Abstract

Contemporary Islamic legal discourse is often shaped by tensions between rigid textualism and unrestricted contextualism, creating challenges for developing legal rulings that are both normatively grounded and socially responsive. Although religious moderation and istinbāṭ al-aḥkām have been studied before, there has been no discussion on how moderation can be incorporated into this process. The current study aims at studying istinbāṭ approach where moderation becomes part of the process of producing legal rulings. In order to address the research objectives, a qualitative case study design was employed. Data collection was conducted using semi-structured interviews with 12 participants, non-participant observations in 8 sessions of legal reasoning, and analysis of institutional documents and fatwa books. As results show, religious moderation is perceived as a process whereby the balance between texts, context, and objectives of Islamic law is achieved. Religious moderation is operationalized through two approaches: the first is Qawlī Intiqādī, which includes critical evaluation and selection of juristic opinions, while the other is Manhajī and includes derivation of the rulings from texts, principles, and objectives of Islamic law. Moreover, the results show that the involvement of multiple actors in collective reasoning, consulting with different specialists, and considering the public welfare are important for arriving at context-sensitive legal rulings.

Abstract

Based on data presented by ‘Abd al-Razzāq, out of 60 ḥadīth studies spanning from 1986 to 2004, only five focused on the Andalusian region, accounting for approximately 8.3%, with none specifically addressing areas in Andalusia. More specifically, there is no connection found with the study of ḥadīth that centers on researching the figure of Muhammad Ibn Waḍḍāh (d. 899) in his book titled al-Bida’ wa al-Nahy ‘Anhā. The purpose of this writing is to explore the biography and scholarly journey of Ibn Waḍḍāh, as well as to delve deeply into related backgrounds, systematics, and methods employed in the preparation of the book al-Bida’ wa al-Nahy ‘Anhā. The method employed in this article is qualitative, utilizing a library study approach, given that the desired data is narrative and extracted from written literature. The article concludes that the background of composing the book is influenced by socio-political conditions favoring Ibn Waḍḍāh as a scholar dedicated to global knowledge. The socio-cultural conditions were alarming, marked by phenomena such as cultural acculturation, interfaith marriages, and massive conversions to Islam, prompting Ibn Waḍḍāh (d. 899) to react to the degradation of faith at that time.

Abstract

The science of hadith sharia is the study of the meaning or explanation contained in a hadith. In studying a hadith, there are several supporting sciences involved, one of which is the science of hadith sharia. When studying the science of hadith sharia, one will also learn about the methods used to explain a hadith. These methods are what help scholars to explain hadiths that are not yet fully understood by readers. Some of the methods used to explain hadiths are the analytical, ijmali, and muqarrin methods. This paper will focus more on the ijmali method used to explain hadiths. The data in this study was obtained from library research sources. The purpose of this study is to understand what the ijmali method is and to understand the hadith sharia about the obligation of wudu for every prayer in one of the hadith sharia books that uses the ijmali method in its explanation.

Abstract

This study examines the influence of the Zindiq sect on the development of hadith studies in the 2nd century Hijri. The Zindiq sect systematically fabricated hadiths, distorted Islamic teachings, and raised doubts about the authenticity of hadith as a source of Islamic law. This research aims to analyze hadith from the perspective of the Zindiq sect, their impact, and the responses of hadith scholars and the government at that time in addressing their influence. Using a historical approach and qualitative methods, this study explores hadith falsification, the scholars' efforts in hadith criticism, and governmental actions against the Zindiq. The findings indicate that the Zindiq movement posed a serious challenge to hadith transmission and used it as a tool for their conspiracy, prompting scholars to refine hadith verification methods. Additionally, their activities accelerated the codification of hadith and the implementation of stricter transmission standards. This study concludes that although the Zindiq posed a significant threat to Islamic scholarship, they inadvertently contributed to the strengthening of hadith sciences. Further research is needed to explore the influence of other ideologies on hadith transmission.
