Abstract

Corruption is a foul act, like being bribed. It has damaged not only the legal finances and legal economic potential, but also the socio-cultural, moral, political and legal pillars of the national security and law. Corruption is an extraordinary crime (Extra Ordinary Crimes) because it is done by people who have positions or power, which is carried out systematically, structured, and neatly cooperated with the others to cover up their actions, with the aim of getting money, goods or something for personal and family interests. The impact caused by corruption assuredly endangers the community. Factors causing corruption are very complex, including those related to lifestyles (consumptive), integrity/ morality/ mental attitude, attitude/ behavior, legal environment culture, economic needs/ demands, opportunities, and economic legal gaps which lead to jealousy of the law, the vulnerability of the bureaucracy,surveillance systems,and legal services. The causes of corruption are apparently very broad/ multi-dimensional. Corruption prevention efforts are conducted by making better changes in all areas of life both personally and institutionally. They are done by involvingcommunity participations, one of which is to report to the authorities when they know or even experience a criminal act of corruption (being whistleblower) and cooperate with the law enforcement in exposing corruption(being justice collaborator). Besides, ratifying the conventions related to eradication of corruption and issuing various regulations are needed to be done in order to prevent the occurrence of criminal acts of corruption.Keywords: Corruption, causes, prevention

Abstract

Human trafficking is recruitment, delivery, removal, gathering or admitting people by threatening,kidnaping,deceiving or using violence or other forms  of forcement, kidnaping, deceiving, lying or or abusing of power risky position or taking and giving payment or getting advabtages in order to get agreement from the authority of other persons for exploitation. And the action of human trafficing is an action or a series of actions which fulfil the aspects of crime in the the rules of law.The most prominent of human trafficking is the sexual exploitation. This situation is so terrifying in the Bantul region. The victims of human trafficking are women and children, at least, two cases have been brought to court in  the State Court of Bantul in the period of 2016 to 2017. They are the case of No.147 Pid.Sus 2016 PN.Btl and the case of No.148 Pid.Sus 2016 PN.Btl. Based on the facts, the questions arise are  how the juridical implementation to the human trafficking through sexual exploitation in Bantul regency is and what makes the cases of human trafficking through sexual exploitation in Bantul regency arise.The objectives of this research are 1. To give explanation of juridical study of adjudication to the human trafficking through sexual exploitation in Bantul regency, 2. To give explanation why the crime of human trafficking arise through sexual exploitation in Bantul regency.The result of this research is study of adjudication of the human trafficking through sexual exploitation in Bantul regency. It  includes, judges must consider the system of crime act provement. b judges must consider the principle of legality of the law. And the reasons of the human trafficking through sexual exploitation in Bantul regency are the factors of economic religion family  education and facilities in Bantul regency.

Abstract

Legal protection efforts for narcotics abuse victims are based on Law Number 35 of 2009 concerning Narcotics which can be in the form of sanctions for action. This study aims to determine victims of narcotics abusers in terms of victimization based on Law Number 35 Year 2009 and legal protection for victims of narcotics abusers and the obstacles they face. Data collected from the results of research, both library research and field research, are then analyzed descriptively qualitatively, namely the method of data analysis by grouping data and selecting data obtained from research according to its quality and truth, then linked to laws and theories obtained from the literature, so obtained answers to the problems studied. Victims of narcotics abusers in terms of victimization based on Law Number 35 Year 2009 are those who unintentionally use narcotics, because they are persuaded, tricked, tricked, forced, and / or threatened to use narcotics. However, in practice those who are considered victims are those who have just been first caught red-handed with evidence that does not exceed those stipulated in the Supreme Court Circular Letter Number 4 of 2010. Legal protection for victims of narcotics abusers is carried out through rehabilitation. There are two types of rehabilitation provided, namely medical rehabilitation and social rehabilitation. The victims of abusers who were caught red-handed by the National Narcotics Agency immediately carried out rehabilitation without due process. While those who were caught red-handed by the Police, even though the evidence was under the provisions of the Circular of the Supreme Court No. 4 of 2010, the legal process continued, after that it was only rehabilitated.

Abstract

Eksekusi hukuman mati dalam kasus penyalahgunaan narkoba yang mengatasnamakan Mary Jane Fiesta Veloso sempat tertunda di detik-detik terakhir saat hendak dieksekusi. Penundaan itu pada prinsipnya hanya tertuang dalam Undang-Undang Nomor 2/PNPS/1964 tentang Tata Cara Pelaksanaan Hukuman Mati oleh Pengadilan Umum dan Peradilan Militer. disebutkan bahwa penundaan eksekusi hanya dapat dilakukan jika orang yang akan dieksekusi hamil, maka eksekusi akan dilakukan setelah anak lahir. keinginan terakhir harus dipenuhi oleh pemerintah. Namun kasus Mary Jane Viesta Veloso tidak ditangguhkan di bawah hukum.Jenis penelitian ini adalah empiris normatif dengan pendekatan perundang- undangan dan pendekatan kasus. Pengambilan data dilakukan secara primer dan sekunder sehingga dapat dilakukan analisis kualitatif yaitu dengan menyajikan data yang diperoleh dalam bentuk kalimat yang rinci dan jelas.Hasil penelitian ini dapat disimpulkan bahwa, pertama alasan penundaan hukuman mati bagi pelaku tindak pidana narkotika atas nama Mary Jane Fiesta Veloso terbagi menjadi 2 (dua) yaitu alasan yuridis dan politik, kedua implikasi penundaan eksekusi hukuman mati. hukuman mati atas nama Mary Jane Fiesta Veloso dapat berdampak pada kepastian, kemanfaatan dan keadilan

Abstract

Bentuk kewenangan yang dimiliki Oleh Satuan Samapta Bhayangkara Polresta Yogyakarta dalam memberantas peredaraan minuman keras yaitu melakukan menangkap, mengamankan barang bukti dan menyidangkan dengan acara cepat melalui pengadilan negeri. Pelaksanaan penegakan hukum dilakukan secara penegakan hukum preemtif, preventif dan represif. Pelaksanaan penegakan hukum secara peremtif dilakukan dengan cara melakukan himbauan dan upaya pemberintahun terhadap masyarakat untuk tidak terlibat dalam peredaraan minuman keras melalui spanduk-spanduk di jalan raya, selain itu juga melakukan upaya pembinaan terhadap para pelaku yang pernah terjaring dengan adanya peredaraan minuman keras baik itu konsumen, penjual. Penegakan hukum secara preventif dilakukan dengan cara operasi penyakit masyarakat pada setiap malam, operasi ini dilakukan di tempat-tempat yang dicurigai terjadi peredaraan minuman keras, selain itu juga terhadap pengendaraan motor yang mengendarakan kendaraan secara ugal-ugalan. Penegakan hukum represif yang dilakukan Polresta dalam melakukan pembrantasan peredaram minuman keras dilakukan dengan cara adanya laporan dari masyarakat bahwa telah terjadi tindak peredaraan minuman keras dengan tidak lanjut penangkapan dan menyita barang bukti dan diamankan ke Polresta Yogyakarta dan dihadapakan dimuka persidangan

Abstract

This study aims to study and analyze the settlement of traffic accident cases with child offenders, which resulted in fatalities in the Bantul Police Station and its constraints and efforts to resolve the obstacles. The results showed that the settlement of a traffic accident case with a child offender, which resulted in the death of a victim in the Bantul District Police area, began with a mere case and then involved children, so that the police  investigator conducted an investigation and case crime scene. If the BAP results contain evidence that points to the child as a suspect, Bapas conducts Litmas to the suspect, so a recommendation from Bapas for Diversi is published. Obstacles faced by Bantul Police investigators in the settlement of traffic accident cases with child offenders, which resulted in fatalities in the Bantul Polres area, including obstacles originating from children , constraints originating from law enforcement, and constraints originating from from the community. Then how to overcome these obstacles include improving the quality and quantity of human resources in Bantul Regional Police.

Abstract

AbstrakKasus kecelakaan ini ternyata mengalami peningkatan yang signifikan tidak hanya ditingkat nasional termasuk di Daerah Istimewa Yogyakarta. Untuk perlu dilakukan pendidikan lalu lintas terhadapat masyarakat dengan tujuan agar tidak terjadi kecelakaan yang lebih merugikan masyarakat secara umum.Penelitian ini mempunyai tujuan sebagai berikut : 1) Tujuan yang bersifat analitis kritis yaitu untuk mengetahui dan menganalisis upaya pendidikan berlalulintas terhadap masyarakat dalam upaya mencegah terjadinya kecelakaan di wilayah Polda DIY; 2) Tujuan yang bersifat analitis kritis yaitu untuk mengetahui dan menganalisis kendala dalam upaya melakukan pendidikan berlalulintas terhadap masyarakat untuk mencegah terjadinya kecelakaan di wilayah Polda DIY.Penelitian ini merupakan penelitian hukum normatif. Data diperoleh dari penelitian kepustakaan yang dilakukan dengan cara mengkaji bahan-bahan hukum primer, sekunder, dan tersier, meskipun demikian penelitian ini juga didukung dengan data yang diperoleh dari wawancara kepada sejumlah narasumber yang meliputi :  Kasi Laka Subitgakkum Ditlantas Polda DIY dan BA SI Laka Subditgakkum Ditlantas Polda DIY.  Metode pendekatan dalam penelitian ini adalah Statue Approach dan Conceptual Approach.  Data yang diperoleh dianalisis secara kualitatif
