Abstract

Penelitian ini mengkaji hukum jual beli lele jumbo yang digunakan sebagai sarana galatama dalam perspektif sadd adz-dzarī‘ah. Fenomena jual beli lele jumbo untuk keperluan galatama berkembang di tengah masyarakat sebagai bagian dari aktivitas hiburan berhadiah, namun praktik tersebut menimbulkan persoalan hukum karena mengandung unsur perjudian (maisir) dan potensi penganiayaan terhadap hewan. Penelitian ini bertujuan untuk menganalisis keabsahan transaksi jual beli lele jumbo serta menilai implikasi hukumnya berdasarkan prinsip sadd adz-dzarī‘ah dalam hukum Islam. Penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian lapangan. Data primer diperoleh melalui observasi dan wawancara dengan penjual, pembeli, serta pihak penyelenggara galatama di Kolam Pancing Batu Tembung Pasar 3 Kota Medan. Sementara itu, data sekunder bersumber dari literatur fikih muamalah, ekonomi syariah, serta pandangan ulama kontemporer yang relevan dengan kajian perjudian dan perlakuan terhadap hewan. Hasil penelitian menunjukkan bahwa meskipun jual beli lele jumbo pada dasarnya merupakan transaksi yang dibolehkan, namun penggunaannya sebagai sarana galatama menyebabkan perubahan status hukum transaksi tersebut. Berdasarkan prinsip sadd adz-dzarī‘ah, jual beli lele jumbo yang secara dominan ditujukan untuk kegiatan galatama dinilai tidak diperbolehkan karena berfungsi sebagai sarana menuju perbuatan yang diharamkan. Penelitian ini diharapkan dapat memberikan kontribusi terhadap pengembangan kajian fikih muamalah kontemporer serta menjadi rujukan bagi masyarakat dalam menjalankan aktivitas ekonomi yang sesuai dengan prinsip syariat Islam.

Abstract

This study aims to analyze the implementation of consumer protection in ferry services using fishing boats to Pandang Island, Batu Bara Regency and review it from the perspective of maslahah mursalah. This study uses an empirical juridical method with a statutory, empirical and conceptual approach. Data were obtained through interviews, observations, documentation involving ferry service managers, service users, and related parties and documentation studies by reviewing, examining, and analyzing various documents related to the research object to obtain relevant data. The results of the study indicate that consumer protection has been implemented through the provision of life jackets, safety briefings, fare transparency, and attention to weather conditions. However, the implementation is not optimal due to limited safety facilities, the unavailability of life jackets for all passengers, lack of supervision, and the potential for excess passenger capacity. Viewed from the perspective of maslahah mursalah, this ferry service is basically permissible because it provides benefits to the community and the local economy. However, deficiencies in safety aspects have the potential to cause harm that is contrary to the objectives of sharia, especially hifz al-nafs and hifz al-mal. Therefore, it is necessary to improve safety standards, provide adequate facilities, limit passenger capacity, and have more effective supervision.

Abstract

Background: Unregistered divorce is carried out without going through the official procedure at the Religious Court, making it unrecognized under state law despite being valid according to Islamic law. This situation creates various legal issues, particularly regarding the legitimacy of registering children with the Civil Registry and Population Administration Office after such a divorce. Purpose: This study aims to analyze the interplay between legal norms and cultural practices in unregistered divorce highlighting how these practices affect the legal identity of children and exploring their implications within both Islamic legal thought and anthropological perspectives. Methods: This study employs an empirical juridical approach using field research methods. Primary data were obtained through interviews with community leaders, religious figures, and residents who engaged in unregistered divorces. Meanwhile, secondary data were collected from legal literature, statutory regulations, and other scholarly references. The analysis was conducted qualitatively through the stages of data reduction, data presentation, and conclusion drawing. Findings: The study reveals that unregistered divorce is often legitimized by cultural consensus and religious approval at the local level, despite its non-compliance with formal legal procedures. Such practices contribute to the exclusion of children from official civil registration, limiting their access to legal rights. The findings indicate that religious authority and local customs operate as parallel legal systems, occasionally challenging the state’s regulatory framework. Theoretical and Practical Implications: The research enriches anthropological approaches to Islamic jurisprudence by illustrating how fiqh adapts and transforms in localized contexts. Practically, it suggests the need for culturally sensitive legal reforms and community-based legal literacy programs to bridge the gap between state law and community practices. Originality/Novelty: This study is among the first to integrate an anthropological reading of fiqh with empirical legal research on unregistered divorce in Indonesia, offering a nuanced understanding of how local Muslim communities reconcile religious norms with socio-legal realities.
