Abstract

This study, conducted at PT. Pos Indonesia Banjar Branch, focuses on HR policies regarding recruitment, selection, placement as well as compensation by using a qualitative approach with a case study method. The data were taken from interviews with the HR Manager as well as the Head of the Post Office, observations, and documentation. The results showed that the recruitment policy implemented by PT. Pos Indonesia Banjar branches are (1) Opening 50% of job vacancies for apprentice students, 30% open to the public through advertising and 20% open based on recommendations from internal employees. (2) The process of placing employees is based on the selection process and the competence of employees. (3) Compensation policies, that have been implemented "well", meet the eligibility requirements and the Regional Minimum Wage (UMR) standard. In conclusion, PT. Pos Indonesia Banjar Branch needs to emphasize policies to human resources in order to maintain good company performance.

Abstract

This paper examines the sociological and anthropological perspectives on household resilience in rural and urban communities. This research is grounded in significant social change, where values and social structure shifts impact how individuals and families sustain their existence. This study aims to understand how sociocultural factors influence household resilience strategies and compare the differences and similarities between rural and urban communities in this context. The methods used include literature studies. The theoretical framework for this research encompasses social structure theory, social network theory, and anthropological approaches that emphasize an in-depth understanding of cultural practices. The discussion results indicate that rural communities rely on community solidarity and tradition in building household resilience, whereas urban communities prioritize individualistic social networks. The implications of this research provide insights for policymakers and social practitioners in designing more effective intervention programs to enhance household resilience, considering each community's unique characteristics. This study is expected to contribute to the further development of research in the fields of sociology and anthropology, as well as offer a new perspective on understanding social dynamics in Indonesia.

Abstract

The fatwa on the prohibition of inter-religious greetings issued by the Majelis Ulama Indonesia (MUI) in English Indonesian Theologian Council has caused controversy in the context of inter-religious relations in Indonesia. This study aims to evaluate the impact of the fatwa on Islamic family law and social harmony, focusing on the intolerance caused by interfaith interactions. Using a qualitative approach, this study conducted a content analysis of the text of the Indonesian Theologian Council fatwa and literature related to maqashid al-syariah and Islamic family law. Data were obtained through a documentation study of Indonesian Theologian Council fatwas, books, articles, and academic publications. The analysis technique involved identifying the main themes in the fatwa, comparing them with maqashid al-syariah principles, and evaluating their impact on multicultural family relationships and social harmony. The results show that this fatwa, although aimed at protecting Islamic identity, has the potential to cause tension in family relationships that have members with different religious backgrounds and undermine social harmony. The research emphasizes the need for open dialogue between scholars, academics and the community to find a more inclusive and tolerant solution. A more moderate approach is hoped to be adopted to create interfaith harmony and maintain harmony in Indonesia's multicultural society.

Abstract

The MUI fatwa related to interreligious greetings has created polemics in Indonesian society, particularly in the context of Islamic moderation. This fatwa prohibits interreligious greetings which are considered to damage the purity of Islamic teachings that affect social relations, especially in families that have different beliefs. This article aims to analyse the impact of the MUI fatwa on the dynamics of family law in Indonesia, especially on families who have different beliefs and their relevance to the principles of Islamic moderation in the context of family law. This article uses a qualitative approach with an analysis of the content of the MUI fatwa related to greetings in family law, and interviews with family law experts and religious leaders who understand the implications of the fatwa on family relations in interfaith Indonesian society. This article shows that the MUI Fatwa causes tension in families of different beliefs regarding interfaith greetings. This fatwa also shows the tension between maintaining religious identity and maintaining family harmony. In the context of family law, this fatwa affects basic principles such as respect for religious differences and the values of inclusivity in families of different religions. This article offers a new perspective that connects the MUI fatwa related to interfaith greetings with family law in Indonesia.

Abstract

The principle of proportionality is based on the principle of balance between the interests of the perpetrator, the victim and the state (on behalf of the society) in relation to the suitability between the crime that has been committed and the sanctions imposed as an important part of the criminal justice system. The purpose of this study is to analyse the existence of the principle of proportionality, from the perspective of positive law and maqasid sharia in the criminal justice system. The type of the present study is a normative juridical research with a statutory approach, a case study approach, and a comparative approach by using primary legal materials, secondary materials, and tertiary legal materials, with qualitative analysis. The results of the study reveal that the existence of the principle of proportionality from the perspective of positive law and maqasid sharia in the criminal justice system is essential, especially in the criminal justice system by considering the objectives of the imposed punishment and the guidelines for imposing such punishment. Therefore, synchronisation of the criminal justice system is needed, namely substantial synchronisation, structural synchronisation and cultural synchronisation to realise the objectives of the fair and just law, in addition to the benefits and certainty for the interests of the perpetrator, the victim, and the state. The principle of proportionality must be well configured in the Positive Law, especially Criminal Law, as contained in the values of Pancasila as the philosophy and way of life of the Indonesian nation, in addition to the ideals of Islamic Law in maqasid sharia which reflects the intent or purpose of law as the philosophy of Muslims for the benefit of the universe ( rahmatan lil 'alamin ) such as hifdz ad-din , hifdz an-nafs , hifdz al-aql , hifdz al-mal and hifdz an-nasl which serve as the symbiotic paradigms.Keywords: criminal justice, maqasid sharia, proportionality, synchronization. AbstrakAsas proporsionalitas yang mendasarkan pada prinsip keseimbangan antara kepentingan pelaku, korban dan negara (masyarakat) berkaitan  adanya kesesuaian antara pidana yang telah dilakukan dengan sanksi yang diterimanya adalah bagian penting dalam sistem peradilan pidana. Tujuan penelitian ini adalah menganalisis eksistensi asas proporsionalitas, perspektif hukum positif dan maqosid syariah dalam sistem peradilan pidana. Jenis penelitiannya adalah yuridis normatif dengan statute approarch, case approarch, comparative approarch dan menggunakan bahan hukum primer, bahan sekunder, bahan hukum tertier, serta analisis kualitatif. Hasil studi mengungkapkan bahwa eksistensi asas proporsionalitas, perspektif hukum positif dan maqosid syariah dalam sistem peradilan pidana sangat penting, khususnya dalam sistem pemidanaan dengan memperhatikan tujuan pemidanaan dan pedoman pemidanaan. Oleh sebab itu, diperlukan sinkronisasi sistem peradilan pidana yaitu sinkronisasi substansial, sinkronisasi struktural dan sinkronisasi kultural untuk mewujudkan tujuan hukum yang berkeadilan di samping kemanfaatan dan kepastian bagi kepentingan pelaku, korban, dan negara (masyarakat). Asas proporsionalitas tersebut harus terkonfigurasikan dengan baik dalam hukum positif terutama Hukum Pidana yang terkandung dalam nilai-nilai Pancasila sebagai falsafah dan way of life bangsa Indonesia, di samping cita Hukum Islam dalam maqasid al syariah yang memuat maksud atau tujuan hukum sebagai falsafah Umat Islam demi kemaslahatan bagi alam semesta (rahmatan lil ‘alamin) seperti hifdz ad-din, hifdz an-nafs, hifdz al-aql, hifdz al-mal dan hifdz an-nasl yang merupakan paradigma simbiotik.Kata Kunci: Asas Proporsionalitas, Maqasid Sharia, Sinkronisasi, Sistem Peradilan Pidana.

Abstract

The article's main aim is to analyze the readiness of infrastructure to support the development of halal industrial areas in Indonesia. The discussion focused on aspects of infrastructure quality, halal awareness, and cooperation between organizations in the field of infrastructure. This study is proposed as literature research by examining various publications published in multiple media. The data that has been collected is validated and then analyzed using a descriptive-qualitative approach. Several halal industrial areas established in Indonesia are used as cases to discuss this study. This research shows that with Indonesia's sizeable Muslim population and solid demographic, religious, social and cultural capital, Indonesia has an excellent opportunity to become the centre of the world's halal industry. This support also takes the form of a high level of awareness regarding halal. However, Indonesia is still faced with various challenges, starting from suboptimal infrastructure and low awareness of halal certification, which results in limited availability of human resources and regulatory constraints so the halal industry can develop. The region's supply chain infrastructure and halal ecosystem accelerator could have been more optimal. This study can provide initial information on the development of halal industrial areas in Indonesia, but it requires further, more comprehensive research.

Abstract

This study is motivated by the differences in the application of sanctions between positive law and Islamic criminal law for perpetrators of traffic accidents resulting in death due to negligence. The main issue in this study is the discrepancy between the types of sanctions imposed by judges in the positive legal system and those recommended by Islamic criminal law. The purpose of this research is to analyze and compare the forms of accountability applied to perpetrators under both legal systems and to evaluate the implications of justice for both victims and offenders. The method used is normative juridical with a conceptual and case approach. Data were obtained through literature study of court decisions and relevant scholarly works, followed by qualitative analysis of the sanction concepts in both legal systems. The findings indicate that sanctions under positive law tend to emphasize imprisonment, even when the act is committed due to negligence. In contrast, Islamic criminal law classifies such acts as unintentional offenses that are not punishable by imprisonment, but rather require financial compensation to the victim’s family and moral redemption by the offender. This approach is considered to prioritize restorative justice values and the restoration of social relationships. This research recommends the integration of restorative justice principles into the criminal justice system, particularly in cases involving unintentional acts, in order to achieve a more proportional and humane form of justice.
