Abstract

This research aims to analyze criminal liability in relation to fault, specifically intention (dolus) and negligence (culpa), committed by optical fiber operators from the perspective of positive law, in conjunction with the synchronization of the criminal justice system and the maqashid shariah in relation to the resulting harm to society. The study utilizes primary, secondary, and tertiary legal materials, supported by qualitative analysis, considering that the research is of a juridical normative nature, and employs a legislative, case-based, and comparative approach. In addition to providing compensation, the findings indicate that the fault of the optical fiber operator (schuld) as a corporation, whether through dolus or culpa, leads to criminal liability for damages to roads, drainage systems, and sidewalks as public infrastructure. Businesses may sometimes be parties that benefit from the crimes they commit, making it unjust to impose criminal penalties on management, including the possibility of applying a Deferred Prosecution Agreement (DPA), particularly in cases where the loss can be quantified economically, through legal reforms. Authorities responsible for regulations concerning urban development are also accountable, meaning that local government administrations (district/city) hold responsibility. The use of criminal mediation as part of restorative justice, also within the frameworks of the crime control model, due process model, juridical model, and steering model, is relevant. To achieve fair legal objectives from the perspective of Positive Law, synchronization within the criminal justice system is needed, including substantial, structural, and cultural synchronization, as well as aligning with Islamic legal ideals and the maqashid shariah, which are in accordance with Divine Justice and the principles of Hifdz ad-din, Hifdz an-nafs, Hifdz al-aql, Hifdz al-mal, and Hifdz an-nasl, as the philosophy of Islam for the welfare of the universe (rahmatan lil ‘alamin). Penelitian ini bertujuan untuk menganalisis pertanggungjawaban pidana sehubungan dengan kesalahannya berupa kesengajaan (dolus) dan kelalaian (culpa) yang dilakukan oleh operator fiber optik dalam pandangan hukum positif dengan sinkronisasi sistem peradilan pidana dan maqashid syariah sehubungan timbulnya kerugian bagi masyarakat. Dipergunakannya bahan hukum primer, sekunder dan tersier didukung analisis kualitatif, mengingat jenis penelitiannya yuridis normatif serta dipergunakan pendekatan undang-undang, kasus, dan komparatif. Selain memberikan ganti rugi, temuan penelitiannya menunjukkan bahwa kesalahan operator kabel optik (schuld) sebagai korporasi, baik dolus maupun culpa, mengakibatkan pertanggungjawaban pidana atas kerugian dan kerusakan jalan, sistem drainase, dan trotoar sebagai fasilitas umum. Bisnis kadang-kadang menjadi pihak yang mengambil keuntungan dari kejahatan yang mereka lakukan, maka dianggap tidak adil untuk menjatuhkan hukuman pidana kepada manajemen, termasuk tidak menutup kemungkinan diberlakukan Deferred Prosecution Agreement (DPA), utamanya dalam kasus yang berkaitan dengan suatu perkara yang kerugiannya dapat diukur dengan ekonomi dengan melakukan pembaruan hukum. Pemegang kekuasaan atas peraturan yang mereka keluarkan mengenai pembangunan kota, maka pemerintah daerah kabupaten/kota juga bertanggung jawab. Penggunaan mediasi pidana sebagai salah satu komponen keadilan restoratif tidak terkecuali dalam crime control model, due process model, model yuridis dan model kemudi. Untuk mencapai tujuan hukum yang berkeadilan dari sudut pandang Hukum Positif perlu adanya sinkronisasi sistem peradilan pidana meliputi sinkronisasi substansial, sinkronisasi struktural, dan sinkronisasi budaya dan cita-cita hukum Islam yang sesuai dengan keadilan Ilahi dan Maqashid Syariah seperti Hifdz ad-din, Hifdz an-nafs, Hifdz al-aql, Hifdz al-mal, dan Hifdz an-nasl sebagai falsafah umat Islam untuk kemaslahatan alam semesta (rahmatan lil ‘alamin).

Abstract

The principle of proportionality is based on the principle of balance between the interests of the perpetrator, the victim and the state (on behalf of the society) in relation to the suitability between the crime that has been committed and the sanctions imposed as an important part of the criminal justice system. The purpose of this study is to analyse the existence of the principle of proportionality, from the perspective of positive law and maqasid sharia in the criminal justice system. The type of the present study is a normative juridical research with a statutory approach, a case study approach, and a comparative approach by using primary legal materials, secondary materials, and tertiary legal materials, with qualitative analysis. The results of the study reveal that the existence of the principle of proportionality from the perspective of positive law and maqasid sharia in the criminal justice system is essential, especially in the criminal justice system by considering the objectives of the imposed punishment and the guidelines for imposing such punishment. Therefore, synchronisation of the criminal justice system is needed, namely substantial synchronisation, structural synchronisation and cultural synchronisation to realise the objectives of the fair and just law, in addition to the benefits and certainty for the interests of the perpetrator, the victim, and the state. The principle of proportionality must be well configured in the Positive Law, especially Criminal Law, as contained in the values of Pancasila as the philosophy and way of life of the Indonesian nation, in addition to the ideals of Islamic Law in maqasid sharia which reflects the intent or purpose of law as the philosophy of Muslims for the benefit of the universe ( rahmatan lil 'alamin ) such as hifdz ad-din , hifdz an-nafs , hifdz al-aql , hifdz al-mal and hifdz an-nasl which serve as the symbiotic paradigms.Keywords: criminal justice, maqasid sharia, proportionality, synchronization. AbstrakAsas proporsionalitas yang mendasarkan pada prinsip keseimbangan antara kepentingan pelaku, korban dan negara (masyarakat) berkaitan  adanya kesesuaian antara pidana yang telah dilakukan dengan sanksi yang diterimanya adalah bagian penting dalam sistem peradilan pidana. Tujuan penelitian ini adalah menganalisis eksistensi asas proporsionalitas, perspektif hukum positif dan maqosid syariah dalam sistem peradilan pidana. Jenis penelitiannya adalah yuridis normatif dengan statute approarch, case approarch, comparative approarch dan menggunakan bahan hukum primer, bahan sekunder, bahan hukum tertier, serta analisis kualitatif. Hasil studi mengungkapkan bahwa eksistensi asas proporsionalitas, perspektif hukum positif dan maqosid syariah dalam sistem peradilan pidana sangat penting, khususnya dalam sistem pemidanaan dengan memperhatikan tujuan pemidanaan dan pedoman pemidanaan. Oleh sebab itu, diperlukan sinkronisasi sistem peradilan pidana yaitu sinkronisasi substansial, sinkronisasi struktural dan sinkronisasi kultural untuk mewujudkan tujuan hukum yang berkeadilan di samping kemanfaatan dan kepastian bagi kepentingan pelaku, korban, dan negara (masyarakat). Asas proporsionalitas tersebut harus terkonfigurasikan dengan baik dalam hukum positif terutama Hukum Pidana yang terkandung dalam nilai-nilai Pancasila sebagai falsafah dan way of life bangsa Indonesia, di samping cita Hukum Islam dalam maqasid al syariah yang memuat maksud atau tujuan hukum sebagai falsafah Umat Islam demi kemaslahatan bagi alam semesta (rahmatan lil ‘alamin) seperti hifdz ad-din, hifdz an-nafs, hifdz al-aql, hifdz al-mal dan hifdz an-nasl yang merupakan paradigma simbiotik.Kata Kunci: Asas Proporsionalitas, Maqasid Sharia, Sinkronisasi, Sistem Peradilan Pidana.

Abstract

Violence in education has led to criminal activities that require special attention from all parties. This paper discusses preventive measures of violence in education through a juridical-religious approach under the criminal justice system. This paper is a doctrinal law study in which an analysis of legal materials is used to answer legal problems and produce legal arguments. This paper demonstrates that the incorporation and operation of these two approaches under the criminal justice system will be very effective and useful for preventing and controlling crimes in schools because, first, the juridical approach can prevent students from becoming victims of violence and educate them not to repeat the same crimes; secondly, the religious approach will instill a faithful, pious character and noble personality into students so that they avoid crimes.

Abstract

This study evaluates the integration of artificial intelligence in the judicial processes, focusing on how technology can promote fairness in the Indonesian Criminal Justice system, where there are no specific guidelines for using AI in legal proceedings. The research follows a normative legal approach, analyzing laws and court cases and comparative methods using various legal sources and qualitative analysis methods. The findings reveal that incorporating AI in the judge's decision-making process aids in assessing information and data, facilitating optimal, effective, and efficient decision-making.  On the other hand, incorporating AI into the decision-making process of judges within the Criminal Justice System implies that judges act as a smaller version of the system itself, considering various factors such as examination records, charges, and real-life circumstances impacted by social, cultural, and economic elements. Ultimately, integrating AI into the evidential process for judicial decision-making aims to align the criminal justice system with factual situations and the goals of punishment. It is recommended that the use of AI in legal proceedings should not only focus on algorithm-based legal aspects but also take into account non-legal aspects such as humanitarian, social, and economic conditions that contribute to criminal activities. This holistic approach is crucial for ensuring alignment in the Criminal Justice System to uphold legal, moral, and societal justice.  The role of the Supreme Court is no exception in providing guidance and supervision of Judges regarding the use of technology, including legal legalization, while still paying attention to law, ethics, social values , and just legal principles.

Abstract

The criminal justice system aiming to serve as a resolution of domestic violence should take into account the adat law system, religious law, and self-regulation living in society. Marriage Institution and Law Number 23 of 2004 concerning Abolishment of Domestic Violence turns out to be a criminogenic factor. This research seeks to investigate the criminal justice system linked to measures for the protection of women as victims of domestic violence in Indonesia and to find out and analyze the contribution of local wisdom to the reform of the system regarding the protection of female victims of domestic violence. This research required doctrines involving the study of secondary data supported by a field study and systematic analyses of the existence of the criminal justice system regarding domestic violence cases with an approach to the local wisdom in Madurese society. The research discovers that the criminal justice system in mitigating the female victims of domestic violence must be integrated and synergized with the sub-systems embracing police, health professionals, social workers, voluntary facilitators, and preachers assigned in criminal court as governed under the Law Number 23 of 2004. The presence of local wisdom in the reform of the criminal justice system concerning domestic violence cases represents the measures taken to shape criminal law in Indonesia by accommodating the values that live in societies, including religious teaching through restorative justice. This approach is intended to accommodate the interest of the victims and criminal offenders to resolve the issue within the criminal justice system.

Abstract

Sumenep Regency has thousands of hectares of land used as salt ponds. Therefore, many people in Sumenep make a living as salt farmers. The salting process is carried out by salt farmers independently or in groups, also by PT Garam. The status of salt farmers is seen from the number of Madura salt production actors consisting of owner farmers and sharecroppers or mantong. There is an interaction between parties which may consist of landowners and salt farmers/mantong as well as workers/laborers who work at PT. Garam forms a legal relationship. In this legal relationship, there are differences in the systems used by the parties, such as employment relationships and partnership relationships, so this becomes an ambiguity regarding the status and rights of the workers. This article explores the following research questions: how is the legal relationship between salt pond workers in Sumenep Regency and have the rights of salt pond workers in Sumenep Regency been fulfilled? The purpose of this study is to find out the legal relationship of salt pond workers in Sumenep Regency and to find out whether the rights of salt pond workers in Sumenep Regency were fulfilled. The research type is empirical research and the approach used was empirical juridical. The results of this study are the effectiveness of statutory policies regarding clarity of worker status and the fulfillment of the rights of salt pond workers.
