Abstract

Extradition agreements based on the international resolution A/RES/45/166 68th Plenary meeting on 14 December 1990 in conjunction with A/RES/52/88 70th Plenary meeting on December 12, 1997 for making extradition treaties and mutual legal assistance internationally.This  propose the problem identification as follows: 1. What are the important articles suggested in the extradition treaty and mutual legal assistance related to criminal theory and international treaties. 2. How is the application and implementation of the extradition and mutual legal assistance based on the national and regional especially In Indonesia.This research conducted is analytical descriptive. Here is the research results, as follows: 1.) Important articles suggested in the extradition treaty are the principle of nebis in idem, the principle of multiple crimes and the diplomatic principle and the mutual legal assistance is the principle of agreement, the principle of reciprocity, the principle of equality of crimes, the principle of territoriality and the principle of surrendering the perpetrators of political crimes. 2) The implementation of extradition treaty model and the mutual legal assistance from the national and regional legal aspects. Based on the regional aspect, Indonesia is the most active country in realizing a cooperation within an agreement.

Abstract

This article is entitled "Examination of the Recall Rights of Political Parties Against Legislative Members in the Perspective of a Democratic Rule of Law (Case Study of Regional People's Representative Assembly in Central Sulawesi)", where the author will analyze the right of recall or a right that political parties have to temporarily dismiss legislative members at the suggestion of a political party which supports it concerning the principles of a democratic rule of law. The legal issue raised in this writing is "Is the Right to Recall Political Parties Against Legislative Members Compliant with the Principles of a Democratic Rule of Law? ". This article uses normative juridical and empirical juridical research methods by analyzing the rights contained in the Constitution of the Republic of Indonesia and their relationship to Law Number 17 of 2014 concerning the People's Consultative Assembly, the People's Representative Council, the Regional Representative Council, and the Representative Council Regional People, especially those related to the temporary dismissal of legislative members proposed by political parties, in this case is contained in Article 239 paragraph (2) letter "d". In this article, the recall rights of political parties follow the principles of the rule of law. Recalls are needed to monitor political parties over their members who have served as members of the legislature. However, its application still requires clarity regarding matters that result in the recall of a legislative member by his political party.

Abstract

The Unitary State of the Republic of Indonesia is founded on the unity of the territory of the Provinceand Regency/City as regulated by Article 18 paragraph (1) of the 1945 Constitution of the Republic ofIndonesia. This article is the constitutional basis for forming Law Number 23 of 2014 concerningRegional Government, which accommodates regulations regarding the division of government affairs,including food affairs. This study aims to identify and describe the legal impact of the determination ofTalaga Village, Dampelas District, Donggala Regency, Central Sulawesi Province as the IndonesianFood Area, which was formed based on the Decree of the Governor of Central Sulawesi Number504/117.1/DBMPR-G.ST/2022 concerning the Determination of Talaga Village, Dampelas District,Donggala Regency, as the Indonesian Food Area for the National Food Provision Improvement Program(Food Estate). This research is normative legal research, using a statute and conceptual approach. Thelegal materials used are laws and regulations at the Central and Regional levels of Central SulawesiProvince and legal concepts taken from the latest legal references. The results of the study concludedthat there are several legal impacts of the determination of the Food Estate in Central Sulawesi Province, in environmental law, forestry law, spatial planning, and agrarian disputes aspects.

Abstract

The lack of clarity regarding the relationship between position and content material for government regulations and presidential regulations can be seen in the provisions of Article 12 and Article 13 of Law Number 12 of 2011 concerning Formation of Legislation. From these provisions it can be seen that the material content of presidential regulations is broader than the content material of government regulations. From the explanation regarding the contents of government regulations and presidential regulations, it does not explicitly delegate further arrangements, there are no benchmarks for using government regulations or presidential regulations. This means that in this condition there is a similarity in the content of government regulations and presidential regulations. This research was conducted using a juridical-normative approach, research with reference to juridical aspects. This method is carried out through literature studies on various literature related to legal theories and principles. Abstract

Peningkatan pemahaman hukum dan etika dalam interaksi di lingkungan merupakan kebutuhan mendesak mengingat masih maraknya perundungan, diskriminasi, penyalahgunaan media sosial, serta rendahnya kesadaran terhadap konsekuensi hukum di kalangan pelajar. Kesadaran hukum dan etika sejak dini penting untuk mewujudkan lingkungan pendidikan yang kondusif, aman, dan harmonis. Kegiatan pengabdian kepada masyarakat ini dilaksanakan di SMA negeri 1 Luwuk dengan sasaran 30 siswa yang bertujuan memberikan edukasi mengenai pentingnya hukum dan etika dalam interaksi sosial di sekolah. Metode pelaksanaan menggunakan ceramah dan diskusi yang diawali pemaparan materi kemudian dilanjutkan dengan sesi tanya jawab. Hasil kegiatan menunjukkan antusiasme tinggi dalam mengikuti materi dan mampu mengidentifikasi bentuk pelanggaran hukum serta etika yang lazim terjadi di sekolah. Dengan begitu, dapat menumbuhkan kesadaran siswa mengenai pentingnya perilaku yang patuh dan menghargai orang lain. Kegiatan PKM ini memberikan kontribusi nyata dalam membangun budaya sekolah yang lebih disiplin dan harmonis serta menjadi dasar bagi pengembangan program pembinaan hukum dan etika berkelanjutan di lingkungan pendidikan.

Abstract

This study critically examines the legal dimensions, mechanisms, and barriers to public participation in the formulation of local regulations (perda) in Central Sulawesi. Employing a socio-legal approach that integrates normative analysis with empirical inquiry, the research evaluates compliance with the 1945 Constitution, Law No. 12/2011 (amended by Law No. 15/2019), Law No. 23/2014, and Ministry of Home Affairs Regulation No. 80/2015. Empirical data were gathered through in-depth interviews with 45 informants, observations at 12 public consultation forums, and document analysis of three strategic local regulations across four regions during 2021–2023. The findings reveal a significant implementation gap: public participation has been reduced to procedural formality, fundamentally contradicting the principle of openness. Three critical legal deficits were identified: (1) the absence of legal sanctions for procedural participation violations; (2) insufficient clarity in mechanisms for substantively accommodating public input; and (3) the lack of a public right of action against regulations enacted without adequate participation. The study concludes that multidimensional legal reform, coupled with a community-based deliberative participation model, is essential to fostering authentic and equitable democratization within the local legislative process.

Abstract

Pelayanan Terpadu Satu Pintu (PTSP) merupakan sistem pelayanan administrasi peradilan yang diamanatkan Peraturan Presiden Nomor 97 Tahun 2014 guna mewujudkan penyelenggaraan layanan publik yang cepat, transparan, dan akuntabel. Salah satu layanan dengan volume permohonan tertinggi di PTSP Pengadilan Agama Palu adalah pengambilan akta cerai, mengingat tingginya angka perceraian di wilayah Kota Palu, Sulawesi Tengah. Pengabdian ini bertujuan menganalisis implementasi PTSP pada layanan pengambilan akta cerai, mengidentifikasi kendala operasional yang dihadapi, serta merumuskan rekomendasi perbaikan yang sistematis. Kegiatan dilaksanakan pada periode Februari hingga Mei 2026 menggunakan pendekatan partisipatif dengan metode kualitatif deskriptif, melalui teknik observasi partisipatif, wawancara mendalam, dan studi dokumentasi. Data dianalisis menggunakan model interaktif Miles dan Huberman serta divalidasi melalui triangulasi sumber dan metode. Hasil pengabdian mengidentifikasi tiga kendala utama yang bersifat sistemik, yakni keterbatasan mekanisme pembayaran non-tunai, ketidaklengkapan dokumen persyaratan akibat minimnya informasi prosedural kepada masyarakat, serta keterlambatan penerbitan akta cerai yang bersumber dari lemahnya koordinasi internal antara panitera dan staf pembuat akta cerai. Edukasi prosedural yang dilakukan secara langsung kepada pemohon terbukti efektif, namun bersifat tidak sistemik. Pengadilan Agama Palu perlu menindaklanjuti temuan ini melalui perluasan mekanisme pembayaran, optimalisasi informasi prosedural, penguatan SOP internal, serta monitoring berkala guna mewujudkan layanan PTSP yang lebih responsif dan berpihak pada masyarakat pencari keadilan.
