Abstract

Regional head elections held simultaneously on a regular basis in five years held in several regions by the mandate of Law Number 10 of 2016 still leave some problems. These problems include pre-post-conflict local elections when post-conflict local elections and post-conflict local elections. If some of these problems are described, one of them is the problem before the post-conflict local election process, namely the issue of incumbent leave. Regarding the arrangement of incumbent leave, there is still controversy. This has a significant impact on the holding of regional head elections. Some regional heads who are running for re-election in the following period (incumbent) object to the obligation of leaves contained in Article 70 paragraph (3) of Law Number 10 of 2016. However, on the other hand, many things must be considered to maintain the contents of Article 70 paragraph (3) regarding the obligation of incumbent leave. The research is descriptive analytical, namely making a precise, factual enunciation and accurately dealing with the facts. This research is a normative juridical approach with the Law approach (Concept approach) and conceptual approach (Conceptual Approach). Obligations regarding incumbent leave are mandatory for incumbents when nominating themselves again in the next period, although in some other laws and regulations governing voluntary consent of absence rules.

Abstract

Sejak tahun 2018 Pemerintah Daerah Purworejo sudah mulai serius untuk membenahi kebijakan demi terciptanya pelayanan publik yang inklusi. Untuk menuju kabupaten yang ramah difabel tentunya diperlukan komitmen tinggi terhadap implementasi Peraturan Daerah tentang jaminan hak-hak difabel tersebut diantaranya tentang apa saja fasilitas umum yang telah dimiliki, apa tantangannya dan apa yang perlu dipersiapkan guna menghadapi tantangan tersebut. Kajian dalam penelitian ini memfokuskan pada implementasi Peraturan Daerah Nomor 8 Tahun 2018 mengenai jaminan hak-hak kaum difabel di lingkungan kabupaten Purworejo yang telah berjalan selama 1 tahun terakhir. Penelitian ini bertujuan untuk mendeskripsikan implementasi Peraturan Daerah Nomor 8 Tahun 2018 mengenai jaminan hak-hak kaum difabel di lingkungan kabupaten Purworejo yang telah berjalan selama 1 tahun terakhir. Penelitian ini merupakan penelitian deskriptif kualitatif dengan pendekatan yuridis empiris. Teknik dalam pengumpulan data yang dilakukan yakni melalui obesrvasi, wawancara langsung kepada narasumber serta dokumentasi terhadap data-data yang berkaitan dengan kebijaka pemenuhan hak-hak kaum difabel yang selanjutnya dianalisa dan dihasilkan kesimpulan. Hasil penelitian menemukan factor yang menjadi faktor pendukung serta faktor penghambat dalam implementasi Perda Kabupaten Purworejo Nomor 8 Tahun 2018 tentang Perlindungan dan Pemenuhan Hak Penyandang Disabilitas diantaranyafaktor komunikasi, factor sumber daya, factor anggaran dan kondisi social lingkungan dan ekonomi.

Abstract

The New Normal era during the covid-19 pandemic resulted in industry 4.0 business players having difficulty in dealing with dispute resolution due to financial problems and policy restrictions. The reformation of online dispute resolution media is needed due to the difficulty of mobility and the high cost cutting. Before the implementation, it is necessary to have concrete formula of an online dispute resolution concept because the legal basis in Indonesia is not yet qualified. This study aims to conceptualize the legal basis for online dispute resolution in the business world, which is currently not accommodated by the Indonesian laws. It also examines the development of an online dispute resolution model as a technical regulation applied to the industrial sector 4.0. This study uses legal normative research. The study approach uses an online dispute resolution conceptual system and alternative dispute resolution legislation. The results show that online dispute resolution is a new form of quick, inexpensive justice principle that can reform business law in the technology era. Several dispute resolution models can be developed online and used for implementing regulations, especially for dispute resolution media in the industrial sector 4.0.Era New Normal di masa pandemi covid-19 mengakibatkan para pelaku usaha industri 4.0 mengalami kesulitan dalam menangani penyelesaian sengketa karena masalah keuangan dan pembatasan kebijakan. Reformasi media penyelesaian sengketa secara online perlu dilakukan untuk mengatasi kendala sulitnya mobilitas dan pemotongan biaya tinggi. Sebelum dilaksanakan, terlebih dahulu perlu ada rumusan konkrit konsep penyelesaian sengketa secara online karena landasan hukum di Indonesia belum memenuhi syarat. Tujuan dari penelitian ini adalah untuk mengkonseptualisasikan dasar hukum penyelesaian sengketa online di dunia bisnis yang saat ini tidak diakomodir oleh undang-undang Indonesia. Selain itu juga mengkaji pengembangan model penyelesaian sengketa online sebagai regulasi teknis yang dapat diterapkan pada sektor industri 4.0. Studi ini menggunakan penelitian hukum normatif. Pendekatan yang digunakan ialah sistem konseptual penyelesaian sengeketa online dan perundang-undangan alternatif penyelesaian sengketa. Hasil studi menunjukkan bahwa penyelesaian sengketa online adalah bentuk baru dari asas keadilan yang cepat dan murah yang bisa mereformasi hukum bisnis di era teknologi. Beberapa model penyelesaian sengketa dapat dikembangkan secara online dan dapat digunakan sebagai dasar implementasi aturan, khususnya untuk media penyelesaian sengketa di sektor industri 4.0.

Abstract

In recent months the world has faced a serious case in the form of the Covid-19 pandemic. All work together in order to reduce the number of increasing cases of Covid-19. Including among them is the state of Indonesia. Where Indonesia is slowly but surely increasing the number of victims from both ordinary people and medical personnel. The mortality ratio is 8%. Some of the deaths were due to Covid-19 medical personnel. The ratio of the death rate due to Covid 19 in Indonesia is recorded as the highest in the Southeast Asia region. Medical personnel are a profession where handling Covid-19 is at the forefront. However, the Indonesian government has not been able to meet the needs of medical personnel in order to serve or treat positive COVID-19 patients. Several government referral hospitals for covid-19 patients do not yet have sufficient medical equipment such as PPE, N95 Mask, Hand Sanitazer and others. This of course is not in accordance with Law Number 36 of 2014 concerning health workers. The research method used in this article is a normative research approach with a statute approach. The purpose of writing this scientific article is to provide recommendations regarding the government's responsibility for the rights of medical personnel as stipulated in Law Number 36 of 2004 concerning Health Workers.Keywords: Health Workers, Covid-19, Legal Protection

Abstract

Abstract:Legal reform in the field of judicial power is the focus of the Judicial Power in the context of revamping the Indonesian judiciary. In the development of judicial power reform, one of which is the authority of the Administrative Court, as contained in the Supreme Court Regulation Number 2 of 2019 on Guidelines for the Settlement of Administrative Court that the object of the lawsuit for State Administrative disputes extends to matters relating to unlawful acts committed by government/onrechtmatige overheidsdaad (OOD). This research was conducted in order to analyze problems related to the implementation of Article 2 of the Supreme Court Regulation No 2/2019 related to unlawful acts committed by government. The research method used is normative research with a statutory approach and case approach. This article finds that factual actions of the government can be the factual actions of the government that can be the object of disputes for lawsuits against unlawful acts carried out by agency or government officials. Many decisions of unlawful acts carried out by government/onrechtmatige overheidsdaad (OOD) at the first level tend not to grant the lawsuit with the argument of different interpretations by the judge for the unlawful act.Keywords: Administrative Court; Onrechtmatige overheidsdaad; unlawful acts.Abstrak:Reformasi hukum dalam bidang kekuasaan kehakiman menjadi fokus Mahkamah Agung dalam rangka pembenahan lembaga yudikatif Indonesia tersebut. Dalam perkembangan reformasi kekuasaan kehakiman salah satunya yakni kewenangan Peradilan Tata Usaha Negara, sebagaimana terdapat dalam Peraturan Mahkamah Agung No. 2/2019 tentang Pedoman Penyelesaian Sengketa Tata Usaha Negara bahwa obyek gugatan sengketa Tata Usaha Negara meluas pada hal yang berkaitan Perbuatan Melanggar Hukum yang dilakukan oleh Badan/Pejabat Pemerintah atau onrechtmatige overheidsdaad (OOD). Artikel ini mengalanisis problematika dalam implementasi Pasal 2 Perma No2/2019 terkait Perbuatan Melanggar Hukum yang dilakukan oleh Pemerintah. Metode penelitian yang digunakan merupakan penelitian normatif dengan pendekatan peraturan perundang-undangan dan pendekatan kasus. Artikel ini menemukan bahwa Tindakan Faktual pemerintah dapat menjadi objek sengketa Gugatan Perbuatan Melanggar Hukum yang dilakukan oleh Badan/Pejabat Pemerintah. Banyak putusan dari Perbuatan Melanggar Hukum yang dilakukan oleh Badan/Pejabat Pemerintah (onrechtmatige overheidsdaad) pada tingkat pertama cenderung tidak mengabulkan gugatan dengan dalil penafsiran berbeda-beda oleh hakim atas tindakan perbuatan melanggar hukum tersebut. Abstract

Diversi merupakan upaya penyelesaian perkara pidana anak yang dilakukan di luar pengadilan dan menjadi prinsip utama yang dianut oleh Sistem Peradilan Pidana Anak di Indonesia. Penelitian ini menggunakan metode yuridis normative dengan pendekatan case approach. Penelitian ini dilakukan dalam rangka mengetahui efektivitas pelaksaan diversi dengan ditinjau dari fiqh Maslahah Mursalah. Dalam pelaksanaan diversi sejauh ini cukup berhasil dimana dari kasus yang sampai pada tingkatan kejaksaan pada kurun waktu 2 tahun selesai pada tahap diversi dan tidak berlanjut pada proses peradilan. Dimana diversi sebagai bentuk perwujudan keadilan restorative di Indonesia. Hal tersebut sesuai dengan bagaimana prinsip Maslahah Mursalah berlaku dimana mengambil lebih banyak manfaat daripada mudharat dalam penentuan sebuah hukum.

Abstract

There are still relatively few people with disabilities who complete their education up to the university level in Indonesia. In contrast, Singapore and the United States are known for their high levels of innovation, especially in promoting equality in education. Three countries—Indonesia, Singapore, and the United States—share a common commitment to realizing the protection of disability rights. This research employs normative legal research methods, utilizing both statutory and comparative approaches. The findings of this study reveal that Singapore's universities have the highest percentage of disability-friendly institutions, with approximately 60% of colleges maintaining specialized Disability Services units. In the United States, only 4.7% of colleges offer Disability Services, while in Indonesia, the figure stands at 1.48%. Substantial, structural, and cultural challenges persist in all three countries when it comes to fulfilling the right to education, particularly concerning funding policies. Each nation needs to cultivate a culture of anti-discrimination in disability education. Notably, Indonesia has yet to implement an inclusive curriculum in higher education. This paper holds significant importance in the context of improving educational services for individuals with disabilities, ultimately contributing to the realization of equality in the education system.

Abstract

AbstractFemale domestic workers still dominate the numbers as victims of rights violations. Female domestic workers are not only vulnerable to having their rights as workers violated, but also experience discriminatory treatment and even sexual harassment. The purpose of this article is to look at the background to the formulation of government policy lines in an effort to ensure the fulfillment of the rights of women workers in the domestic sector. This research is normative juridical research using a statute approach. The results of this research show that the Domestic Workers Protection Bill has the characteristics of a responsive legal product which reflects society's sense of justice, especially for domestic workers who are dominated by women. On the other hand, in the theory of legal protection, the Indonesian government is obliged to ratify ILO Convention 189 concerning the Protection of Domestic Workers and as soon as possible pass the Domestic Workers Protection Bill. This article is a form of thought contribution in efforts to uphold human rights, especially the rights of women workers.Keywords: Female domestic workers; Legal Policy; Legal ProtectionAbstrakPerempuan pekerja domestik masih mendominasi angka sebagai korban pelanggaran hak- hak. Perempuan pekerja domestik tidak hanya rentan dilanggar haknya sebagai pekerja, namun mendapat perlakuan diskriminatif hingga pelecehan seksual. Tujuan dari artikel ini adalah melihat latar belakang penyusunan garis kebijakan pemerintah dalam upaya menjamin terpenuhinya hak-hak pekerja perempuan di sektor domestik. Penelitian ini merupakan penelitian yuridis normative dengan menggunakan pendekatan statute approach. Hasil penelitian ini menunjukkan bahwa RUU Perlindungan Pekerja Rumah Tangga memiliki karakteristik produk hukum yang responsif dan telah mencerminkan rasa keadilan masyarakat khususnya bagi pekerja rumah tangga yang didominasi oleh perempuan. Disisi lain dalam teori perlindungan hukum, pemerintah Indonesia wajib melakukan ratifikasi Konvensi ILO 189 tentang Perlindungan Pekerja Rumah Tangga dan sesegara mungkin mengesahkan RUU Perlindungan Pekerja Rumah Tangga. Abstract

The rapid advancement of technology is a double-edged sword. While it provides easy access to information, it also opens the door to unrestricted access, including personal data. Governments worldwide are leveraging technology to enhance their connection with citizens and deliver top-tier public services. In this vein, the Provincial Government of DKI Jakarta as an Indonesian local government, launched a SuperApps called JAKI in 2019 as a dynamic platform for two-way communication between DKI Jakarta residents and local authorities. This research employs empirical juridical methods, incorporating statutory and conceptual approaches. Drawing from primary sources, including DKI Jakarta Regional Secretariat Decree Number 99 of 2022 concerning the Citizen Relations Management application and interviews with the Smart City Developer Service Unit, the study demonstrates that JAKI ensures robust data security. The app complies with ISO 2700, an international standard that regulates information security management systems and fulfils the three core components: confidentiality, integrity and availability. Furthermore, in alignment with Al Farabi's concept of information security accountability, the emphasis is placed on collaborative social responsibility between data owners and collectors, represented by DKI Jakarta Provincial Government. This cooperation is both fair and beneficial, adhering to the fundamental principles of political philosophy and ethics.
