Abstract

The era of the economy globalization is a movement that has a nationalism dimension because infinite flows of investment and capital that begin to penetrate the strategic sector economically result in fundamental problems given that this strategic sector is related to the livelihoods of the people (the basic needs of citizens) that demand protection from the state. In the field of water management that is not spared from the current globalization of the economy it has a complicated problem because the policies in the exploitation of water are considered to be contrary to the 1945 Constitution. The peak, with the issuance of Constitutional Court Decision Number 85 / PUU-XI / 2013 which decided to reject the entire contents of Law Number 7 of 2004 so that it essentially returns the exploitation of this water to the state. This writing is a conceptual legal thought that aims to find answers to the regulation of water management in Law Number 7 of 2004 concerning Water Resources contradicts the 1945 Constitution, and seeks the concept of good water regulation that can be used as a means of protection for citizens in the era of economic globalization after Law Number 7 of 2004. The results of the discussion concluded that Law Number 7 of 2004 concerning Water Resources denies the 1945 Constitution because in terms of law enforcement both ideally and normatively it has lost the constitutive elements of the enactment of a law. Meanwhile, the concept of good water regulation as an effort to protect citizens in the era of economic globalization after Law No. 7 of 2004 is regulation that adheres to the state ideology, and are able to respond to global pressures and challenges, namely with efforts to harmonize the law in the field of water.

Abstract

Konsep negara dan bisnis memiliki perbedaan yang cukup mendasar, sehingga dalam tataran praktisnya seringkali ada masalah yakni benturan kepentingan keduanya khususnya dalam kegiatan Badan Usaha Milik Daerah (BUMD) yang bidang produksinya berkaitan dengan hajat hidup orang banyak, dimana dampaknya tujuan untuk mencapai kemakmuran masyarakat belum tercapai secara optimal. Tujuan dari kajian ini adalah untuk memahami dua unsur penting yakni unsur bisnis dan unsur negara yang harus sinergi dalam pengelolaan BUMD terkait upayanya untuk mencapai tujuan negara yakni kemakmuran masyarakat. Metode penelitian yang digunakan adalah penelitian doktrinal yang mengkaji data sekunder berupa bahan pustaka meliputi bahan hukum primer, sekunder, dan tersier. Pendekatan yang digunakan adalah pendekatan perundang-undangan, sejarah, dan konseptual, serta cara analisis kualitatif dengan interpretasi gramatikal, sistematis, dan teologis. Hasil penelitian memperlihatkan bahwa konsep bisnis harus ada dalam fungsi pemerintahan daerah sebagai implementasi kegiatan pemerintahan dalam kerangka otonomi daerah, sehingga makna bisnis yang dijalankan oleh pemerintah daerah esensinya adalah mempercepat terwujudnya kesejahteraan masyarakat. Sedangkan,  antinomi dalam pengelolaan BUMD, yakni benturan antara unsur negara yang identik dengan pelayanan publik dengan unsur bisnis yang karakteristiknya mengejar keuntungan harus disikapi dengan perubahan paradigma pemerintah daerah dalam memaknai keuntungan BUMD. Oleh karena itu, disarankan untuk memberikan rumusan yang jelas mengenai tugas pelayanan umum dalam bidang-bidang produksi yang terkait hajat hidup orang banyak dalam regulasi yang mengatur mengenai BUMD. Keywords: Politik Hukum, Bisnis, Badan Usaha Milik Daerah (BUMD), Kesejahteraan Sosial.

Abstract

This study investigates the potential of blockchain technology in safeguarding and managing Intellectual Property Rights (IPR) in Indonesia, focusing on copyrights and industrial property rights. It employs a qualitative descriptive methodology, using secondary data from relevant legislation and literature. Data analysis follows the Miles and Huberman technique. The results demonstrate that blockchain technology offers substantial promise in enhancing the protection and administration of IPR. It can validate copyright ownership, record copyright-related transactions, and enhance security and transparency in copyright management. Moreover, it can be relevant in safeguarding trademarks and patents, efficiently tracking ownership and usage, and preventing infringement. The study implies that the implementation of blockchain technology in IPR management in Indonesia requires more detailed regulations and collaboration among stakeholders. It also highlights the need to consider contemporary Islamic Law perspectives to ensure optimal protection for creative and intellectual rights in the digital age.

Abstract

The lack of partner knowledge regarding packaging, labels and hygiene that partners need to pay attention to makes the implementation team feel they have to provide education regarding matters regarding hygiene to partners and the surrounding community. The method of implementing activities is legal counseling and technical training on product packaging in accordance with statutory provisions as well as increasing the production capacity of household businesses. The obligation to meet food packaging standards in order to create safe food products is closely related to food labeling obligations. This PKM activity is an effort to empower MSME business actors in food production. So that MSME business actors can produce and package food according to food packaging and labeling standards, they are provided with training on packaging and making food labels that comply with regulations. Apart from that, MSME players are also given equipment assistance that can support and increase their production, but still taking into account statutory provisions. In the future, it is hoped that more MSME business actors will have legal awareness regarding food packaging and labels when carrying out their business activities
