Abstract

This study aims to analyze the implementation of Good Zakat Governance (GZG) in the management of zakat, infaq, and alms (ZIS) at BAZNAS Barru Regency. The background of this study is based on the increase in ZIS collection every year, although it is still faced with internal obstacles such as limited human resources and field coordination, as well as external challenges in the form of the community's economic conditions. This study focuses on the application of GZG principles that include transparency, accountability, responsibility, independence, and fairness in the planning, implementation, and supervision of ZIS management. The research method used is a qualitative descriptive approach with a case study approach, through interviews, observations, and documentation at BAZNAS Barru Regency. The results show that the principle of transparency is implemented through a SIMBA-based reporting system and PSAK 109, and accountability is realized through internal and external audits. Independence is strengthened by cooperation between BAZNAS, local governments, and the private sector, while the principle of justice is reflected in the distribution of zakat according to the needs of mustahik in various regions. However, limited human resources, low community participation, and a manual verification system remain the main obstacles. This research contributes to strengthening zakat governance at the regional level and enriches academic studies on the implementation of Good Zakat Governance in Indonesia.

Abstract

This study aims to discuss the issue of pregnant women out of wedlock in Bugis community in the modern era in relation to the shift in the value of customary sanctions from the perspective of human rights and Islamic law. This study consists of two problems, namely the application of customary sanctions against women who are pregnant out of wedlock and the shift in the value of customary sanctions against women who are pregnant out of wedlock in the modern era from the perspective of human rights and Islamic law. The research methodology was carried out using a qualitative-descriptive field research approach. Data collection by way of observation, interviews, documentation. Sources of data are from the Bugis community, both academics and traditional leaders. Data processing is carried out with data related to the study and data analysis carried out by the theory of legal change and the theory of human rights. The results of the study show that 1) The application of customary sanctions against pregnant women out of wedlock in Bugis community is seen as a disgrace and shame so that customary sanctions called dipaoppangi tana apply, namely women are considered dead and the lineage from their family is erased, unless men are willing marrying a woman who causes her to become pregnant, or it can be with another man who is commonly known as pattongko siri, and 2) Traditional sanctions against women who become pregnant out of wedlock have experienced a shift in values both in the system of norms after being studied in Islamic law and human rights.

Abstract

Penelitian terdahulu mengenai Maqāṣid al-Sharī‘ah cenderung didominasi oleh kajian sektor perbankan dan teknologi finansial, sehingga mengabaikan dinamika regulasi ekonomi dan praktik usaha mikro di tingkat lokal. Penelitian ini bertujuan untuk menganalisis regulasi ekonomi lokal dan praktik pelaku Usaha Mikro, Kecil, dan Menengah (UMKM) di Kota Parepare melalui lensa Maqāṣid al-Sharī‘ah kontemporer berbasis pendekatan sistem (systems approach) Jasser Auda. Menggunakan metode kualitatif deskriptif dengan pendekatan studi lapangan (field research), data dikumpulkan melalui wawancara mendalam dengan pelaku UMKM (toko campuran, pangkalan gas, dan ATK) di Kelurahan Lemoe dan Lumpue, Kota Parepare, serta dokumentasi regulasi lokal terkait. Hasil penelitian menunjukkan bahwa kesadaran internal pelaku UMKM dalam menerapkan nilai kejujuran, keadilan sosial, dan kemaslahatan lingkungan telah selaras dengan dimensi pembangunan ekonomi dan keberlanjutan dalam Maqāṣid kontemporer. Namun, dari sisi regulasi lokal, implementasi kebijakan ekonomi daerah dinilai masih bersifat administratif-normatif dan belum sepenuhnya integratif dalam memitigasi dampak eksternalitas negatif (seperti kelangkaan pasokan energi bagi usaha mikro). Penelitian ini menyimpulkan bahwa penguatan UMKM lokal memerlukan rekonstruksi regulasi yang tidak hanya berorientasi pada kepatuhan formalitas hukum, melainkan berfokus pada perlindungan hak-hak ekonomi masyarakat kecil demi mewujudkan kemaslahatan yang holistik..

Abstract

Research on MSMEs and the digital economy generally focuses on digital marketing strategies and the validity of contracts in electronic transactions, while studies on the marginalization of MSMEs due to the structure and policies of digital platforms are still relatively limited. This study aims to analyze the marginalization mechanisms of Micro, Small, and Medium Enterprises (MSMEs) in the digital platform ecosystem and examine this phenomenon from the perspective of Islamic Economic Law. The study was conducted in Parepare City, South Sulawesi, using a descriptive qualitative research method with a field study approach. Data were obtained through in-depth interviews, observation, and documentation of nine MSMEs consisting of Culinary Businesses, Local Craft Businesses, Muslim Fashion Businesses, printing businesses, mixed shops, fried food businesses, Sultan Snacks, laundry, and graduation sash businesses. Data analysis was carried out through the stages of data reduction, data presentation, and drawing conclusions. The results show that digital platforms provide benefits in the form of expanded market access, increased consumer reach, and ease of transactions. However, on the other hand, marginalization mechanisms were found, characterized by dependence on platform algorithms, high service and promotion costs, the dominance of large-capital businesses, unequal price competition, and a lack of transparency in platform policies. From the perspective of Islamic Economic Law, this situation does not fully reflect the principles of justice (al-'adl), balance (tawazun), and public welfare (maqasid sharia). Furthermore, there are indications of elements of gharar (unlawful behavior) due to unclear algorithms and platform policies, which have the potential to harm MSMEs. Therefore, more transparent, accountable digital regulations are needed that support the protection and empowerment of MSMEs. Abstract

This study aims to analyze the concentration of wealth and the inequality of economic distribution in Sidenreng Rappang Regency and examine the role of sharia economic principles in realizing economic justice based on the maqāṣid al-syarÄ«”˜ah framework. This study uses a qualitative method with a field research approach. Data were obtained through in-depth interviews with seven informants consisting of academics, community leaders, business actors, and zakat institution managers, supported by observation and documentation. Data analysis was conducted using the interactive model of Miles and Huberman which includes data reduction, data presentation, and conclusion drawing/verification. The results of the study indicate that the inequality of economic distribution in Sidenreng Rappang Regency is influenced by the concentration of capital ownership, limited economic access for small communities, weak distribution of business opportunities, and the dominance of certain groups in controlling economic resources. These conditions cause the distribution of wealth to not be fair and equitableFrom the perspective of the maqāṣid al-syarÄ«”˜ah (Islamic principles), this phenomenon does not fully reflect the principles of distributive justice and social welfare because there are still obstacles in fulfilling the economic welfare of society in an inclusive manner. This study also found that Islamic economic instruments, such as zakat, infaq, sadaqah, waqf, and strengthening Islamic micro-enterprises, have strategic potential in reducing economic inequality. However, their implementation still faces various obstacles, particularly the dominance of consumptive distribution patterns and the suboptimal empowerment of the productive economy. Theoretically, this study expands the study of Islamic economics by placing the maqāṣid al-syarÄ«”˜ah as an analytical framework to evaluate the phenomenon of wealth concentration and economic inequality at the local level. Unlike previous studies that generally focused on the effectiveness of zakat, infaq, sadaqah, and waqf instruments, this study shows that wealth distribution also needs to be analyzed from the aspect of the structure of control of economic resources and the level of achievement of distributive justice in society. The novelty of this research lies in the integration of the perspectives of economic dominance and maqāṣid al-syarÄ«”˜ah in explaining the relationship between wealth concentration, community economic access, and the achievement of social welfare in the local economic context of Sidenreng Rappang Regency. Abstract

Artikel ini bertujuan untuk menganalisis menguatnya korupsi dan melemahnya budaya malu melalui revitalisasi nilai siri’ dalam perspektif hukum pidana Islam. Metode yang digunakan adalah penelitian hukum normatif atau library research dengan pendekatan perundang-undangan, konseptual, filosofis, dan kultural untuk membedah norma hukum serta nilai kearifan lokal secara mendalam. Kebaruan penelitian ini terletak pada rekonstruksi konseptual siri' masiri' sebagai sistem imunitas internal aparatur yang menyinergikan etika kesadaran teologis (amanah) dengan harga diri kultural. Temuan utama penelitian menunjukkan bahwa korupsi merupakan pelanggaran berat terhadap amanah, prinsip keadilan, perlindungan harta publik, dan kemaslahatan umum (maslahah). Selain itu, nilai siri’ ditemukan sangat relevan sebagai etika lokal antikorupsi yang mampu menanamkan kesadaran individu untuk menjaga harga diri, kehormatan, dan martabat sosial dari tindakan nista. Penelitian ini menawarkan model revitalisasi melalui skema "Siri' Berbasis Akuntabilitas Ilahi", sebuah konsep yang mentransformasikan nilai malu pasif menjadi tanggung jawab transendental yang diinstitusikan secara formal. Penelitian ini merekomendasikan revitalisasi nilai siri’ secara holistik melalui jalur pendidikan antikorupsi yang berakar pada kearifan lokal, pembinaan integritas aparatur sipil negara, penguatan etika publik dalam birokrasi, serta pengaktifan kontrol sosial masyarakat. Upaya ini diharapkan dapat menciptakan budaya hukum yang bermartabat dan memperkuat sistem pencegahan korupsi nasional dengan mengintegrasikan nilai universal hukum Islam dan kearifan lokal masyarakat.

Abstract

This study investigates the phenomenon of unregistered marriage and efforts to prevent underage marriage in Wajo Regency. The research aims to examine the motivations behind unregistered underage marriages through the lens of Maq??id Mukallaf and evaluate the effectiveness of local legal interventions. Wajo Regent Regulation No. 64 of 2022 serves as a key policy instrument aimed at curbing underage marriage and promoting legally recognized unions. Using a qualitative juridical approach, data were collected through in-depth interviews with marriage officials, parents, community leaders, and underage couples, supported by observation and document analysis. The study integrates Maq??id Mukallaf theory to assess the legality and ethical validity of marriage motives, alongside Ibn Qayyim al-Jawziyyah’s theory of legal change and Weber’s bureaucratic management theory to evaluate policy responsiveness and implementation. Findings indicate that although unregistered marriages involving underage couples may fulfill internal aspects such as personal capability and social support from parents and family, they are often driven by defensive motives such as avoiding complex legal procedures or social stigma which ultimately fail to meet the criteria of valid Maq??id Mukallaf.  Such acts are legally and morally untenable when they cause harm to others, particularly to children. This study highlights the importance of aligning legal frameworks with religious principles and community engagement to protect children’s rights and foster sustainable social change.

Abstract

This study discusses the Optimization of the Use of Islamic Religious Education Laboratories in the Practice of Student Worship at State Junior High Schools in Pangkajene District, Pangkep Regency. The main problem is how the Islamic Religious Education Laboratory can be optimized as a facility and infrastructure that supports the development and progress of Islamic Religious Education. The author uses a research approach with qualitative methods in data collection, as well as testing and analyzing data qualitatively. The research paradigm is constructivism; data sources are Principals, PAI Teachers, Students (primary data) and documents related to the management of the PAI Laboratory (secondary data); The research instrument is the researcher himself and is assisted through data collection tools, namely observation guidesheets, interview guidelines and document study guidelines; Data collection techniques are participation observation, in-depth interviews, and documentation; and testing the validity of the research results applying source triangulation and triangulation techniques. The research was carried out in four State Junior High Schools in Pangkajene District, Pangkep Regency. The results of the study showed that 1) The condition of PAI laboratories in the schools studied varied in terms of availability and quality of facilities. All schools have PAI laboratories, but there are gaps in infrastructure and equipment due to differences in budget allocation. 2) Laboratory use of PAI showed variation in intensity and effectiveness. Some schools have integrated the use of laboratories into the curriculum, while others still face challenges in optimization. 3) The practice of students' worship varies in the level of consistency and understanding. The majority of students have awareness of the importance of worship, but the level of practice varies. 4) Factors that affect the use of PAI laboratories include the availability of infrastructure, teacher competence, budget allocation, school management, student motivation, and education policies. This study recommends increasing budgets, developing teacher competencies, integrating curriculum, collaboration between schools, utilizing technology, and periodic evaluations to optimize the use of PAI laboratories and improve students' practice of worship.

Abstract

Government Regulation Number 45 of 1990 concerning Marriage and Divorce Permits for Civil Servants in article 3 stipulated that all civil servants intending to divorce had to have prior permission from their superiors or a letter of recommendation from a relevant official. This administrative requirement was mandatory, allowing the judge to consider and decide on divorce cases involving civil servants. This research employed field research with an empirical juridical approach, which was conducted directly to understand the real issues and was then linked to applicable laws, the legal certainty theory, and the maslahah theory (maintaining the objectives of shari'a and achieving benefits/avoiding harms). The research findings concluded that: 1) the divorce requirements in the maslahah theory aimed to reduce the divorce rate among civil servants. Superiors or authorized officials had the right to guide employees to try to preserve their marriages; 2) the Parepare Religious Court granted six months to obtain permission from superiors. If, by the specified deadline, the individual did not have this permission and still wished to divorce, they were required to submit a statement willing to bear the consequences of divorce without the superior's permission. The related consequences were outlined in Government Regulation Number 94 of 2021 on Civil Servant Discipline; 3) there was a connection between the judge's consideration and the maslahah theory. In addition to considering the applicable laws, the judge also took into account aspects of maslahah when making decisions. The maslahah obtained from a formal divorce in the Religious Court included legal certainty and justice in the judge's divorce decree.

Abstract

This study examines how Gen Z adult Muslims navigate digital economy trends by analyzing the influence of Islamic religiosity on e-entrepreneur intentions, with attitudes, perceived behavioral controls, and subjective norms as mediating variables based on Planned Behavior Theory (SDP). A quantitative cross-sectional survey was conducted with 387 Gen Z adult Muslim respondents recruited through purposive, convenience, and snowball sampling from selected Indonesian urban centers in Java and Sulawesi. Data were collected using a structured 5-point Likert scale questionnaire (22 items) and analyzed using PLS-SEM with SmartPLS 4.0. All seven hypotheses are supported. Islamic religiosity has a positive and significant direct effect on e-entrepreneurial intentions (t = 8.828, p < 0.001). Attitudes (t = 5.776, p < 0.001), perceived control of behavior (t = 4.803, p < 0.001), and subjective norms (t = 3.889, p < 0.01) also significantly predicted intention. Attitudes (indirect effects = 0.198), perceived control of behavior (0.163), and subjective norms (0.109) partially mediated the religiosity-intention relationship because the direct path from Islamic religiosity to intention remained significant. The model explains 48.3% of the variance in e-entrepreneurship intentions. These findings should be interpreted in the context of adult Muslim Gen Z respondents from specific Indonesian cities and should not be generalized to all Indonesian youth, rural populations, other religious groups, or developed country contexts. The cross-sectional design limits causal inference. Practically, universities, Islamic boarding schools, policymakers, and Islamic entrepreneurship institutions must integrate Islamic ethical values, digital skills, and community support into digital entrepreneurship programs. This study expands the SDGs by positioning Islamic religiosity as a religious-based cognitive antecedent of e-entrepreneurship intentions among Gen Z adult Muslims in Indonesia. It contributes to the theory of digital entrepreneurship in an Islamic context and offers evidence for value-based entrepreneurship education and policy design.
