Abstract

Non-penal efforts are one of the efforts to tackle crime, including corruption crimes. The purpose of this study is to explain the KPK's non-penal efforts to tackle corruption. The method used is literature study with primary and secondary law materials. The result is that KPK's non-penal efforts are prevention efforts that complement efforts to eradicate corruption. The form of using the mass media to form public opinion about the consequences of corruption and criminal sanctions. In addition, it also encourages the formation of national mental health in state and government institutions, community organizations, political parties, the involvement of community organizations and universities in tackling corruption crimes. Abstract

Nowadays, food and beverage products are widely circulated in society. In the era of globalization of society, the traffic of goods including food/drinks across countries is not guaranteed to be halal. Even though religious obligations command us to consume halal food/drinks. With the existence of Law no. 33 of 2014 concerning Halal Product Guarantees and Government Regulation no. 39 of 2021 shows that there is legal certainty in the implementation of Halal Product guarantees. The problem is how to theoretically and empirically study the implementation of halal product guarantees from an Indonesian legal perspective. The research methods are normative juridical and sociological. The research results show that theoretically, the implementation of halal product guarantees is based on Law no. 33 of 2014 concerning Halal Product Guarantees reflects legal norms originating from God's Law (God Order), namely from the Al-Qur'an and Hadith, and has long been practiced in people's lives as a reflection of a person's or society's religious awareness. The process shows a circle of interaction that ends with the Halal Product Guarantee Law. Empirical studies explain that the implementation of halal product guarantees has been going on in people's lives for a long time so that it functions to create legal certainty, comfort and justice for the user community as well as realizing beneficial values for economic growth and community welfare. The existence of statutory regulations, legal institutions and public awareness of halal product guarantees are elements of a legal system. Empirical studies explain that the economic subsystem played by business actors has great energy to adapt quickly and utilize legal regulations and community culture to expand and develop their business. Abstract

Perkembangan teknologi digital memberikan kemudahan akses terhadap layanan keuangan, termasuk pinjaman online. Namun, kemunculan pinjaman online ilegal yang tidak terdaftar di OJK menimbulkan risiko hukum, finansial, dan psikologis bagi masyarakat, khususnya mahasiswa sebagai konsumen muda. Banyak kasus menunjukkan praktik intimidasi oleh debt collector, penyalahgunaan data pribadi, hingga bunga tinggi yang menjerat korban. Rendahnya literasi hukum dan keuangan digital di kalangan mahasiswa memperbesar kerentanan terhadap jeratan pinjaman online ilegal. Oleh karena itu, analisis yuridis mengenai perlindungan konsumen muda menjadi penting untuk menemukan strategi preventif dan solusi hukum yang efektif. Penelitian ini mengkaji empat permasalahan utama: (1) analisis kerangka hukum perlindungan konsumen terhadap praktik pinjol ilegal; (2) faktor-faktor penyebab rendahnya kesadaran hukum mahasiswa; (3) efektivitas regulasi dan pengawasan OJK; dan (4) pengembangan model edukasi hukum interaktif berbasis pendekatan sosio-yuridis. Penelitian difokuskan pada mahasiswa Universitas Stikubank Semarang sebagai kelompok representatif pengguna layanan digital, dengan dasar analisis pada UU Perlindungan Konsumen, UU ITE, dan POJK No. 77/2016.Metode penelitian menggunakan pendekatan yuridis normatif dan pendekatan sosio-yuridis diperlukan untuk melihat permasalahan ini secara holistik, dengan menggabungkan analisis norma hukum yang berlaku yaitu UU No 8/1999 tentang Perlindungan Konsumen, UU No 11/2008 tentang ITE, serta regulasi OJK terkait Fintect lending dan kondisi sosial mahasiswa yang rentan terhadap jeratan pinjaman ilegal. Data empiris diimplementasikan melalui program dengan menggunakan metode interaktif seperti webinar, studi kasus, live quiz, hingga simulasi cek legalitas aplikasi pinjaman.Analisis dilakukan secara kualitatif-deskriptif untuk menilai kesesuaian regulasi, efektivitas program, serta persepsi mahasiswa.

Abstract

This study examines corruption offenses in the disbursement of People’s Business Loans (KUR) based on Judgment No. 29/Pid.Sus-Tpk/2023/PN.GTO. The results of the study indicate that the criminal acts occurred as a result of the abuse of authority through procedural violations in the KUR disbursement process, which caused financial losses to the state. The judge’s legal reasoning was deemed consistent with the facts revealed during the trial, as all elements of the corruption offense were proven to have been met. Furthermore, the application of Article 3 in conjunction with Article 18 of the Law on the Eradication of Corruption Offenses, in conjunction with Article 55(1)(1) of the Criminal Code, against the defendant was also deemed appropriate. Banks need to strengthen their internal oversight systems, improve verification procedures in the credit granting process, and conduct periodic compliance audits to minimize the occurrence of irregularities in the future.
