaruh harga dan kualitas pelayanan terhadap kepuasan pelanggan perusahaan umum daerah air minum (PDAM) Tirta Jeneberang Kabupaten Gowa. Responden dalam penelitian ini adalah pelanggan PDAM Tirta Jeneberang Kabupaten Gowa khususnya yang berdomisili di kecamatan Somba opu dengan jumlah sampel sebanyak 100 responden. Teknik pengambilan sampel menggunakan teknik  simple random sampling dengan pengumpulan data menggunakan kuesioner. Data yang diperoleh diolah menggunakan SPSS 25 yang terdiri dari analisis regresi berganda yang terlebih dahulu diuji menggunakan uji validitas, uji reliabilitas, uji normalitas, multikolinearitas,  dan uji heteroskedastisitas. Hasil penelitian menunjukkan bahwa indikator yang digunakan untuk setiap variabel menunjukkan bahwa Harga dan Kualitas Pelayanan berpengaruh secara signifikan terhadap Kepuasan Pelanggan PDAM Tirta Jeneberang Kabupaten Gowa. Hal ini dibuktikan berdasarkan Uji Korelasi serta Uji T dan Uji F serta Uji Koefisien Determinasi terhadap data yang diperoleh. Kata Kunci: Harga, Kualitas Pelayanan, Kepuasan Pelanggan.

Abstract

The increasing phenomenon of digital wallet use today indicates that people in this case have accepted digital payment applications to support daily transaction activities. This study aims to find out how the perception of benefits and convenience in the interest in using E-Money in Shopeepay users in Wajo Regency is perceived. The research approach used is a qualitative approach with a descriptive type of research. This research was conducted on Shopeepay users in Wajo Regency. Data collection procedures with observation, interviews and documentation. The data analysis used is the data collection technique used, namely data reduction, data presentation and conclusion drawn. From the results of the study, it was found that the perception of benefits and convenience makes users continue to be interested in using shopeepay e-money, especially in Wajo district. Shopeepay is an electronic money service that functions as a payment method and to store change funds offered by one of the largest marketplaces in Indonesia, namely Shopee. The perception of benefits is something that is always paid attention to by the public, with very helpful benefits, of course, people are interested in using products. The perception of ease of use is a consideration for the public in using electronic money services. The novelty of this research is that there is a novelty in the technological aspect, the aspect of consumer behavior and the economic aspect in the region. Abstract

This study is grounded in consumer protection theory and the concept of asymmetric information in digital transactions, which explain the imbalance of information and bargaining power between business actors and consumers in electronic commerce. The research aims to analyze consumer protection in live shopping transactions of thrift products on TikTok, identify potential risks and violations of consumer rights, and examine business actors’ legal responsibility and dispute resolution mechanisms under Indonesian law. This study employs a normative juridical approach through library research and document analysis of primary legal materials, including the Consumer Protection Law, the Electronic Information and Transactions Law, and regulations on electronic commerce, supported by relevant scholarly literature. Data were analyzed using qualitative normative analysis by interpreting legal provisions and relating them to the characteristics of live shopping practices. The results show that although the legal framework is comprehensive, the real-time and persuasive nature of live shopping increases the risk of information asymmetry, product misrepresentation, unilateral no-refund policies, and evidentiary difficulties. The novelty of this research lies in its specific focus on live shopping thrift transactions as a digital trade model that heightens consumer vulnerability.
