Abstract

Extradition agreements based on the international resolution A/RES/45/166 68th Plenary meeting on 14 December 1990 in conjunction with A/RES/52/88 70th Plenary meeting on December 12, 1997 for making extradition treaties and mutual legal assistance internationally.This  propose the problem identification as follows: 1. What are the important articles suggested in the extradition treaty and mutual legal assistance related to criminal theory and international treaties. 2. How is the application and implementation of the extradition and mutual legal assistance based on the national and regional especially In Indonesia.This research conducted is analytical descriptive. Here is the research results, as follows: 1.) Important articles suggested in the extradition treaty are the principle of nebis in idem, the principle of multiple crimes and the diplomatic principle and the mutual legal assistance is the principle of agreement, the principle of reciprocity, the principle of equality of crimes, the principle of territoriality and the principle of surrendering the perpetrators of political crimes. 2) The implementation of extradition treaty model and the mutual legal assistance from the national and regional legal aspects. Based on the regional aspect, Indonesia is the most active country in realizing a cooperation within an agreement.

Abstract

This article is entitled "Examination of the Recall Rights of Political Parties Against Legislative Members in the Perspective of a Democratic Rule of Law (Case Study of Regional People's Representative Assembly in Central Sulawesi)", where the author will analyze the right of recall or a right that political parties have to temporarily dismiss legislative members at the suggestion of a political party which supports it concerning the principles of a democratic rule of law. The legal issue raised in this writing is "Is the Right to Recall Political Parties Against Legislative Members Compliant with the Principles of a Democratic Rule of Law? ". This article uses normative juridical and empirical juridical research methods by analyzing the rights contained in the Constitution of the Republic of Indonesia and their relationship to Law Number 17 of 2014 concerning the People's Consultative Assembly, the People's Representative Council, the Regional Representative Council, and the Representative Council Regional People, especially those related to the temporary dismissal of legislative members proposed by political parties, in this case is contained in Article 239 paragraph (2) letter "d". In this article, the recall rights of political parties follow the principles of the rule of law. Recalls are needed to monitor political parties over their members who have served as members of the legislature. However, its application still requires clarity regarding matters that result in the recall of a legislative member by his political party.

Abstract

Negara Kesatuan Republik Indonesia merupakan Negara yang didirikan di atas kesatuanwilayah Provinsi dan Kabupaten/Kota sebagaimana diatur oleh Pasal 18 ayat (1) UndangundangDasar Negara Republik Indonesia Tahun 1945. Pasal ini menjadi landasankonstitusional bagi pembentukan Undang-undang Nomor 23 Tahun 2014 Tentang PemerintahDaerah yang mengakomodir pengaturan mengenai pembagian urusan pemerintahan,termasuk urusan pangan. Penelitian ini bertujuan untuk mengindentifikasi dan menguraikandampak hukum penetapan Desa Talaga Kecamatan Dampelas Kabupaten Donggala ProvinsiSulawesi Tengah sebagai Kawasan Pangan Nusantara yang dibentuk berdasarkan SuratKeputusan Gubernur Sulawesi Tengah Nomor 504/117.1/DBMPR-G.ST/2022 tentangPenetapan Desa Talaga Kecamatan Dampelas Kabupaten Donggala sebagai Kawasan PanganNusantara Program Peningkatan Penyediaan Pangan Nasional (Food Estate). Penelitian inimerupakan penelitian hukum normatif, dengan menggunakan pendekatan perundangundangan(statute approach) dan pendekatan konseptual (conceptual approach). Bahan hukumyang digunakan yaitu peraturan perundang-undangan di tingkat Pusat dan di tingkat DaerahProvinsi Sulawesi Tengah, serta konsep-konsep hukum yang diambil dari referensi hukumterkait. Hasil penelitian menyimpulkan bahwa terdapat beberapa dampak hukum penetapanKawasan Pangan Nusantara di Provinsi Sulawesi Tengah, yaitu dalam aspek hukumlingkungan, aspek hukum kehutanan, aspek tata ruang, dan aspek sengketa agraria.

Abstract

The lack of clarity regarding the relationship between position and content material for government regulations and presidential regulations can be seen in the provisions of Article 12 and Article 13 of Law Number 12 of 2011 concerning Formation of Legislation. From these provisions it can be seen that the material content of presidential regulations is broader than the content material of government regulations. From the explanation regarding the contents of government regulations and presidential regulations, it does not explicitly delegate further arrangements, there are no benchmarks for using government regulations or presidential regulations. This means that in this condition there is a similarity in the content of government regulations and presidential regulations. This research was conducted using a juridical-normative approach, research with reference to juridical aspects. This method is carried out through literature studies on various literature related to legal theories and principles. The results of this study indicate that there are inconsistencies in the position of presidential regulations, especially when juxtaposed with government regulations when viewed from the perspective of the material content. ___ Referensi Buku dengan penulis: Asshiddiqie, Jimly. Abstract

In making a decision on a judicial review case, ideally the Constitutional Court decides according to what the applicant requested in his/her application, but in practice the Constitutional Court often decides a case beyond what the applicant requested, or in other words, is ultra petita. This is actually contrary to the provisions in Article 45A of Law Number 8 of 2011 concerning Amendments to Law Number 24 of 2003 concerning the Constitutional Court, which prohibits the Constitutional Court from deciding ultra petita. The study used a normative legal method that focused on the legal aspect with a literature study approach. The results of the study show that the legislators wanted the Constitutional Court not to decide more than what the applicant requested because of the nature of the Constitutional Court's decision, which is final and binding. However, in subsequent cases, the provisions regarding the prohibition of ultra petita were also found to be contradictory by the Constitutional Court itself, namely through the Constitutional Court's decision Number 48/PUU-IX/2011 concerning the judicial review of Law Number 35 of 2009 concerning Narcotics and Law Number 8 of 2011 concerning Amendments to Law Number 24 of 2003 concerning the Constitutional Court, shortly after the enactment of Law Number 8 of 2011. The Constitutional Court, in deciding constitutional cases, must avoid actions that exceed its authority while still prioritizing the values ​​of truth and justice that apply in society. However, the application of ultra petita is not without limitations, because it raises challenges that can weaken the effectiveness of the judiciary and has the potential to invite arbitrariness in judicial decision-making. Abstrak Dalam memberikan putusan terhadap suatu perkara pengujian undang-undang, idealnya Mahkamah Konstitusi memutus sesuai dengan apa yang dimohonkan pemohon dalam permohonannya, namun dalam praktiknya Mahkamah Konstitusi sering kali memutus suatu perkara melebihi apa yang dimohonkan pemohon atau dengan kata lain bersifat ultra petita. Hal tersebut justru bertentangan dengan ketentuan dalam pasal 45A Undang-Undang Nomor 8 Tahun 2011 tentang Perubahan Atas Undang-Undang Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi yang melarang Mahkamah Konstitusi untuk memutus secara ultra petita. Penelitian menggunakan metode yuridis normatif yang difokuskan pada aspek yuridis dengan pendekatan studi kepustakaan. Hasil penelitian menunjukkan bahwa pembentuk undang-undang menghendaki agar Mahkamah Konstitusi tidak memutus lebih dari apa yang dimohonkan pemohon dikarenakan sifat putusan Mahkamah Konstitusi yang bersifat final dan mengikat. Akan tetapi, pada perkara-perkara selanjutnya, ketentuan mengenai larangan ultra petita tersebut juga ditemukan kontradiksi oleh Mahkamah Konstitusi sendiri, yaitu melalui putusan Mahkamah Konstitusi Nomor 48/PUU-IX/2011 tentang pengujian Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika dan Undang-Undang Nomor 8 Tahun 2011 tentang Perubahan Atas Undang-Undang Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi, sesaat setelah diundangkannya Undang-Undang Nomor 8 Tahun 2011. Mahkamah Konstitusi dalam memutus perkara konstitusi harus menjauhi tindakan yang melampaui kewenangannya dengan tetap mengutamakan nilai-nilai kebenaran dan keadilan yang berlaku dalam masyarakat. Meskipun demikian, penerapan ultra petita bukannya tanpa keterbatasan, karena menimbulkan tantangan yang dapat melemahkan efektivitas peradilan dan berpotensi mengundang kesewenang-wenangan dalam pengambilan keputusan peradilan.

Abstract

Peningkatan pemahaman hukum dan etika dalam interaksi di lingkungan merupakan kebutuhan mendesak mengingat masih maraknya perundungan, diskriminasi, penyalahgunaan media sosial, serta rendahnya kesadaran terhadap konsekuensi hukum di kalangan pelajar. Kesadaran hukum dan etika sejak dini penting untuk mewujudkan lingkungan pendidikan yang kondusif, aman, dan harmonis. Kegiatan pengabdian kepada masyarakat ini dilaksanakan di SMA negeri 1 Luwuk dengan sasaran 30 siswa yang bertujuan memberikan edukasi mengenai pentingnya hukum dan etika dalam interaksi sosial di sekolah. Metode pelaksanaan menggunakan ceramah dan diskusi yang diawali pemaparan materi kemudian dilanjutkan dengan sesi tanya jawab. Hasil kegiatan menunjukkan antusiasme tinggi dalam mengikuti materi dan mampu mengidentifikasi bentuk pelanggaran hukum serta etika yang lazim terjadi di sekolah. Dengan begitu, dapat menumbuhkan kesadaran siswa mengenai pentingnya perilaku yang patuh dan menghargai orang lain. Kegiatan PKM ini memberikan kontribusi nyata dalam membangun budaya sekolah yang lebih disiplin dan harmonis serta menjadi dasar bagi pengembangan program pembinaan hukum dan etika berkelanjutan di lingkungan pendidikan.
