Abstract

The increase of the online transportation practice raises problems from its legal aspects. Even so, the community actually welcomes it as an alternative means of public transportation, which is faster, cheaper and more convenient for the community.This study aims to: (1). Analyze the legal relationship of the online transportation service provider and their driver partners according to Indonesia Transportation Law; and (2) Analyze the validity and legality of the agreement between the company of online transportation service provider and their driver partners and also between the driver partners and their passenger and it relations under Indonesia Traffic Law.This research was conducted using normative legal approach with studies from theoretical, historical, structural and philosophical aspects of laws and regulations. Empirical approach was used to support the normative approach arguments.The results reveals that: (1) Construction of the legal relationship between the online transportation service provider and the drivers is an agency agreement, where the online transportation service provider act as a commercial agent (Agentuur) and the drivers act as the Principal. Therefore, the agreement substance that contained in the terms and conditions in the electronic contract categorized as an agency agreement (Agentuur contract). (2) The legal relation between the company of online transportation service provider and their driver partners and also between the driver partners and the passenger is a violation of Indonesia Traffic Law. Therefore, the legal status is null and void by law and the parties cannot file a lawsuit before the court based on that agreement

Abstract

The purpose of this study is to analyze the married couples engaged in an unregistered marriage and the position of the marriage agreement regarding the property as well as the concept of equal treatment of couples before and after isbat based on the theory of equality. This is important due to the legal gap observed in the norms, especially in relation to the unregistered legal marriages, despite the recognition of religious and registered marriages in Indonesian laws. This is legal research conducted using a conceptual and regulatory approach and the results defined an unregistered marriage as a legal marriage which fulfills the requirements determined by religion. Therefore, the failure to register a marriage does not invalidate its legality but there is a need for the record to be available with the state charged with such responsibility. Moreover, the agreements made concerning properties in unregistered marriages are valid as long as the parties conducted the process voluntarily and fulfill all the elements required. These agreements can also be recognized through the submission of isbat (marriage authorization) which recognizes and stipulates all activities conducted in the marriage before the isbat

Abstract

The objective of this study is to discover the legal position of the National ID number functioning as the primary identity that forms the basis for fulfilling citizens’ rights, including fundamental rights to health services and education for persons with disabilities. Also, to determine the innovation implemented by the Dinas Adminduk of Palu City to encourage public service fulfillment for persons with disabilities. This research is empirical legal research with statutory and conceptual approaches. This research concludes that the legal position of the National ID number functioning as the primary identity that forms the basis for fulfilling citizens’ rights has been legalized in the Regulation of The President of The Republic of Indonesia Number 83 Year 2021. This causes every Indonesian citizen to be mandatory to have an ID number to access public services, which leads to the fulfillment of the constitutional rights of citizens. SIMALEO BERGERAK, PELANGI in the District, and PELAYAN SEKSI are the innovations developed to help the citizens, especially persons with disabilities, to have an ID number. Therefore, the obligation to fulfill the constitutional rights of persons with disabilities can be carried out by the State.

Abstract

Kelurahan Siranindi merupakan salah satu Kelurahan yang berada dalam wilayah Kota Palu, Sulawesi Tengah. Berdasarkan hasil konsultasi dengan aparat Kelurahan, diketahui bahwa masyarakat Kelurahan Siranindi belum memahami perihal Manfaat Nilai Jual Objek Pajak (NJOP) Terhadap Pengenaan Pajak Bumi dan Bangunan. Sehingga perlu dilakukan penyuluhan hukum yang berfokus pada pemahaman pada makna dan tujuan dari manfaat NJOP sebagai taksiran harga rumah dan bangunan yang dihitung berdasarkan luas tanah dan bangunan serta kelas tanah. Selain itu, NJOP juga digunakan sebagai dasar pembayaran PBB. Metode yang digunakan adalah penyuluhan hukum dengan menggunakan model ceramah, tanya jawab, dan konsultasi. Hasil kegiatan penyuluhan yaitu adanya pemahaman tentang NJOP dari perspektif kemanfaatan bagi masyarakat pemilik objek pajak di Kelurahan Siranindi. Kesimpulan yang dapat ditarik dari kegiatan penyuluhan ini yaitu masyarakat Kelurahan Siranindi pada umumnya belum mengetahui hal-hal terkait NJOP, terutama mengenai sistem zonasi dan besaran NJOP yang ditetapkan oleh pemeirntah, apalagi bila objek pajak yang bersangkutan akan diperjualbelikan.

Abstract

This study examines the impact of regional autonomy on fiscal independence, particularly through the ability of local governments to generate revenue without reliance on the central government. Effective governance requires a sustainable budget, and Law Number 1 of 2022 on Financial Relations Between the Central and Local Governments grants local governments the authority to impose taxes. However, the law restricts local governments to collecting only specified types of taxes, which must be established through local regulations (*Perda*), and prohibits the introduction of new tax types. The selection of tax types is contingent upon the existence of tax objects with sufficient potential to contribute to Locally-Generated Revenue (LGR) and enhance fiscal independence. This study aims to analyze the regulation of local tax types for autonomous regions and assess the implications of insufficient tax potential on fiscal decentralization. Utilizing a normative-juridical approach, with legislative, conceptual, and historical perspectives, the findings indicate that inadequate tax objects undermine fiscal decentralization by failing to significantly increase PAD. Consequently, a feasibility study is recommended to assess the potential of local taxes before their inclusion in regional regulations.

Abstract

In recent years, earthquake mitigation is no longer dominated by pure science, but it moves towards various approaches based on sociology and anthropology. The main question of this paper is how local wisdom affect the way the people of Palu City faced disasters before there were legal arrangements and legislation regarding disasters and how to integrate this knowledge with the legal substance formulated by the government. Despite having a disaster mitigation policy, the local community and local government showed no disaster preparedness resulting in insurmountable victims and damage, even though they already live in a disaster-prone area. Therefore, a better system based on the integration of local wisdom that is obeyed by the local community needs to be established. Local wisdom is part of the Indonesian legal system, as it can be used as a material source for legislation. Through this research, we explored the possibility of accommodating local wisdom into the government's policy in the form of legislation using a case study from Pasigala, the region that used to be most heavily impacted by the 2018 earthquake. As a result, a model of disaster mitigation based on local wisdom was created and can be implemented as a local policy

Abstract

Negara Kesatuan Republik Indonesia merupakan Negara yang didirikan di atas kesatuanwilayah Provinsi dan Kabupaten/Kota sebagaimana diatur oleh Pasal 18 ayat (1) UndangundangDasar Negara Republik Indonesia Tahun 1945. Pasal ini menjadi landasankonstitusional bagi pembentukan Undang-undang Nomor 23 Tahun 2014 Tentang PemerintahDaerah yang mengakomodir pengaturan mengenai pembagian urusan pemerintahan,termasuk urusan pangan. Penelitian ini bertujuan untuk mengindentifikasi dan menguraikandampak hukum penetapan Desa Talaga Kecamatan Dampelas Kabupaten Donggala ProvinsiSulawesi Tengah sebagai Kawasan Pangan Nusantara yang dibentuk berdasarkan SuratKeputusan Gubernur Sulawesi Tengah Nomor 504/117.1/DBMPR-G.ST/2022 tentangPenetapan Desa Talaga Kecamatan Dampelas Kabupaten Donggala sebagai Kawasan PanganNusantara Program Peningkatan Penyediaan Pangan Nasional (Food Estate). Penelitian inimerupakan penelitian hukum normatif, dengan menggunakan pendekatan perundangundangan(statute approach) dan pendekatan konseptual (conceptual approach). Bahan hukumyang digunakan yaitu peraturan perundang-undangan di tingkat Pusat dan di tingkat DaerahProvinsi Sulawesi Tengah, serta konsep-konsep hukum yang diambil dari referensi hukumterkait. Hasil penelitian menyimpulkan bahwa terdapat beberapa dampak hukum penetapanKawasan Pangan Nusantara di Provinsi Sulawesi Tengah, yaitu dalam aspek hukumlingkungan, aspek hukum kehutanan, aspek tata ruang, dan aspek sengketa agraria.

Abstract

The purpose of this study is to analyze the factors that hinder the implementation of government policies against the elimination of minimal capital of legal entities as an effort to develop MSME to improve the regional economy in Palu of Central Sulawesi. This research was an empirical research method using a qualitative descriptive approach. The results showed the factors inhibiting the implementation of government policy on the elimination of minimal capital of legal entity making is the lack of information about Government Regulation Number 29 of 2016 concerning Changes in The Basic Capital of The Establishment of Limited Liability Companies, Constraints on the requirements of making Limited Liability Companies both due to large capital constraints for the manufacture of Limited Liability Companies and Due to Administrative System Constraints that are quite difficult, and the latter is the Orientation of Individualist Thinking.

Abstract

The position of the village as the lowest autonomous government structure has an essential role in achieving multidimensional national development goals because its management involves all government officials, both at the main and the local level, even at the village level. This study aimed to determine the material normative regulation related to the supervision and guidance of the administration of village governance and to find out the substantive forms of supervision and direction of the administration of village governance that the level of government above can implement. The result of this study was 1) Normative regulation material on the supervision and development of village administration is currently subject to Law Number 6 of 2014 concerning Village Government Regulation of the Republic of Indonesia Number 47 of 2015 concerning Amendment to Government Regulation Number 43 of 2014 concerning Implementation Regulation of Law Number 6 of 2014 concerning Villages, and PP Number 12 of 2017. 2) Substantive forms of supervision and development of village administration that can be carried out by the government level above include the provision of technical guidelines/guidance, appreciation, and guidance in the fields of development planning, finance, and institutional planning.
