Abstract

Integrasi ekonomi global telah menumbuhkan kekuatan-kekuatan ekonomi baru, demikian pula dengan Negara-negara ASEAN. Integrasi ekonomi regional ASEAN telah menyepakati Masyarakat Ekonomi ASEAN atau ASEAN Economic Community (AEC). Dalam kesepakatan tersebut mengembangkan AEC Blueprint yang merupakan pedoman bagi negara-negara anggota ASEAN untuk mencapai AEC 2015. Berdasarkan pertimbangan terhadap perkembangan integrasi ekonomi global, dan terbentuknya Masyarakat Ekonomi ASEAN perlu dilakukan pembentukan pembangunan payung hukum yang bisa mengantisipasi kecepatan perkembangan teknologi informasi dan komunikasi khususnya bidang e-commerce dan  aspek hukum perlindungan terhadap konsumenKata kunci : E-commerce, Aspek Hukum, Konsumen dan Masyarakat Ekonomi ASEAN

Abstract

The purpose of this study is to analyze the married couples engaged in an unregistered marriage and the position of the marriage agreement regarding the property as well as the concept of equal treatment of couples before and after isbat based on the theory of equality. This is important due to the legal gap observed in the norms, especially in relation to the unregistered legal marriages, despite the recognition of religious and registered marriages in Indonesian laws. This is legal research conducted using a conceptual and regulatory approach and the results defined an unregistered marriage as a legal marriage which fulfills the requirements determined by religion. Therefore, the failure to register a marriage does not invalidate its legality but there is a need for the record to be available with the state charged with such responsibility. Moreover, the agreements made concerning properties in unregistered marriages are valid as long as the parties conducted the process voluntarily and fulfill all the elements required. These agreements can also be recognized through the submission of isbat (marriage authorization) which recognizes and stipulates all activities conducted in the marriage before the isbat

Abstract

In recent years, earthquake mitigation is no longer dominated by pure science, but it moves towards various approaches based on sociology and anthropology. The main question of this paper is how local wisdom affect the way the people of Palu City faced disasters before there were legal arrangements and legislation regarding disasters and how to integrate this knowledge with the legal substance formulated by the government. Despite having a disaster mitigation policy, the local community and local government showed no disaster preparedness resulting in insurmountable victims and damage, even though they already live in a disaster-prone area. Therefore, a better system based on the integration of local wisdom that is obeyed by the local community needs to be established. Local wisdom is part of the Indonesian legal system, as it can be used as a material source for legislation. Through this research, we explored the possibility of accommodating local wisdom into the government's policy in the form of legislation using a case study from Pasigala, the region that used to be most heavily impacted by the 2018 earthquake. As a result, a model of disaster mitigation based on local wisdom was created and can be implemented as a local policy

Abstract

Indonesia is a country that is blessed with being a pluralistic nation, consisting of several tribes, religions, and cultures. For this reason, the recognition of customary law is also recognized as long as it still exists, and the implementation of marriages is also according to customary law, which is in accordance with the customary law of each region. The research method uses normative research. The findings showed that the age of the prospective groom was 19 years and that of the prospective bride was 16 years. After the amendment, there are no differences. These age limits for marriage are a measure of the maturity of persons who want to marry, carried out by people who have not reached the age of marriage.

Abstract

Indonesia is a country blessed with abundant natural resources. This fosters a wide variety of biological resources, thus providing a wide range of potential natural wealth in the form of agricultural, plantation, cultivation, handicraft and forestry products characterized by each region’s geographical features. The potential for coffee products to be used as Geographical Indication product is very large because there are many variants of coffee from different regions in Central Sulawesi, each having its own unique characteristics. The problem is that at this time there has been no real step taken by the parties related to the application and registration of Geographical Indications. This research aims to see how the potential of Central Sulawesi coffee products to be registered as Geographical Indications and see how the role of local government in encouraging applications and registration of geographical indications. This paper focuses on two coffee producing areas, namely Sigi Biromaru Regency and Poso Regency. The data used are primary data in the form of field observations and direct interviews and secondary data in the form of literature studies and regulations on geographical indications, then processed and analyzed using qualitative methods. Data is presented in descriptive form and conclusions are drawn using deductive logic. The result of the research is that it is time for the Central Sulawesi Government to start mapping the potential of Geographical Indication products in Central Sulawesi, especially those that have the potential to give birth to Geographical Indications, to create local product competitiveness and regional competitiveness in national and international trade.
