Abstract

Lemahnya perlindungan hukum, membuat keadaan perempuan semakin terpojok. Salah satunya pada permasalahan femisida, yakni dapat diartikan sebagai pembunuhan kepada perempuan yang didasari oleh beberapa faktor, diantaranya, menganggap perempuan sebagai pihak lemah, perempuan sebagai korban dari ketidak adilan, perempuan sebagai layanan pemuas seks, hingga menganggap perempuan sebagai barang komoditi bisa diperjual belikan. Berbagai faktor inilah yang menjadi dasar maraknya perempuan sebagai korban. Penelitian ini bertujuan menemukan instrument hukum guna menekan angka femisida yang semakin meningkat hingga saat ini. Fakta terbaru kasus kekerasan pada perempuan akhir-akhir ini semakin meningkat, data dalam CATAHU pada tahun 2022 terjadi peningakatan sebanyak 50% dari tahun 2020. Metode penelitian yang digunakan adalah jenis penelitian hukum normatif dengan analisis hukum yang digunakan dalam penelitian ini preskriptip analisis. Dengan maraknya kasus kekerasan yang mengakibatkan kematian perempuan sudah selayaknya pemerintah mengambil sikap atas permasalahan ini.

Abstract

Contempt of court term in Indonesia has been initially originated in the general definition of Law 14th 1985 on Supreme Court item 4 paragraph 4. In that general definition, it implied an obligation to confirm the law soon specifically regulating about the contempt of court in Indonesia. The perspective of legal experts and practitioner, were expected to contribute within the implementation of contempt of court regulation. Controversy on contempt of court started being a polemic as Law Draft of Criminal Code has appeared, in which within one of this law draft has inserted articles about contempt of court. This research was aimed to analyze factors that could cause contempt of court and its urgency in forming the regulation of contempt of court in Indonesia. The method in this research was juridical-empirical method. Moreover, the researchers in this research attempted to describe point of views of legal practitioners in Malang that were obtained from interview and observation with judges, prosecutors, and lawyers. The researchers used qualitative approach as the type of research approach. This research result explained that the prevalence of contempt of court case until recently was appeared due to the lack of public awareness in complying with the law and low ethical behavior of the law of either the society or law enforcer.

Abstract

There are still relatively few people with disabilities who complete their education up to the university level in Indonesia. In contrast, Singapore and the United States are known for their high levels of innovation, especially in promoting equality in education. Three countries—Indonesia, Singapore, and the United States—share a common commitment to realizing the protection of disability rights. This research employs normative legal research methods, utilizing both statutory and comparative approaches. The findings of this study reveal that Singapore's universities have the highest percentage of disability-friendly institutions, with approximately 60% of colleges maintaining specialized Disability Services units. In the United States, only 4.7% of colleges offer Disability Services, while in Indonesia, the figure stands at 1.48%. Substantial, structural, and cultural challenges persist in all three countries when it comes to fulfilling the right to education, particularly concerning funding policies. Each nation needs to cultivate a culture of anti-discrimination in disability education. Notably, Indonesia has yet to implement an inclusive curriculum in higher education. This paper holds significant importance in the context of improving educational services for individuals with disabilities, ultimately contributing to the realization of equality in the education system.

Abstract

Penelitian ini memfokuskan permasalahan ketenagakerjaan masih menjadi permasalahan krusial hingga saat ini. Maraknya kasus yang berkaitan dengan tenaga kerja seolah menunjukkan lemahnya peran hukum dalam menjawab permasalahan ini. Perlu adanya kebersamaan dalam mengambil solusi guna menyelesaikan masalah ini, khususnya pada kasus pemutusan hubungan kerja secara sepihak yang banyak terjadi di Indonesia. Bagaimana dasar hukum tentang permasalahan ini. Penelitian ini menggunakan pendekatan yuridis normatif, yang bertujuan mempelejari hukum tentang cara penyelesaian perselisihan hubungan industrial pada permasalahan pemutusan hubungan kerja secara sepihak dalam hukum ketenagakerjaan dan hukum Islam. Bahan hukum dalam penelitian ini berasal dari peraturan perundang-undangan terkait penyelesaian PHK sepihak, serta dari sumber hukum Islam. Masalah PHK yang terjadi pada karyawan Pertamina, seakan menggambarkan pola pemutusan hubungan kerja yang masih jauh dari kesan adil. Seharusnya PHK menjadi jalan terakhir dari suatu solusi yang diambil karena masalah yang ada dalam perusahaan. Islam sangat menjunjung prinsip adil dan setara. Setara dalam arti antara majikan dan karyawannya memiliki posisi yang setara, sama-sama membutuhkan. Mempunyai hak dan kewajiban yang setara, majikan dapat memperolaeh hak dari karyawannya berrupa jerih payah dalam pekerjaannya, sedangkan majikan juga harus mememnuhi kewajibannya bagi karyawan, yaitu memberikan gaji atas pekerjaannya

Abstract

This study aims to analyze the effectiveness of derden verzet as a legal protection mechanism for third parties in civil execution disputes in Indonesia and to assess its relevance to the achievement of Sustainable Development Goals (SDGs), particularly Goal 16 on peace, justice, and strong institutions. Employing normative legal research with a case approach, this article examines Decision No. 372/Pdt/2020/PT.Bdg and relevant procedural norms under the HIR/RBg framework, supported by doctrinal and human-rights-based justice literature. The findings show that derden verzet is conceptually designed to safeguard third-party property rights affected by final court judgments; however, its implementation remains constrained by procedural formalism, a heavy burden of proof, limited public awareness, and inadequate procedural safeguards in summons and evidentiary examination. In the analyzed case, the third party’s attempt to reclaim property rights was impeded despite indications that the transfer of rights occurred in the absence of good faith, demonstrating a gap between procedural compliance and substantive justice. This condition undermines legal certainty and weakens access to justice, contradicting the institutional objectives promoted by SDG Goal 16. The novelty of this study lies in repositioning derden verzet not merely as an extraordinary procedural remedy but as a substantive rights-protection instrument within a human-rights-oriented civil justice reform agenda, while identifying key normative deficiencies such as unclear standing requirements and undefined criteria of “harmed interests.” Accordingly, the study recommends clearer judicial guidelines and standardized procedural rules to strengthen third-party standing assessment, improve structured evidentiary review, and reduce excessive formalism to ensure more effective protection and a more accountable civil justice system.
